PUBLIC UTILITIES COMMITTEE MEETING
Minutes of Meeting Held Monday, February 17, 2003
Chairman Eileen Madden called the meeting to order at 7:06 p.m. Also present
were Committee members Ald. Rick Petfalski, Aid. Eric Schroeder,
Engineering/Building Inspection Director Sean McMullen, Public Utilities
Superintendent Scott Kloskowski and Ruekert & Mielke representative Steve
Schultz.
It was noted that the meeting was posted in accordance with the Open Meeting
Law.
Those present recited the Pledge of Allegiance.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Aid. Petfalski moved to approve minutes of January 20, 2003. Seconded by
Aid. Schroeder, motion carried 3-0.
STATUS OF PROJECTS
• Ruekert & Mielke representative Steve Schultz updated the committee on the
attached status of on -going projects as follows:
McShane Storage Facilities — Start up is tentatively scheduled for March
14th with a final payment date of May 30th
Well Explorations Project — (Big Muskego Estates) test boring locations
have been completed. After borings are completed the contractors will
drop a small pump to get preliminary data to see how much water is
available. Ruekert and Mielke is preparing a map showing recommended
boring location and letter report on geophysical survey results and
recommendations.
Engineering/Building Director Sean McMullen reported on the following projects:
Freedom Square Water Project — The Agreement to Assume Certain
Assets and Liabilities is scheduled to go to Council for approval. HNTB,
the appraiser hired by the City, is going through the process of acquisition
of the easement. HNTB will handle the entire process and will act as a
buffer between the City and Parkland Ventures. Council must still approve
the first offer and final offer. HNTB should have the easement acquired in
less than 60 days.

• SEWER UNFINISHED BUSINESS
Status of Town of Norway Contract - Utility Superintendent Scott Kloskowski
advised the committee the matter is back in circuit court. However, the Town of
Norway Sanitary District Board has stopped the process for reasons unknown at
this time.
Further review of Sewer Backup Manual — The Committee reviewed sewer
backup manual and made one addition to the Information for Homeowners &
Residents handout. The Committee clarified the bold sentence in the last
section, to read; Maintenance and repair of the lateral line is the owner's
responsibility from the house to the right of way. From the right of way to
the sewer line is the Utilities responsibility. A line was also added to the
diagram showing the right of way. Aid. Petfalski moved to approve the
above additions to the Sewer Backup Manual. Aid. Schroeder seconded.
Motion carried 3-0.
SEWER NEW BUSINESS
Review Chapter 21 — City's Responsibility of Repairs Section 21.05 Rules and
Regulations (5) Maintenance of Services — Director McMullen stated this was a
"house cleaning" matter and needed to be clarified who's responsible for sewer
• line repairs. Director McMullen recommended removing the last sentence of (c)
The user is responsible for their service pipe from the sewer main through their
premise, as it contradicts the first line of Section 5, All sewer services within the
limits of the City from the street main to the property line and including all control
between the same shall be maintained and repaired without expense to the
property owner except when they are damaged as a result of negligence or
carelessness on the part of the property owner. Aid. Petfalski moved to
remove the last sentence of Chapter 21.05 (5) (a) The user is responsible
for their service pipe from the sewer main through their premise. Aid.
Schroeder seconded. Motion carried.
Review Sewer and Water Plans for Chamberlain Hills Subdivision — Director
McMullen reported the plans have gone through a second review and there are
sanitary sewer issues that need to be resolved. Director McMullen is
recommending conditional approval so the plans can be sent to MMSD and the
DNR. Aid. Petfalski moved to approve the sewer and water plans for
Chamberlain Hills subdivision subject to technical changes. Aid.
Schroeder seconded. Motion carried.
Review RCA and Hook Up Charges — Knutson Property (Hillendale) — Director
McMullen informed the committee Tim and Roseann Knutson of W208 S8241
Hillendale have an accessory building with a floor drain that is hooked up to City
• sewer. The Knutson's are being charged 1 full REC for the accessory building.
Director McMullen referred to Ordinance #1098 to amend Chapter 21, Section

• 21.06(2). It states, All Buildings shall be assigned a minimum value of one (1)
REC. Exception: In the case of a business property with multiple buildings, the
property shall be assessed a minimum of one (1) REC for the main building, and
an additional minimum .5 REC for each additional building connected to sewer.
Director McMullen stated the property must have a primary building for an
accessory building to be allowed. The Committee agreed to charge .5 REC for
the accessory building subject to a review of the usage on an annual basis.
WATER UNFINISHED BUSINESS
Status of Request to PSC for water rate change — Utility Superintendent Scott
Kloskowski reported that a hearing has been tentatively scheduled for March
19th. Finance Director Dawn Gunderson will send out the notice.
Status of WCA 10 District and water extension agreement with Towne Realty —
Director McMullen advised the Committee an informational meeting has been
scheduled for March What 5:30 PM in the Muskego Room. Director McMullen
also stated the bid date for the project will be the 2nd week in March.
Final review and approval of agreement with Freedom Square for acquiring
Water System — The Committee reviewed agreement. Director McMullen stated
all blank lines will be filled in prior to signing. Aid. Petfalski made a
• recommendation to Council for approval of agreement with Freedom
Square for acquiring water system. Aid. Schroeder seconded. Motion
carried.
WATER NEW BUSINESS
Review comments from the Informational Meetina for Janesville Road Water
Proiect — Bids came in higher than expected. The TIF can cover up to St. Paul's
Church. The City will look at the CDA as another founding source for burying the
electric. Staff is recommending the available funds go toward the water project.
Aid. Petfalski made a recommendation to Council to award the Janesville
Road water project to Super Excavators with a bid of $910,309.00. Aid.
Schroeder seconded. Motion carried.
Aid. Petfalski made a recommendation to Council to reject bids for all of
Part B. Aid. Schroeder seconded. Motion carried.
WCA Amendment #11 — The Settlement on Woods Road — Director McMullen
informed the Committee that the water main extension district ended at the
DeAngelis farm and only includes a portion of the Settlement Subdivision. The
WCA District has already been amended to include the eastern section of the
Settlement Subdivision. If this piece were not added the only other options would
• be community or private wells. Aid. Petfalski moved to approve the
amendment to the WCA District adding the piece of the Settlement on

• Woods Road that was not already in the district. Aid. Schroeder seconded.
Motion carried.
Review bids for Janesville Road Water Main Proiect — Action was taken under
Water New Business — Review comments from the Information Meeting for
Janesville Road Water Project.
REVIEW OF DEFERRED ASSESSMENTS/SEWER & WATER - Nothing to
report.
ACCEPTANCE OF IMPROVEMENTS — Nothing to report.
REPORT OF UTILITY SUPERINTENDENT — Utility Superintendent Scott
Kloskowski informed the Committee of a leak in the forecemain between the High
School and the system. The leak is in the right of way and probably is the City's
responsibility to repair. Repairs will be done tomorrow. Director McMullen
believes an agreement with the High School could be made to share the cost.
REPORT OF ENGINEERING/BUILDING INSPECTION DIRECTOR — Nothing to
report.
