PUBLIC UTILITIES COMMITTEE MEETING
Minutes of Meeting Held Tuesday March 18, 2003
Chairman Eileen Madden called the meeting to order at 530 p.m. Also present
were Committee members Aid. Rick Petfalski, Aid. Eric Schroeder, Public Utilities
Superintendent Scott Kloskowski, Dave Simpson and Ruekert & Mielke
representative Steve Schultz. Engineering/Building Inspection Director Sean
McMullen was excused.
It was noted that the meeting was posted in accordance with the Open Meeting
Law.
Those present recited the Pledge of Allegiance.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Aid. Petfalski moved to approve minutes of February 17, 2003. Seconded
by Aid. Schroeder, motion carried 3-0.
STATUS OF PROJECTS
• Ruekert & Mielke representative Steve Schultz updated the committee on the
attached status of on -going projects as follows:
• Janesville Road Box Culvert— Ruekert& Mielke is working on the design,
at this point it is not critical because the County does not anticipate box
culvert reconstruction prior to the fall. The design will be sent the City for
review in April.
• Janesville Road Water Main — the project was awarded and the contracts
are being processed. The public hearing to amend the WCA district is
scheduled for March 25, 2003.
• Mc Shane Pump Station — Leak was repaired in the gravity system on
March 1, 2003. Start up was yesterday everything was working as
planned. There is a question on the necessary trimming of the inpellers of
the pumps. Startup activities will continue this week and punchlist items
will be given to the contractor. Superintendent Kloskowski noted that
while he was present everything worked well. There was a small problem
with getting enough water into one end of the tank to test the gates that
would open after the event and wash the remainder out of the tank. Water
was being trucked in. The gates seemed to work correctly but they were
going to test them each three times.

• Well Site Exploration — three sites were identified in the Big Muskego
Estates area. One lot in the subdivision, one in an outlot and one in a
preservation area on the west side of Durham. Mr. Schultz reported on
the results of the test borings and recommended that the City use the site
on the outlot to drill a test well with the option to go to a production well
immediately. Ruekert & Mielke is predicting a 500-1000 gallon per minute
flow out of this well. It would be beneficial to the City to use the same
contractor for both the temporary and production well. Mr. Schultz also
noted that he identified the homes in the area and will monitor the private
wells during test pumping.
SEWER UNFINISHED BUSINESS
Status of Town of Norway Contract - Utility Superintendent Scott Kloskowski
advised the committee the City met with the Town of Norway to negotiate the
contract. Town of Norway will draw up a formal proposal and present it to the
City of Muskego.
Review RCA and Hook Up Charges — Knutson Property (Hillendale) — This item
was brought back to the Committee for further discussion. Staff was under the
assumption that this property was connected to water and was also a commercial
property. The property is not connected to water and therefore would need a
meter to be installed. The property is classified residential not commercial. At
this time, the property owner only has their personal horses and are not
operating as a commercial business. Residential users are not required to have
a meter unless connected to water. The cost of installing a meter would be
greater than paying the original additional .50 REC. Aid. Petfalski moved to
leave the decision as agreed at last month meeting to charge .5 REC with
no meter. Aid. Schroeder seconded. Motion carried 3-0.
SEWER NEW BUSINESS
Review Deferred Assessment — 2209.960 — Dave Romelski (Hi View Sewer
Project - Dave Romelski was present to request the deferred assessment on his
property, tax key 2209.960, be waived or forgiven. Mr. Romelski stated he had
no intent on splitting the property. He also stated there is a swamp area in the
back 3`d of his property that would make it hard to put a house on. Mr. Romelski
explained that the lien on the title is incurring interest every year and he is
worried that in 20 years if he would sell the property a title company may react
adversely to insuring the interest. Mr. Romelski suggested a deed restriction be
placed on the property, which would prohibit a future owner to divide the
property. Plan Director Brian Turk stated in a memo that the staff does not
support the use of private covenants to deed restrict properties against further
division. A future landowner can petition the courts to vacate the restriction
without approval of the Common Council. The owner could then connect to

sewer without obligation to pay an assessment. Superintendent Kloskowski
stated the assessment policy was only 10 years old and each are reviewed every
five years. Alderman Petfalski moved to deny request for forgiveness but
would like to look at options to capping the interest accruing at next
month's meeting. Aid. Schroeder seconded. Motion carried 3-0.
Review Sobeck's sewer usage charge/cottage — Superintendent Kloskowski
stated that it has come to the Utility Department's attention there is a cottage on
the property at S79 W16419 Woods Road that is connected to sewer and has not
been charged for an RCA or sewer usage. The tavern on the property was
connected and charged at the 1986 rate of $272.50 per REC. In the past with
these situations the practice has been to charge the RCA at the rate of the year
of connection and back bill sewer usage 2 years plus the current year. The
property is in an estate and the potential new owner is aware of the charges and
does not have a problem with it. Aid. Petfalski moved to charge the RCA at
the rate of the year of connection and back bill usage 2 years plus the
current year. Aid. Schroeder seconded. Motion carried 3-0.
WATER UNFINISHED BUSINESS
Status of Request to PSC for water rate change — Superintendent Kloskowski
informed the committee the PSC hearing was held on March 13, 2003. There
were no objections. Some time this week the City should have formal approval
of rates from the PSC and they should be in place for the 2"d quarter of this year.
Aid. Petfalski moved to approve the rate increase for the 2"d quarter of
2003. Aid. Schroeder seconded. Motion carried.
Status of WCA 10 District and water extension aareement with Towne Realtv and
review public hearing minutes — Superintendent Kloskowski reported the public
hearing was held March 11, 2003. There was a large turn out. The minutes of
the public hearing were included in the packets. There have been no additional
comments received since the public hearing. Aid. Schroeder agreed that the
Lake Trust Area and McShane should be included in the district. Aid. Schroeder
requested taking the McShane properties into consideration if/when the City
would run water up to the Lake Trust to assist the property owners on McShane
with the assessment. Aid. Petfalski suggested a policy be written specific to
each project. The Committee requested an item be added to next month's
agenda to discuss writing of specific policies related to water
assessments. Aid. Schroeder questioned including Baylawn subdivision in the
WCA District. Superintendent Kloskowski explained that if they were removed
there would leave a hole in the district and does not see any reason to remove
them. The only way being in the district would affect them is if they decide to
hook up to City water.

REVIEW OF DEFERRED ASSESSMENTS/SEWER & WATER - Aid. Petfalski
questioned the interest rate of 8% on deferred assessments. Superintendent
Kloskowski explained for each project the rates are discussed and the Finance
Director justifies staying with 8%.
ACCEPTANCE OF IMPROVEMENTS — Nothing to report.
REPORT OF UTILITY SUPERINTENDENT — Superintendent Kloskowski stated
he received a call from the president of the Lakewood Meadows water trust.
They are having some problems with their water system. The subdivision is
discussing the possibility of the City taking over their water system. They are
having a problem with tannins in the well. The DNR is concerned that surface
water is running in. The subdivision has a deadline of the end of the month to
run a camera into the well to determine the problem. Superintendent Kloskowski
is meeting with the subdivision president tomorrow. Consultant Steve Schultz
explained if the City took over the system residents would have to pay the same
rates as those on the City water system. Mr. Schultz stated tannins are not a
health issue but an aesthetic issue. The Committee is interested in negotiating
depending on the problem.
Superintendent Kloskowski reported a sewer back up on Dover Lane. He
explained the lateral across the street broke on private property. The ordinance
I, is written that the property owner is responsible for repairs. Superintendent
Kloskowski stated that MMSD has been having discussion on making repairs to
the laterals on private property. The Committee will require the property owner to
make repairs.
