PUM20030120CITY OF MUSKEGO Approved PUBLIC UTILITIES COMMITTEE MEETING Minutes of Meeting Held Monday, January 20, 2003 Chairman Eileen Madden called the meeting to order at 7:06 p.m. Also present were Committee' members Aid. Rick Petfalski, Aid. Eric Schroeder, , Engineering/Building Inspection Director Sean McMullen, Public Utilities Superintendent Scott Kloskowski, Ruekert & Mielke representative Steve Schultz, Mayor Mark Slocomb, Aid. Butch Le Doux, and Mr. Randy St. Lawrence (Lake Meadows Water System). It was noted that the meeting was posted in accordance with the Open Meeting Law. APPROVAL OF MINUTES OF PREVIOUS MEETING Aid. Petfalski moved to approve minutes of special Joint Public Works/Public Utilities Committee meeting of April 9, 2002, which had been approved by the Public Works Department but had been omitted by the Public Utilities Committee, and the minutes of the Public Utilities Committee of December 16, 2002. Seconded by Aid. Schroeder, motion carried 3.0. • The recording secretary read the notice of closed session. STATUS OF PROJECTS Ruekert & Mielke representative Steve Schultz updated the committee on the attached status of on -going projects as follows: • Janesville Road Water Main Project — The plans have been completed and submitted. Bid Opening will be February 15, 2003. • McShane Storage Facilities — Backfilling and exterior water -proofing has now been completed. Wells are all shut off and level of West Lake has now gone down a foot. Small building walls are up as well as interior masonry walls for the bathrooms. • Jewel-Osco/Kohls Offsite water main — All punch list items completed and project can be closed if acceptable to the City. • Quietwood Creek East — Final design review letter submitted January 9, 2003. . Well Explorations Project — Phase I testing has been done by Ruekert & Mielke on the Big Muskego Estates site and results verified the depth of Public Utilities Committee Meeting — January 20, 2003 Page 2 the sand and gravel deposits. On the lake side it is approximately 180 ft. and doesn't go up too much as you go further east. This is a good potential for a well site. They also did some further testing to be able to distinguish between clay and nonclay layers. This data is being interpreted now and there will be a report by next meeting. Status on potential impacts to Well #7/Stoneridge Ground Water Remediation — The owners of the landfill have agreed to most of the items that the City is requiring. The landfill owners have gone back to the EPA to ask for alternatives on one type of well construction that has been recommended by Ruekert & Mielke. Engineering/Building Director Sean McMullen reported on the following projects: • SEWRPC's 208 Plan Amendments — Blattner property was approved by MMSD and SEWRPC to be included into the sewer service area. The process is now being started to secure approval for the May property. Hope to receive approval around the 15th of March. SEWER UNFINISHED BUSINESS Status of Town of Norway Contract - Mayor Slocomb advised the committee that he has been conferencing with City Attorney Stan Riffle regarding the contract. Attorney Riffle has been in contact with the Town of Norway and it has been suggested that a meeting be scheduled to see if an agreement can be reached prior to it going to circuit court. Further review of Sewer Backup Manual — Utility Superintendent Scott Kloskowski advised the committee that he will be working with the City Clerk and city staff to come up with a hand-out that is simplistic and can be given to any resident, in the future, that experiences a sewer backup. This handout would explain, in detail, the insurance claim steps to be taken if a backup ever occurs. Scott felt he should have something for committee review for the February meeting. Review 2002 sewer bill/Stoney Creek — Utility Superintendent Scott Kloskowski explained that at the November 18, 2002 meeting, the committee agreed to give the complex some relief because of the excessive gallons used for the P quarter as a result of grass wateringy. At that meeting, Aid. Petfalski had requested that the committee review the 4t quarter usage report when compiled. The committee reviewed usage and placed on file. SEWER NEW BUSINESS Review MMSD & Town or Norway 4th Quarter Billing for 2002 - The committee is reviewed and placed on file. Public Utilities Committee Meeting — January 20, 2003 Page 3 Review MMSD Capital Charges — The committee reviewed and noted the increase in capital charges. Utility Superintendent Scott Kloskowski explained the increase from last year that was expected. When MMSD does water course work that we are not attributed to, we receive a credit. They did less watercourse work so we received a smaller credit. The report was placed on file. Review Amended Final Sewer Resolution to refund for lateral (Lana Prooertv) — Building/Engineering Director Sean McMullen explained that while compiling information for the final review of Subdivider's Agreement and Letter of Credit for the Lang Property, it came to his attention that they were charged for a 6" sewer lateral for their property which was not installed. Aid. Petfalski moved to recommend Common Council to do a Third Amended & Revised Final Assessment resolution to delete the one 6" lateral for the Lang Property, and refund the $3,140.40 Seconded by Aid. Schroeder, motion carried 3-0. WATER UNFINISHED BUSINESS Status of Request to PSC for water rate change — Utility Superintendent Scott Kloskowski advised that the formal request has been sent to the PSC and the City has received confirmation of this request. There is a lot of work to be done and he feels that it will probably be at least three to four months before we • receive information. Presently the increase looks to be about 20%. That is less than originally anticipated. Further review of agreement with Freedom Square Condominium — Utility Superintendent Scott Kloskowski reported that he has received signed waivers from a majority of the owners and feels that we are ready to formally sign agreement realizing that there is one easement that is still required. Aid. Petfalski moved to have the City Attorney proceed with the necessary paperwork for the Utility to formally take over the water system. Seconded by Aid. Schroeder, motion carried 3-0. Status of WCA 10 District and water extension aareement with Towne Realtv — The WCA 10 and water extension has been approved. A copy has been sent to Attorney Molter's office and to Towne Realty. City is now waiting for a draft copy of a Letter of Credit and a fully executed agreement. Looking at a late February 2003 bid date. Sean also advised that they are proposing to schedule a March 6th informational meeting to bring all of the affected property owners on Durham Drive to discuss this project. This informal meeting is tentatively being scheduled for 6:30 PM. WATER NEW BUSINESS ' Review comments from the Informational Meeting for proposed Pioneer Drive Water Project — Utility Superintendent Kloskowski advised that the general Public Utilities Committee Meeting — January 20, 2003 Page 4 • consensus of property owners at the meeting was that there were not interested in connecting to the municipal water utility. He advised that there is one property owner, Willow Apartments, who are interested. Sean will contact them and discuss a possible single connection. Review radium standard compliance — Utility Superintendent Scott Kloskowski and Steve Schultz, representative from Ruekert & Mielke, discussed with the committee the need for a response letter to be sent to the DNR replying to their notice of noncompliance with the Utility's radium standard. The draft letter to the DNR explains the City's intent to abandon wells #4 and #6 as soon as a new shallow well can be constructed and to use well #5 as an emergency well. The letter also includes a timeline and states that the Utility would be agreeable to a consent order using the timeline that will meet the 2006 deadline. Aid. Petfalski moved to direct Utility Superintendent Scott Kloskowski to send letter to the DNR requesting consent order. Seconded by Aid. Schroeder, motion carried 3-0. DEVELOPMENT EXHIBITS Redman Development— Engineering/Building Inspection Director Sean McMullen reviewed the water and sewer plans for this proposed development for four (4) commercial properties and 55 units of duplex assisted senior living along . the existing Moorland Road corridor. Aid. Petfalski moved to approve the plans, as submitted, and to send plans to MMSD and DNR for approval. Seconded by Aid. Schroeder, motion carried 3-0. Quietwood Creek East— Engineering/Building Inspection Director Sean McMullen reviewed the second rendition of water and sewer plans for this proposed development noting that the project has been scaled back for the original submittal. Aid. Schroeder moved to approve the plans, as submitted, and to send plans to MMSD and DNR for approval. Seconded by Aid. Petfalski, motion carried 3-0. REPORT OF UTILITY SUPERINTENDENT — Utility Superintendent Scott Kloskowski discussed with the committee the proposed informational meeting scheduled for Monday, February 17, 2003, at 5:30 PM in the Muskego Room, lower level of City Hall, to discuss a possible water project on Janesville Road, Golden Country to College Avenue. He explained that he felt it would be good to keep the affected property owners aware of the status of the proposed water project that will be part of the TO district and paid for by Tax Incremental Funding if it becomes a viable project. REPORT OF ENGINEERING/BUILDING INSPECTION DIRECTOR— Engineering/Building Inspection Director Sean McMullen advised the committee ' of a request that he has received from Mr. Charles York, S71 W19288 Hillview Drive. Mr. York has been requesting municipal water service for a couple of Public Utilities Committee Meeting — January 20, 2003 Page 5 • years and his second well is now starting to fail. Steve Schultz, Ruekert & Mielke, advised that there is some grant funding available from the State for situations like this where an elderly individual is on a fixed income and he will send the materials to Sean so that he can give to the resident. Aid. Petfalski moved convene into Closed Session pursuant to State Statute 19.85(1)(e), Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; more specifically possible purchase of property for well site. Seconded by Aid. Madden, motion carried 3-0. Aid. Petfalski moved to reconvene into open session at 8:39 PM. Seconded by Aid. Schroeder, motion carried 3-0. Aid.
