PUM20000821PUBLIC UTILITIES COMMITTEE MEETING - CITY OF MUSKEGO Approved Minutes of Meeting Held Monday, August 21, 2000 The meeting was called to order at 7:00 p.m. by Chairman Sanders. Also present were Committee Members Le Doux and Slocomb, Mayor De Angelis, Utilities Superintendent Kloskowski, Engineering and Building Inspection Director McMullen, and Rich Eberhardt of Ruckert & Mielke. Chairman Sanders noted the meeting was noticed in accordance with the open meeting law on August 17, 2000. Ald. Le Doux moved to approve the July 17, 2000 minutes. Ald. Slocomb seconded; motion carried unanimously. Chairman Sanders read the notice of closed session. Rausch Sewer Extension Mr. Berg and Mr. Salentine were present. Mr. McMullen stated the plan shows the force main will cross four private properties. Those property owners are interested in connecting to sewer. Before construction occurs, easements need to be recorded. Mr. Salentine submitted copies of the easements. Ald. Sanders moved to approve the sewer extension plans contingent upon the easements being reviewed by Mr. McMullen. Ald. Slocomb seconded. Mr. Salentine stated that he will submit proof of the easement documents being recorded. Motion carried unanimously. Status of Projects Mr. Eberhardt reported on the status of projects as attached. He stated that pavement on Woods Road will take place in a few weeks following water main construction for Quietwood Creek. Development of Candlewood will also affect Woods Road; however, the road will not be closed to traffic. Mr. Kloskowski discussed the North Shore Drive Lift Station and correspondence from Ruckert & Mielke indicating the contractor has requested a change in the contract time and price. Attorney Molter needs to review and provide an opinion to the City. The McShane project should be closed out with the final payment approved at the August 22 Council meeting. Mr. Kloskowski stated he submitted written correspondence to the Langs to determine their willingness to sell property to the City for the North Cape/Ryan Road Sewer Project. He has not received a response to date. The I/I Repairs Program is just about complete. This item can be removed from future agendas. Odor control at the McShane Pump Station is not quite fine tuned; adjustments are still taking place. Regarding the SEPI Lift Station, it was noted that the City has met with representatives from SEPI. The project will go around the Waste Management property. Mr. McMullen stated that the Jewel Osco development is moving forward; a formal submittal to the City will be forthcoming. Mr. Eberhardt stated bids will be solicited within the next few weeks for the final portion of the Hillendale Drive Water Project. Review Quarterly Bills for MMSD and Town of Norway Ald. Slocomb moved to approve the MMSD invoice and Town of Norway invoice for the second quarter as well as an amended invoice for the first quarter. Ald. Le Doux seconded; motion carried unanimously. Public Utilities Committee Page 2 8/21/00 Meeting Review Deposit and Forfeiture Schedule for Chapter 21 • Mr. Kloskowski explained the rationale for the amounts. Ald. Slocomb approval the following: moved to recommend of Section 21.5 (3-10) Sewer Utility Violations $50 Section 21.09 (1-5) Prohibited Discharges $200 Section 21.11 (1) Pretreatment Facilities $100 Section 21.12 Sand and Grease Trap Installation $100 Section 21.13 (3, 4, 5, 8) Wastewater Measurement & Sampling $50 Section 21.16 Admission to Property $50 Ald. Le Doux seconded; motion carried. It was noted the proposed amendment to the deposit and forfeiture schedule would be submitted to the municipal judge prior to Common Council approval. Review Krause RCA Assessment (Loomis Drive) This item was deferred from the July meeting as the Committee requested additional information regarding this property. Sewer Utility Clerk Kowalik submitted information indicating the property is charged as a duplex for refuse and recycling. The Committee determined that the additional information confirmed that the property should be billed as a duplex for RCA purposes. Consider Changing Future Meeting Dates • Mr. Kloskowski recommended that the meeting date remain the same; the time frame works well. The Committee determined that it would not change meeting dates with the Public Services Committee. Review COMM 83 Exception, Stephen Sobieski Plan Director Turk submitted a memo to the Committee recommending approval. Mayor De Angelis stated no land division was proposed. Ald. Slocomb moved to approve a COMM 83 Exception for the Sobieski property. Ald. Sanders seconded; motion carried unanimously. Annual Review of Stand-by Charges The Committee reviewed the memo submitted by Sewer Utility Clerk Kowalik regarding the charges. Ald. Slocomb moved to accept the current status and place the information on file with the exception of Tax Key #2284.977 which has been sold. Mr. McMullen confirmed that the owners have discussed the property with him and a razing permit has been applied for. Ald. Sanders seconded; motion carried unanimously. It was noted that the property is not in the RCA district. Review Connections - Loomis/Hwy. 45 Mr. Kloskowski gave the Committee an update on the properties that still have not connected to sewer. Wayne Stever is in the process of completing the work for five of the properties. It appears the Durham Hill Nursery property has not entered into a contract to connect to sewer as . no permit has been issued. The Committee determined that a signed contract and permit must be obtained prior to the Committee's September meeting. The Sewer Utility Clerk is to notify the property owner. Public Utilities Committee Page 3 8/21/00 Meeting Review Proposed Amendment to Final Assessment Roll - North Cape Ryan Sewer Project Ald. Le Doux moved to amend the Assessment Roll and issue a refund in the amount of $2,100 to Mr. O'Malley. The amount represents a sewer lateral that was not received. It was noted that no interest was incurred. Ald. Sanders seconded; motion carried unanimously. Lakewood Condos - Watermain Oversizing (Racine) Mr. McMullen explained that he and Plan Director Turk are requesting approval of the Committee to proceed to negotiate with the developer for the payment of costs associated with the watermain oversizing. This is similar to what was done with the Quietwood Development. Ald. Slocomb moved for approval. Ald. Sanders seconded; motion carried unanimously. Dreamland Development/Watermain This was discussed under status of projects. There were no improvements to accept and the Utility Superintendent did not have anything further to report. Under Report of City Engineer, Mr. McMullen stated that he met with Jeff Chase and Mayor Gatzke of New Berlin regarding the connection of two properties to sewer. No amendment to the 208 plan would be done. The parcels would be included when the plan was reviewed in 2010. Ald. Slocomb requested information prior to next month's meeting regarding the McShane • upgrade. Mr. Eberhardt acknowledged that he would provide. Closed Session Ald. Sanders moved to convene into closed session pursuant to §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons required a closed session, more specifically contract negotiations with the Town of Norway. Ald. Slocomb seconded. Motion carried with a roll call vote of 3-0.
