Minutes of Meeting Held Monday, May 20, 2002
Chairman Dave Sanders called the meeting to order at 7:05 p.m. Also present were
Committee members Ald. Rick Petfalski, and Ald. Eileen Madden, Engineering/Building
Inspection Director Sean McMullen, Public Utilities Superintendent Scott Kloskowski
and Steve Schultz, representative from Ruekert & Mielke.
The committee recited the Pledge of Allegiance.
It was noted that the meeting was posted in accordance with the Open Meeting Law.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Ald. Petfalski moved to approve minutes of meeting held April 15, 2002. Seconded by
Ald. Madden, motion carried 3-0.
STATUS OF PROJECTS
The committee reviewed Consultant's Report dated 05/20/02, as attached.
• Hillendale Water Project (Assignment of Easement) — Sean advised the committee
that Waukesha County is in the process of foreclosing on the property on Hillendale and
as part of that foreclosure process, Waukesha County has indicated that when they gain
title of the property they will automatically deed us the 30 ft. easement which will
become Utility owned property. Once that is completed, Sean will be able to close out
the project.
Janesville Road Water Project - Steve Schultz, Ruekert & Mielke, advised the
committee that the survey work has been completed and that the design work is
continuing.
Freedom Square Water Project — Steve Schultz, Ruekert & Mielke, advised the
committee that the City has received an additional time extension request from the
DNR, a final 30-day extension was given in order for them to complete the process.
Everything including the well house protection plan, the contaminate use inventory
survey, revised site investigation and responses to all of their questions will be
submitted by this Friday and the DNR will then have a 30-day period in which to review
all of the submittals. Scott requested that Steve digitally send to the Plan Department,
c/o Dustin Wolff, a map of the wellhead protection area for this project.
Well Explorations Project — Steve Schultz, Ruekert & Mielke, advised the committee
that they are proceeding with the next phase of well exploration at the Community
• Center area. Preliminary work had been done this past Winter with a piece of

equipment in-house rented for another project that they were working on and what this
• equipment revealed was the sub -surface geology, underground. The problem with that
particular piece of equipment was that it didn't differentiate between rock and sand and
gravel. What they are looking for is a shallow sand & gravel well. After further review of
the geology of a number of private wells in that area, it looks like bedrock is going to be
deep enough and they are recommending that instead of spending more money to do
more geophysics which would result in recommending soil borings anyway, that the
committee by-pass that and go directly to soil borings. It would save approximately
$5,000.00. They have a boring company in the area and they will get prices from them
for these borings. What has to be determined is the areas that are acceptable based
upon the preliminary plans for the area.
Moorland Road Water Project — Sean advised the committee that the contractor is
doing scrapping and pavement removal and it will be several weeks before the
contractor will run the 12" water main extension south to Candlewood Creek
Subdivision.
McShane Storage Facility — Steve Schultz, Ruekert & Mielke, advised the committee
that the City has received DNR approval. All first round well measurements and testing
have been completed in order to set a baseline. Contracts have been forwarded to
contractors and we are waiting for signatures and submittals are starting to come in.
The Public Informational Meeting was held on Thursday, May 16th, and several
questions were asked by those in attendance. All of the residents who had their wells
• tested wanted to know the results. Sean provided the committee with correspondence
received from Dan Butler, Ruekert & Mielke, dated May 20, 2002, which shows the
names and addresses of residents who are participating in the private well monitoring
program along with the measured depth to water for each well and whether the well cap
was replaced with a vermin -proof cap. Total well depth is shown for wells if the
information was viable. The questions which could not be answered were about the
well pump or the depth at which it was set at other than asking the home owner, or
physically pulling the pump, there is no source of information on well pump setting
depths. Sean advised that a letter will be sent out to each resident, with a copy of Mr
Butler's report, and also a request to each resident to provide, if possible, the pump
information that would be in their records or could be obtained from the well installer, or
may be posted on their starter box. The Committee also requested that in the cover
letter it is very clearly spelled out to the residents to notify the listed personnel if there is
any change in air pressure, air bubbles, etc., as soon as possible and also stress the
importance of unplugging their pump and/or not using water so that the pump doesn't
burn out. Sean also stated that there is a PDF file containing the map in his City
Hall/Engineering folder that he will e-mail to Aid. Sanders and Aid. Madden. He will also
send a copy of the map along with Mr Butler's report with a cover letter to all residents
on the list.
Sean stated that the other issue brought up at the meeting was regarding the temporary
access road for this project. He stated that those in attendance unanimously felt that
• the access road should not be left as gravel because of the amount of dust and

maintenance that would be required. Sean explained that to add the cost for an
• overlay, approximately 2'/z inches thick by 20 ft. wide for approximately 900 feet would
cost somewhere between $16,000 and $18,000. He also commented that it may be
possible to coordinate the work being done on Moorland Road with a pulverizer and we
could actually bring a mill in to salvage the material and use it for City right-of-ways and
shoulders. After considerable discussion on the pros and cons, Ald. Madden moved to
authorize Sean to sign a change order for the road asphalt overlay for the additional
cost. Seconded by Ald. Petfalski, motion carried 3-0.
Scott stated that the last issue was concern voiced by one resident of the potential
building of restrooms and a pavilion over the storage site. The Committee agreed that
this project would be under the complete jurisdiction of the Parks & Recreation Board
and all inquiries should be directed to Craig Anderson, Recreation Director
The final issue to be discussed was a proposal from Miron Construction Company, Inc.
to strip the top soil off an area in Bluhm Park, south of McShane Road, place the
excavated material, reinstall the topsoil and reseed the disturbed areas. The proposal
would require a DNR Notice of Intent to be filed and may require a Chapter 30 and U.S.
Army Corps of Engineers permits. The cost of obtaining these permits is one of the
reasons the City chose not to require the fill to be left for use in the park while this
project was in the design phase. After considerable discussion, it was determined that
Sean will write a letter to Miron Construction Company indicating that the City is
considering the offer, but that they would have to be agreeable to obtain all permits, as
• required. Sean and Scott will discuss with Craig Anderson if there is any interest in
keeping the excess topsoil at the park and where.
SEWER UNFINISHED
Town of Norway Contract — The City responded to the Public Service Commission's
request for additional information and the PSC has now requested additional
information from the Town of Norway regarding charges and limits of flows.
Status of proposed amendment to SEWRPC's 208 Plan — The proposed amendment
for the Blattner property has been approved, with some modifications, by the Plan
Commission and has been sent to SEWRPC for final approval. Once SEWRPC has
approved the amendment, this item will go to the Common Council for the amendment
to the 208 plan and the Council will also act, at the same time, on the Reserve Capacity
Assessment District amendment.
Further review request to have City purchase property/Jacobus (Indian Trail) —
Scott presented the committee with a copy of correspondence that he sent to Mr
Jacobus outlining the procedure that he would have to follow and, to date, nothing has
been received from Mr Jacobus.
Further review of sewer usage charts and compare REC purchases — Sean
• discussed with the committee the updated report submitted by the Sewer Utility Clerk,

• Renee Kowalik, showing the latest comparison for commercial, industrial, and multi-
family actual usage as it compares to their total RCA capacity. She pointed out over
forty (40) properties show additional RCA's needed to support actual usage if billed by
gallon. Scott advised that Attorney Molter is not sure whether any change can be made,
as these charges were part of an assessment hearing that was determined by following
the adopted REC chart. Scott and Sean will schedule a meeting with City Attorney Don
Molter and Ken Ward, Ruekert & Mielke. It was clarified that purchases were based on
peak capacity for each building, and that if the building use changed and they used less
water, there is no reimbursement because the REC purchase was part of the initial
system infrastructure cost.
Further review of sewer usage deduct meters — Scott reviewed with the committee
the changes that are being proposed to Chapter 21 of the Sewer Ordinance in order to
accommodate requests of commercial, industrial and multi -family units to meter the
water that does not go down the sewer They would like this amount subtracted from
their usage and our current policy does not allow this, so Scott has put together the
amendments required, as follows:
Listed below are proposed changes to Chapter 21 regarding metering and deduct
meters:

Metered users, as described in 21.05 (10(a) may install, at their expense, a deduct
• meter to measure water not entering the sanitary sewer system. The total from this
meter shall be subtracted from the main water meter for sewer usage billing purposes.

21.13 (2) - Initial costs for metering equipment and installation shall be paid by user if
user is not on municipal water or if a deduct meter is installed. Municipal Water Utility
customers will utilize the reading from the meter provided by the Water Utility. The user
charge shall be based on the quantity of water so measured. Whenever the person fails
to install such metering equipment, or where it is not practicable to measure the water
consumed on any premises by a meter or meters, the Utilities Superintendent shall
determine the estimated volume of water discharged into the Sewerage System.

replacement, when necessary, of meters. This charge will apply to all users not on
municipal water or those that have deduct meters.

SEWER NEW BUSINESS
Review Deferred Sewer Assessment (Richard Patterson/North Cape Road — Tax
Key #2256.993) — Sean -stated that he talked to Mr Patterson and he and his attorney
regarding working with builders to see if a residence could be built on the property. Mr
Patterson mentioned that he did not want to secure any DNR permits. The City has
determined that the property is buildable and that the lateral assessment is due. Ald.
Petfalski moved to defer until more information is received from Mr Patterson.

WATER UNFINISHED
Status on potential impacts to Well #7/Status of Stoneridge Ground Water
Remediation — Steve Schultz advised the committee that he has heard nothing from
the EPA.
Status on proposed power plants — Muskego/New Berlin — Steve Schultz advised
that he understood that there was a letter sent to the power plant from the State
requesting clarification on 48 items on their submittal. There has been nothing new
heard regarding the New Berlin power plant.
WATER NEW BUSINESS
Discuss water service — Rosewood Estates, Addn. #1 — Sean presented to the
committee the preliminary layout for the Rosewood Estates, Addn. #1 subdivision. This
is for nine lots and will be located just west of Durham Drive, just north of Candlewood
Creek Subdivision. For the original Rosewood Estates Subdivision, the City agree with
the developer that water was not readily available and would be years before they
would receive through Candlewood Estates. With this new nine lot addition, it would
make sense that they would be connected to the municipal water system, but there is
• quite a difference in the timeline for the Redman (Boehm) duplex development of about

six or seven years, and Rosewood developers are looking at approximately 8 months
• for all of their approvals, so that doesn't seem to be quite fair to the Rosewood
developers. The committee determined that possibly a financial agreement could be
worked out between the Redmond (Boehm) developer and the Rosewood developer to
escrow monies for the water extensions. After considerable discussion, Aid. Petfalski
moved to defer in order for Sean to schedule a meeting with the two developers.
Seconded by Aid. Madden, motion carried 3-0.
