Minutes of Meeting Held Monday, October 16, 2000
The meeting was called to order at 7.10 p.m. by Chairman David Sanders. Present
were committee members Ald. Mark Slocomb, Ald. William Le Doux, Utilities Supt.
Scott Kloskowski, Engineering/Building Inspection Director Sean McMullen, Mayor
DeAngelis, and Ruekert - Mielke representative Rich Eberhardt.
It was noted by Chairman David Sanders that the meeting was posted in accordance
with the Open Meeting Law.
Notice of Closed Session:
Chairman David Sanders read the Notice of Closed Session.
Approval of Minutes of Previous Meeting
The committee reviewed minutes of the meeting held on September 18, 2000 and
September 26, 2000. Ald. Slocomb made a motion to approve the minutes as
submitted and place on file. Ald. Le Doux seconded, motion carried.
Status of Projects
Mr Rich Eberhardt reviewed the status of projects (as per attached) noting the following
updates: Scott reported the property owners around the North Shore Lift Station have
decided on a color of the building that will be designed to house the generator The
McShane Bypass can be removed from the status list. The committee directed the
Utility Superintendent to speak with the property owners of the lift station site for the
North Cape Ryan Rd. to 500 Ft N. of Boxhorn Sewer Project. The attorney working for
the property owners was out of town for the month of September, which delayed this
project. The City needs to continue due to the reconstruction of the County Road. Ald.
Slocomb made a motion to direct the engineers to proceed with the design of the Lift
Station and gravity sewers. Ald. Sanders seconded, motion carried. Rich questioned
the committee if he should close out Woods Rd. Kurtze Ln to Bay Ln. Project, and the
committee felt it could be closed out. The committee discussed the pavement on the
Woods Rd. Sandy Beach Force Main project. Ald. Slocomb made a motion to direct
Sean to send a letter to the contractor to repave the road by November 1, 2000. Aid.
Sanders seconded, motion carried. The committee decided the Knudsen Force Main
could be removed from the status of project list. Sean reported the sanitary sewer
approvals for Lakewood Condominiums came in October 16, 2000. The committee
directed the engineers to send a letter with a 30 - day notice for the Victorian Villas to
complete the video of the sewers, or the City will complete the video and charge the
cost against the developer's deposit.
Status of Town of Norway Contract
Mayor addressed the letter received from the DNR. Ald. Sanders made a motion to
have the Mayor direct the City Attorney to file an appeal in reply to the letter received
from the DNR. Ald. Slocomb seconded, motion carried.

• Utility Superintendent indicated the Utility received the first shipment of meters. A
notification had been sent to inform the property owners that the meters are available
and the plumbers can pick them up after payment has been received.
Discuss Date of November Meeting
Due to some conflicting schedules, the committee discussed an alternative date for the
November meeting. Ald. Sanders made a motion to schedule next month's meeting
Thursday, November 16, 2000 at 7:00 p.m. Ald. Le Doux seconded, motion carried.

The committee discussed the letter from the Muskego Moose Lodge Building
Committee. The Moose Lodge Committee indicated that they will no longer be using
the building and plan to demolish the building. Ald. Le Doux made a motion to extend
the sewer connection deadline an additional 6 months, to April 1, 2001, for the Loyal
Moose Lodge (#2231.995) connection. Ald. Slocomb seconded, motion carried. Utility
Superintendent reported he had met with the two property owners from the North Cape
Ryan Sewer Project, the O'Malleys and Laimons. The two property owners are in the
process of working out an agreement for an easement to service the Laimon property.
The O'Malley property owners have plans to demolish the existing building on the
property in the spring. Ald. Sanders made a motion to extend the sewer connection
deadline an additional 6 months, to April 1, 2001, for the O'Malley (#2257.997) property.
Ald. Slocomb seconded, motion carried.
• Review Zaharopoulos Letter Boxhorn Groveway Ryan Sewer Project
Mr Kloskowski reported he had received a letter from Mr Zaharopoulos, a property
owner on the Boxhorn / Ryan / Groveway Sewer Project, requesting reimbursement for
damage done to his property. Mr Zaharopoulos had been invited to attend the meeting
to discuss damage done by the contractor to his property. Mr Zaharopoulos was
present and indicated that although the City did give him 10 trees, some Blue Spruce
and other evergreen trees, they where not the same size or type trees (Apple, a large
Walnut, etc.). The contractor was only to remove trees in the easement. Discussion
took place on where the trees where located on the property. Scott will investigate
further for documentation of the types of trees and their location. Mayor requested Mr
Zaharopoulos bring in copies of his cancelled checks for work that had been done to
correct the damage done by the contractor Mr Zaharopoulos will be invited back when
the documentation is supplied.
Review Request for COMM 83 Moratorium Exception — Kindler ProDerty

A memo was reviewed from the Plan Director, Mr Brian Turk, who recommends
approval to install an A+4 mound system on the existing lot for the purpose of building a
single family residence for the Kindler Property (#2282.996). Aid. Slocomb made a
motion to approve the A+4 system for the Kindler Property (#2282.996) for the purpose
of building a single family residence. Ald. Sanders Seconded, motion carried.
• Mayor discussed the policy of Waukesha County issuing permits for COMM 83. The
County is not checking with the communities on the availability of sewers. The

• committee directed the Mayor and Scott to draft language to repeal the City Ordinance
on COMM 83 and draft language in our Sewer Ordinance to require sewer availability
checks prior to use of COMM 83 Systems to protect the City under the new County
Ordinance.
Review Sewer Usage Charges — Staniszewski
Mrs. Staniszewski appeared to discuss the sewer usage charges for their property
(#2180.011). They object to being charged for sewer usage from the time of
connection. Scott explained the potential for use once the lateral was connected and
that is the reason why the policy has been upon connection and not upon occupancy.
Ald. Sanders made a motion to deny reducing the sewer usage charges for the
Staniszewski property (#2180.011). Aid. Slocomb seconded, motion carried.

The data available indicated that Well 7 is potentially at risk of being contaminated by
chemical constituents from the landfill area. A clay sequence present above the sand
and gravel aquifer supplying Well 7 will provide some degree of protection from
contamination. Although the extent of continuity of the clay layer is known, and may
provide a pathway for migration into Well 7, Ruekert — Mielke recommend further
investigative measures be completed off site to adequately characterize the subsurface
hydrogeological and hydrogeochemical flow regime. Ald. Sanders made a motion to
direct the engineers to send a letter to the EPA and to the WDNR to compel the
• responsible party to more aggressively define the extent of off site contamination and
prevent further migration towards Well 7 Ald. Slocomb seconded, motion carried.
Mayor also asked the cost of money spent on this to be tracked separately.
Discuss Possible Watermain Extension — Cth L (Moorland Rd. to Tess Corners)
The committee discussed the plans of the County reconstruction of the road; the Utility
should possibly consider the need to run a water main extension. The committee
discussed the WCA District would need to be expanded. The committee felt the
property owners from Moorland Rd. east to the City limits, be invited into the February
2001 meeting to discuss the possible extension.
Review Impact of Proposed Electrical Power Plant (New Berlin) Northwest Side
Abutting Muskego
Ald. Chiaverotti was present to talk about the possibility of the construction of the
proposed electrical power plants. The committee discussed the concerns such as the
impact on our current water supply, noise levels and expansion of the turbines. The
committee had many questions and felt the need for the Mayor and Sean to have a site
visit at the plant and report back to the committee.
Review Deferred Sewer and Water Assessments
The committee reviewed the updated report. Ald. Slocomb will be meeting with the
Finance Director to discuss the interest and report back to the committee.
• Review Preliminary Sewer & Water Budgets
The committee reviewed the preliminary Sewer and Water Budgets. Utility
Superintendent advised the committee they could meet with him on any individual

• questions they might have. The committee requests the Finance Director be invited to
the next meeting to review the sewer and water budgets as well as recommend a rate
for the sewer usage.
Discussion of the Repainting of the Water Tower
The committee discussed the letter from the engineers to the attorney's office which
provided documentation of the weather data for the period of August 8, 2000 to October
5, 2000. It was noted that there were about 27 days that the weather was acceptable
for painting that did not fall on a Saturday, Sunday or Holiday. Ald. Slocomb made a
motion to send a 15 - day notice to the Bonding Company, and if they don't respond,
the City would then file for liquidated damages. Ald. Le Doux seconded, motion carried.
Acceptance of Improvements
None at this time.
Utility Superintendent's Report —
Scott reported the Odor Scrubber at McShane has been working well and will be shut
down next week.
Engineering/Building Inspection Director's Report
Nothing new to report.
• Closed Session
No need to go into closed session.
Mayor gave a copy of the proposed MMSD Rules on Storm Water to the Committee for
them to review. After some discussion, the committee directed the Mayor to send a
letter requesting MMSD not to adopt the rules, and to meet with the Technical Advisory
Team to have some additional questions answered.
ADJOURNMENT - Being no further business to discuss, Ald. Slocomb moved to
adjourn at 9:48 p.m. Aid. Sanders seconded, motion carried.
