Minutes of Meeting Held Monday, April 23, 2001
Chairman David Sanders called the meeting to order at 7:05 PM. Present were committee members Ald. Mark
Slocomb and Ald. William Le Doux. Also present were Utilities Superintendent Scott Kloskowski, Mayor De
Angelis, and Ruckert - Mielke representative Richard Eberhardt.
It was noted by Chairman David Sanders that the meeting was posted in accordance with the Open Meeting Law.
Approval of Minutes of Previous Meeting
Ald. Slocomb moved to approve the minutes of the March 19, 2001 meeting. Seconded by Ald. Le Doux, motion
carried.
Status of Projects
Richard Eberhardt reviewed the status of projects (as per attached) noting the following updates. Contract was to
have been delivered for the North Cape Ryan 500" N Boxhom Sewer Project. The contractor intends to start work
May 7, 2001. The project manager for the North Shore Lift Station reported there are still items on the punch list that
have not yet been completed. Scott will be checking with the EngineeringBuilding Inspection Director to see if the
chimney seal reinstallation had been completed on the Hi View Sewer Project.
Status of Town of Norway Contract
The committee reviewed the new ordinance that had been passed No. 28 by the Town of Norway, noting the increase
of $ 1.2921 in rates from 2000 to 2001. Mayor reported the City has not yet heard from the DNR. The committee
directed the Sewer Utility Clerk to report back the amount the Town of Norway is charging their residents.
Status of Sewer Metering
Scott reported some transmitters and meters still needed to be installed. A meeting will be held this week to work out
some of the details in the billings and readings. Scott reported the new radio read system read the entire City in less
than eight hours.
Status of MMSD Proposed Storm Water Rules
Mayor reported there was a meeting this last week, and discussed some of the changes in the proposed Storm Water
Rules. Plans need to be sent to MMSD for the Tess Comers area for prior approval as part of our process. This
should go into practice the middle of 2002.
Further discussion on claim received from Zaharopoulos — Boxhorn-Grovewav-Rvan Sewer Proiect
Mr. Zaharopoulos and his Attorney attended the meeting. Ald. Slocomb gave some background information on the
sewer project and how the claim had been settled with the sewer contractor. Our engineering firm during the City
litigations had reviewed the items that had been presented and determined the amount of $5,350.00 for the
Zaharopoulos damages. Any amount above and beyond this would have to have justification to settle the claim. The
Lake Project Coordinator is reviewing the videotape that had been taken prior to construction, to determine the type
of trees that had been on the property. The committee asked Mr. Zaharopoulos if he had any photos that might also
be used to provide any information. Ald. Slocomb made a motion to defer item to next month's meeting. Ald. Le
Doux seconded, motion carried.
Status of alternatives for in -line storage at McShane Lift Station
Mayor reported that he had requested MMSD to reimburse the City for installing the in -line storage unit. Ruekert —
Mielke will be working with Scott on the elevations of basements of homes that had been previously been flooded to
help in the placement of the alarm system to prevent future flooding.
Review Deadline of Sewer Connections
The committee reviewed the following properties that had not yet connected:
2257.976 W 125 S9808 North Cape Rd. mailed in a copy of their contract, paid $500.00 R#258799 7/14/00, and had
called stating they hope to be connected shortly. Ald. Slocomb made a motion to extend the deadline an additional 30
days prior to starting procedures for forced hookup on W125 S9808 North Cape Rd. (#2257.976). Ald. Sanders
seconded, motion carried.

2257.997 W125 S9706-8 North Cape Rd. Mr. Henry representing the O'Malley property was here to update the
•committee on the status of the property. He did report the owner had planned on not renewing the Liquor License
and would be closing the business as of June 1, 2001, and reported the building would be vacant. Mr. Henry asked
for a 6-month extension. Ald. Slocomb advised he did not want to see the building sitting vacant for 6 months. Mr.
Henry is trying to work out an easement with the Laimon property owners. The committee suggested Mr. Henry
contact the Fire Department, to possibly have them assist in taking the building down. Ald. Sanders made a motion to
extend the deadline for forced hookup for six months for W125 S9706-08 North Cape (#2257.997), and have the
property owners report back to the committee by the July 16, 2001 meeting with a plan for this property. Ald. Le
Doux seconded, motion carried.
2257.978.005 W125 S9782 North Cape Rd. This building is also in the plans to come down although no permit has
been pulled. Ald. Sanders made a motion to extend the deadline for connection to next month's meeting for W125
S9782 North Cape (#2257.978.005), and request the property owners update the committee of the status by the May
21, 2001 meeting or the committee will start forced hookup procedures. Ald. Slocomb seconded, motion carried.
2231.995 S86 W21693 Janesville Rd. Loyal Order Moose Lodge. Larry and Judy Wachowiak spoke on behalf of the
owners of the building to update the committee on the status of razing the building. Mr. Wachowiak reported that no
functions were to be held inside the building. Scott had received a call to turn the water back on for the horseshoe
courts. Mr. Wachowiak had not been aware of the request and would inform Scott if indeed the water should be
turned back on. Mrs. Wachowiak indicated that the concern now is the funding of this project and they are waiting to
secure financing. Ald. Sanders made a motion to extend the deadline for connection an additional three months for
S86 W21693 Janesville Rd. (#2231.995). Aid. Slocomb seconded, motion carried.
•Discuss possible Ready to Serve Properties -Durham Hill Nursery
Currently the property at S99 W 12707 Loomis (#2260.998.002) has no facilities, Mr. Luznicky had called 8/29/00
and indicated that the owners of this business had planned on adding facilities. Mr. Earl appeared to discuss the
status of the connection. He was unable to give the committee any plans on future connection at this time. The
Mayor indicated the business should not be operating without facilities and asked if anyone from the Building Dept.
had contacted him. Mr. Earl claimed someone was to come and meet with him twice but had not kept the
appointments. Mayor will make sure someone in Building and Planning will contact him to inform him of his
options. Aid. Sanders made a motion to start charging the property owners at S99 W12707 Loomis (#2260.998.002)
a ready to serve charge, beginning with the second quarter of 2001. Ald. Le Doux seconded, motion carried.
Review request for deferred payment — Olson (Ryan Rd.) #2255.984
A letter dated 4/10/01 had been received from Therese Olson requesting to make $1,000.00 payments on their
deferred sewer assessment. Ald. Sanders made a motion to accept partial payments of no less that $1, 000.00
for the deferred sewer assessment for (#2255.984) S94 W13876 Ryan Rd. Ald. Slocomb seconded, motion
carried.
Personal Appearance from Pioneer Center Condominiums -Discuss meter requirements
Carol Fisher and Sue Barry were present to discuss the meter that is on the well for the Condo complex. The
meter is located on the wellhead and the sewer usage bill reflects all the water that is generated from the well.
Their concern is the pool is required to be backwashed and the water that is used for this is dumped into the
ditch and not in the sewer. They are requesting some form of discount for this usage. Ald. Slocomb made a
motion to credit the property owners once a year on the second quarter bill for the amount of 30, 000 gallons.
The formula used for this calculation is I Y2 times the volume of the pool for backwashing and refilling. Ald. Le
Doux seconded, motion carried.

. Still waiting to hear from the DNR and PSC time frame.
Status of Repaintine of the Water Tower
The committee reviewed a letter from Attorney Molter's office, which indicated a check would be sent to the City of
Muskego, in the amount of $42,191.00 (Fidelity has agreed to forfeit its performance bond). Ald. Sanders made a
motion to direct the Engineers to prepare plans and specs for completing this project. Ald. Le Doux seconded,
motion carried
WATER NEW BUSINESS
Review informational meeting minutes and survey results/proposed Janesville Water Proiect
Jean Russ was present to find out the survey results for the proposed water project on Janesville Rd. Scott
indicated the survey had been sent to list provided from the Public Hearing notice. Not all the property owners
would actually be affected by the project. The current response was 21 voting no, 13 voting yes, I undecided,
and 5 or 6 with no response. Scott will supply the committee a color -coded map for next month's meeting to
help indicate the results of the survey.
Mr. Rich Eberhardt was dismissed at 9:15 p.m.
REVIEW OF DEFERRED ASSESSMENTS/SEWER & WATER
Nothing new to report.
REVIEW OF FIVE-YEAR CAPITAL PLAN

ACCEPTANCE OF IMPROVEMENTS — Salentine/Loughnev
The committee reviewed the memo from Mr. McMullen recommending the approval for the sewer extension for the
Salentine/Loughney property on Kelsey Dr. Ald. Sanders made a motion to approve the acceptance of improvements
for the Salentine/Loughney Sewer Extension for lots 1 thru 14. Ald. Slocomb seconded, motion carried.
REPORT OF UTILITIES SUPERINTENDENT/REPORT OF CITY ENGINEER
Scott reported a sewer backup that was caused by gravel in the lines on Gold Dr. property. The claim will be
submitted to our insurance carrier.
Scott reported the manhole rehab project is coming in under estimate due to the fact a lot of the work was done
internally. Sean and Scott will have information for the committee next month on purchasing camera equipment to
video and locate leaks in the laterals.
Scott will be meeting with representatives of the Freedom Square Condos to discuss possibly the City taking over
their water system.
