Minutes of Meeting Held Monday, January 21, 2002
Chairman Dave Sanders called the meeting to order at 7:00 p.m. Also present
were committee members Ald. Mark Slocomb and Ald. Rick Petfalski, Mayor
David DeAngelis (arrived at 7:30 pm), Engineering/Building Inspection Director
Sean McMullen, Utilities Superintendent Scott Kloskowski, Ruekert & Mielke
representatives Rich Eberhardt, and those per the attached list.
It was noted that the meeting was posted in accordance with the Open Meeting
Law.
APPROVAL OF MINUTES OF PREVIOUS MEETING
Ald. Petfalski moved to approve minutes of meeting held October 15, 2001
Seconded by Ald. Slocomb, motion carried 3-0.
STATUS OF PROJECTS
North Shore Lift Station — North Shore Drive residents, Mr & Mrs. John
Brunner (S106 W20182 North Shore Drive) and Mr Jack Habrat (S106 W20213
North Shore Drive) appeared before the committee to discuss their concerns with
the new generator and submitted a letter from The Citizens of Muskego, North
Shore Drive, attached, which outlined their concerns with the alarms going off at
the lift station and no one from the City responding to these alarms. They are
concerned that basements will again be flooded and damage done to their
homes, as well as having this affect the value of their properties. Utility
Superintendent Kloskowski discussed their concerns and answered their
questions. He indicated that the generator's fail alarm would be connected to the
SCADA computer system, if possible. Residents requested that connection to
the new WEPCO service still be considered, as this will eliminate the grounded
B-Phase 480v Service that seems to be the problem. Ald. Slocomb indicated
that a service change could still be considered. Ald. Slocomb asked Utility
Superintendent to evaluate all alarms at the North Shore Lift Station. Residents
requested a copy of the minutes for this meeting and also an agenda for the
February meeting.
North Cape, Ryan to Boxhorn Sewer and SEPI Sewer— Engineering/Building
Inspection Director Sean McMullen presented a memo to the committee outlining
the negotiations with Advanced Sewer & Water over liquidated damages
assessed on both of these projects. Agreed upon damages is as follows:

is Sean McMullen advised that acceptance of these damage delays will be
executed by written change order which Ruekert & Mielke should have ready for
execution by the Mayor late next week
SEWER UNFINISHED
Status of Town of Norway Contract — Waiting for Public Service Commission's
decision.
Status of Sewer Connection — Mr Jack Henry appeared before the committee,
at the request of the committee, to discuss the deferred sewer connection to the
O'Malley property Loomis Drive (Tax Key 2257.997). Mr Henry indicated that
their interest is to raze the building on the property in Spring of 2002. He
indicated that they would be contacting the Tess Corners Volunteer Fire
Department to make arrangements for the razing. Utility Superintendent
Kloskowski reminded Mr Henry that permits are required to be taken out. Aid.
Petfalski moved to again extend the time for connection and/or demolition to
June 17, 2002. Seconded by Aid. Slocomb, motion carried 3-0.
Sean reported that a razing permit has been obtained for the Martin House on
Loomis Drive (Tax Key 2257.978.005) and Tess Corners Volunteer Fire
. Department will be razing in the near future.

SEWER NEW BUSINESS
Review 4th Quarter MMSD & Town of Norway Bill — The Committee reviewed
the invoice for the fourth quarter gallons charge from Norway Sanitary District
No.1 in the amount of $34,658.41, and invoice for the fourth quarter for total user
charge in the amount of $131,321.25. Aid. Sanders moved to approve payment
of invoices. Seconded by Aid. Slocomb, motion carried 3-0.
Review 2002 MMSD Capital Charges - The Committee reviewed
correspondence from MMSD indicating the 2002 Capital Charges in the amount
of $1,325,308. Mayor DeAngelis explained how capital charges are calculated.
Discuss SEPI/meter installation - Utility Superintendent Kloskowski reported
that the entire SEPI (Superior Emerald Park) site is metered through the meter in
the lift station and a meter on the SEPI water supply is not needed. It was
clarified that SEPI will be charged for two connections plus usage and that Utility
personnel will read the meter quarterly and report gallon usage to the Sewer
• Utility Clerk for billing purposes. Ald. Petfalski moved to waive the requirement of
a water meter on the SEPI water supply until another user is connected to the lift
station. Seconded by Aid. Slocomb, motion carried 3-0.

Review sewer plans for Nature Estates - Mr Reno Berg and Mr Wayne
Salentine appeared before the committee to present sewer and water plans for
Nature Estates. Engineering/Building Inspection Director Sean McMullen
reported that the submitted plans met required standards. Aid. Slocomb moved
to approve sewer and water plans. Seconded by Aid. Petfalski, motion carried 3-
0.
Review sewer charges — International House of Toys (Konkel) — Mr & Mrs.
Konkel, owners of the property addressed S73 W16582 Janesville Road (Tax
Key 2198.993) appeared before the committee to dispute his 4th quarter sewer
usage bill for 2001 They have two business buildings on one individual property.
There are two sewer connections and one water source and meter They are
asking relief from the current 1 REC minimum charge for each building; for a total
of 2 RECs for the property. They stated they were previously charged 1.5 RECs
for the two buildings. Aid. Sanders moved to revise sewer ordinance to require
1.5 REC minimum where an undividable property contains two buildings
connected to sewer with one business operating on the property. Seconded by
Aid. Slocomb, motion carried 3-0. The committee directed Mr. Konkel to pay
current sewer usage bill and the Sewer Utility will reimburse difference if and
when amendment to ordinance passes the Common Council. Utility
Superintendent Kloskowski and Engineering/Building Inspection Director
McMullen will draft revisions for the February meeting. A copy of the
"unapproved" minutes will be sent to Mr & Mrs. Konkel, at their request.
Review design of McShane Storage Facility/availability of funds - Richard
Eberhardt, Ruekert & Mielke, presented engineering plans for the McShane
storage facility along with conservative and aggressive timelines. Mayor De
Angelis reported that after a meeting with Finance Director Dawn Gunderson and
Financial Consultants, it is recommended that the Utility should utilize $2,000,000
from Reserves and borrow the balance of the project's $4,100,000 estimated
cost. Aid. Sanders questioned how this would affect the sewer usage rate and
Mayor reported that this should not affect the current rates for the next several
years. Aid. Petfalski moved to direct Ruekert & Mielke to prepare bidding
documents using the aggressive schedule, if possible. Seconded by Aid.
Slocomb. motion carried 3-0.
plan — Engineering/Building Inspection Director Sean McMullen explained that
this amendment would make the 208 service area and the RCA District have the
same boundaries. In the 1997 MMSD agreement, the 208 boundaries changed
slightly per MMSD's request. This proposed amendment will also include the
properties that have recently requested swaps or inclusion in the SEWPRC 208
plan (L.E.K., Benke, Blattner).
Review proposed Martin Drive Sewer Extension — Engineering/Building
Inspection Director presented sewer plans for the Martin Drive realignment. Aid.
Petfalski moved to approve plans and to authorize Sean to proceed with the
bidding process. Seconded by Aid. Sanders, motion carried 3-0.

• Review Development Standards for Sewer & Water — Engineering/Building
Inspection Director Sean McMullen provided the committee with proposed new
development standards for sewer and water Committee will review and act at
the February meeting.

WATER NEW BUSINESS
Review water plans — Nature Estates — acted upon both sewer and water plans
under #4 -Sewer New Business.
areas identified in water study — The Committee reviewed a memorandum
from Plan Director Brian Turk wherein he referred to Ruekert & Mielke's Report
• on Water Supply Facilities, 2001 Update. Brian indicates that Planning Staff has
concerns that certain land uses, such as gas stations, could develop which would
preclude proper wellhead planning. Planning Staff is recommending a twelve-
month moratorium on the review and approval of Building Site and Operation
Plans for such uses with applications being accepted, placed on file, and
reviewed in the order received, following the removal of the moratorium. Aid.
Petfalski moved to recommend approval of moratorium to Council. Seconded by
Aid. Slocomb, motion carried 3-0.
Review Dedication of Water Main in Woods Road — Towne Realty, Inc. — The
committee reviewed correspondence dated January 14, 2002, from James W
Doering, Assistant Manager Wisconsin Development, Towne Realty, Inc.,
notifying the City that Towne Realty, Inc. is dedicating "free and clear', the water
main extension that was contractually installed between Quietwood Drive and
Kathryn Drive, along Woods Road, to the City of Muskego's Water Utility. Aid.
Sanders moved to recommend acceptance of improvements. Seconded by Aid.
Slocomb, motion carried 3-0.
The committee requests that the "Review of Five Year Capital Plan" be removed
from future agendas.
Communications and any other business as authorized by law — Mr Allan
. Jacobus, W143 S7615 Indian Trail, appeared before the committee and reported
he is having trouble selling his property due to the number of sewer backups he
had in the past. Mr Jacobus indicated that lenders would not approve loans
because of the backups. He is requesting that the Utility purchase his property.

• Aid. Slocomb explained that this item was inadvertently left off of the agenda
and, as a result, could not be acted upon at tonight's meeting. Aid. Slocomb and
Mayor De Angelis apologized for the omission and offered a special Utility
Committee meeting within two weeks. Mr Jacobus stated that the February 18in
meeting would be fine.

Aid. Petfalski moved for adjournment at 9:45 PM. Seconded by Aid. Slocomb,
motion carried 3-0.

This letter is to express our concerns about the condition of the pumping station directly
across from S 106 W20213 North Shore Dr.
In May of 2001 some of the homes located around the pumping station had raw sewage
flood their basements. This created a health hazard and did extensive damage to the
homes and contents of the basements.
We have been contacting the City of Muskego many times since this occurrence. We
have talked to many people at City Hall regarding our concerns. We have called the
Police Department several times, when we could not reach anyone at the city hall, after
alarms have gone off and no one from the City responded to the alarm After each
occasion the City of Muskego promised that the situation would be taken care of. As of
today's date the pumping station still is not working properly.
We are very concerned that basements will again be flooded and damage done to our
homes. Some people are afraid to go on vacations because of the fear of basements being
flooded. We are also concerned that this is affecting the value of our properties. This
condition is unacceptable.
We as residents of Muskego feel we have the right to expect the City of Muskego to
repair, immediately, the pumping station so we do not have to be concerned that raw
sewage will back up into our homes.
