PUM20000717PUBLIC UTILITIES COMMITTEE MEETING - CITY OF MUSKEGO Appproved 46 Minutes of Meeting Held Monday, July 17, 2000 The meeting was called to order at 7:00 p.m. by Aid. Mark Slocomb. Present were committee members Ald. William Le Doux, Utilities Supt. Scott Kloskowski, Engineering/Building Inspection Director Sean McMullen, Mayor DeAngelis, and Ruekert - Mielke representative Ken Ward. Chairman David Sanders was excused. It was noted by Ald. Slocomb that the meeting was posted in accordance with the Open Meeting Law. Review of Minutes of Previous Meeting The minutes of the meeting held on June 19, 2000 were reviewed. Ald. Le Doux made a motion to correct the minutes under the Oversizino Sewer & Water Quietwood Creek. to read as follows: "Ald. Sanders made a motion to reimburse the cost to Quietwood Creek, LLC after 11112001, per the estimated unit costs in the letter from Ruekert - Mielke dated March 8, 2000, for the oversizing needed." Ald. Slocomb seconded, motion carried. After the minutes are corrected they will be placed on file. The minutes of the meeting held on June 26, 2000 were reviewed. Aid. Slocomb made a motion to approve the minutes as submitted and placed on file. Ald Le Doux seconded, motion carried. Status of Projects Mr Ken Ward reported on status of projects as attached. The committee directed Scott to speak with the property owners regarding the offer to purchase for the lift station location for the North Cape Ryan 500' North of Boxhorn Sewer Project. Scott reported the easement on the Dyer property to service the Dyer (#2233.996.003) and Loppnow (#2233.996.002) properties part of the Hillendale Water Project had been signed. Specs for Waste Management to bid out will be done soon. Status of Town of Norway Contract Mayor reported nothing new to report but would be following up. Review status of North Cape/Ryan Sewer Project The Sewer Utility Clerk provided the committee with a memo on the status of connections. Deadline to connect was June 24, 2000. As of this date five properties have not yet connected. The property owners had been invited to the meeting to discuss their connections. Jack Henry, representative of the O'Malley property (#2257.997), was present to request additional time to connect and to discuss the construction plans to redevelop this parcel. The current building will be demolished. The committee requested the developer to inform the committee within 60 days on the status of project. Discussion took place on the easement that had not been filed with the previous owner The committee expressed concern that the two property owners need to work out an agreement between themselves. If they are not able to come to an lk agreement they should contact Scott for assistance. Ald. Slocomb made a motion to extend the deadline for connection an additional 6 months from 6124100 for O'Malley Public Utilities Committee - July 17, 2000 Page 2 • (#2257.997) and Loomis -Martins LLC (#2257.978.005) properties. Ald. Le Doux seconded, motion carried. The committee reviewed the list and letters sent in by the other property owners on the project that had not yet connected. Mr Johnson was also present to advise the committee on the status of his connection. Permits had been taken out and the property owners were waiting for the contractor to complete their connections. Ald. Slocomb made a motion to extend the deadline for connection for an additional 6 months from 6124100 for the other three properties (#2257.976, #2257.994, and #2257.996) also. Aid. Le Doux seconded, motion carried. Review COMM_83 Exception, Matt & Dawn Kramer. Boxhorn Dr. The committee reviewed the memo from Brian Turk, Plan Director, recommending the committee to allow the construction of a new single family home on an existing parcel which is outside of the existing 208 service boundary. Aid. Slocomb made a motion to allow a new COMM 83 A+4 sanitary system for the property owned by Matthew & Dawn Kramer (#2255.996). Ald. Le Doux seconded, motion carried. Review Sewer & Water Plans for Lakewood Condominiums The committee reviewed the memo from Sean McMullen recommending approval of the plans with a few conditions that needed to be met. Sean advised the committee the main issue was the plans need to reflect spacing of 250' fire hydrants according to the Fire Code. Aid. Slocomb made a motion to approve sewer and water plans for the Lakewood Condominiums subject to the changes made, and final approval of the plans • by Sean McMullen. Ald. Le Doux seconded, motion carried. Review Deposit and Forfeiture Schedule The committee reviewed the form submitted by the Clerk and decided it needs additional consideration. The committee directed Scott to work with Ken Ward and make changes to the of deposit and forfeiture for violations that need to be addressed per Chapter 21 Ald. Slocomb made a motion to defer to next months meeting. Aid. Le Doux seconded, motion carried. Review of Public Hearing Minutes - Chapter 21 The committee reviewed the minutes of the meeting held July 11, 2000 and placed on file. Discussion took place on the way Condos should be treated. Several property owners from Pioneer Center and Freedom Square were present to express their concerns. Ken Ward stated that a search had been done on the Internet to find out ways condos and apartments should be charged. He recommends, condos should be charged as a single family home. An example would be each condo in a multi unit building being charged for lateral connection plus consumption charge. An apartment being charged a portion of the lateral, depending on the number of units divided into the lateral charge, and a consumption charge. He stated that a single family home has the possibility of expanding their bedroom count, where an apartment will remain the same. Scott recommends condos be treated the same as apartments which would . require them to be metered. He stated that in the past a lot of apartments have been converted to condos. Sean stated he could understand both arguments. Ken Ward suggested treating condos in a three or more unit building the same as apartments and Public Utilities Committee - July 17, 2000 Page 3 • anything less as single family or duplex. The definition of condos needs to be classified in Chapter 21 Ald. Slocomb agreed that condos of three or more should be metered for their consumption charge and the lateral charge should be divided by the number of units. A two family condo should be charged as a duplex, and a stand alone condo as a single family home. Carol Fischer, along with other condo owners discussed the concern over the installation of multiple meters, and were against putting meters in each building. Scott pointed out the advantage of having each building being metered and being able to deduct the hose bib meter The committee agreed to allow the property owners to decide if they want one meter on the well head or a meter on each building. The issue in Chapter 21 was to require them to be metered, not to determine how many. Scott required them to inform him of what size meter is needed so he can order the correct meter to be read by our system. Scott advised that there is a timing issue of ordering the meters as it can take 45 to 60 days to get the meters and possibly longer for the larger meters; there is a deadline of August 30, 2000. Carol Fischer expressed concern over the cost of the meters and Scott advised it depended on the size. The property owners are required to purchase the meters and hire a plumber Mike Fischer was also discussing the placement of meters, and Scott informed him he would need to identify the placement to his plumber to allow for watering of grass and things. Scott asked the committee about businesses operating out of their home. Currently they are charged 1.25 REC's. The committee determined they would be required to be metered, if zoned business. The committee discussed how mother - in - law units are currently charged and that a classification needs to be • also defined in Chapter 21 Ald. Slocomb brought up the question if someone wants to prepay their sewer bill for the full year would we accept payment? Scott questioned whether we would need to pay them interest as required by the PSC? Ken Ward will check since the Sewer Utility is not regulated by the PSC and report back to committee. The committee directed Ken Ward to incorporate the changes and forward them to Attorney Molter then E-Mail Ald. Slocomb for him to make the changes in our files. Review Krause RCA Assessment The committee reviewed the memo from the Sewer Utility Clerk looking for direction on how to charge the Krause property (#2260.998) for RCA assessment. This property is being used as rooming house with four bedrooms upstairs and one bedroom down. The Assessor's office has this listed as a duplex. Additional information on the property is needed. The committee wanted to know how the property is currently being charged for refuse/recycling? Aid. Slocomb made a motion to defer this item until next months meeting. Ald. Le Doux seconded., motion carried. Approval to Hold Public Hearing - 208 Amendment (Matty's Bar & Grille) Sean advised the committee on the procedure for amending the 208 Sewer Service Area. SEWRPC would hold the Public Hearing, do the presentation and notification. The Public Hearing would be prior to Common Council on August 22, 2000 at 7:20 P.M. With final approval scheduled for September 13, 2000, this property could be • connected, if contractor was available, by the end of September, 2000. New Berlin is in agreement with the change. MMSD is also in agreement because it does follow their rules and regulations of being within 1000 feet of the sewer system. The agreement Public Utilities Committee - July 17, 2000 Page 4 with New Berlin still needs to be amended to include the current three properties that had not been included in original agreement but are being serviced and charged by the City of Muskego. Ald. Slocomb made a motion to approve the holding of a Public Hearing to amend the 208 Service Area to include Matty's Bar & Grill. Ald. Le Doux seconded, motion carried. Review quarterly billing for MMSD and Town of Norway No quarterly bills had been received on time for the scheduled meeting. Review Public Hearing Minutes on WCA District Amendment The committee reviewed the minutes of the meeting held July 11, 2000 and placed on file. Review Deferred Sewer and Water Assessments The committee reviewed the deferred sewer and water assessment report. Scott discussed with the committee the interest charge that is accumulating on some of the older projects. Ken Ward advised as long as there is a possibility of collection within twenty years of project there should be interest charged. Mayor suggested that the Finance Director or Auditor review and advise if projects have been paid off or of the value of debt. Aid. Slocomb would like to meet with Scott and Sewer Utility Clerk after he receives the e-mail file. This item was deferred until next meeting. • Mr Ken Ward was dismissed at 9:30 p.m. Utility Superintendent's Report - Scott reported the McShane Odor Control is up and running and there is very little noise (similar to a fan running in the house). No report of flooding from the rains in July. Engineering/Building Inspection Director's Report Nothing additional to report. Mayor reported that July 25 & July 27, 2000, mediation meetings are scheduled for the Water Tower Repainting. ADJOURNMENT - Being no further business to discuss, Ald.
