Minutes of Meeting Held Monday, May 15, 2000
The meeting was called to order at 7:10 p.m. by Chairman David Sanders. Present
were committee members Aid. Mark Slocomb, Aid. William Le Doux, Utility Supt. Scott
Kloskowski, Mayor and Ruekert-Mielke representatives Richard Eberhardt and Ken
Ward (Mr. Ward arrived at 7:56 P.M.).
It was noted by Aid. Sanders that the meeting was posted in accordance with the Open
Meeting Law.
Review of Minutes of Previous Meeting
The minutes of the meeting held on April 17, 2000 were reviewed. Ald. Slocomb made
a motion to correct the minutes under the Hillendale Water Project - Waste
Management, to read as follows: "Ald. Slocomb made a motion to direct the engineers
to age prepare an easement over the property south of the Loppnow property
(#2233.996. 00 1) in order to install water service to the Loppnow property. Ald. Sanders
seconded, motion carried." Ald. LeDoux seconded, motion carried. After the minutes
are corrected they will be placed on file.
Status of Projects
Mr. Rich Eberhardt gave status of City Projects as attached. Mr. Ken Ward updated the
committee on the status of EPI. Due to the delay in connection the State now has new
requirements. Ald. Sanders made a motion to direct the engineers to design under the
new State standards which include, double wall pipes and a leakage monitoring station.
Ald. Le Doux seconded, motion carried. Mr. Ken Ward will draft a letter to notify EPI.
Status of Town of Norway Contract Nothing new to report.
Further Discussion on Policy on Connections (Capacity Utilization Permit)
Scott is still working on the changes and will report back to the committee prior to
sending the changes to the Attorneys.
Further Discussion on COMM 83/Chapter 21
Mayor provided a copy of the rules. This item will be on the Plan Commission Agenda.
The ordinance possibly will have some changes that will be affected by the plan.
Further Discussion on Sewer Rate Study
Aid. Slocomb had met with the Finance Director, Don Vilione, Scott and Renee to
discuss the formulas. Jean Marenda supplied a timeline. Ken Ward and Christy
Cramer of Ruekert - Mielke, worked together to draft the ordinance changes. The
ordinance had been faxed to Attorney Molter's office. Mr. Ken Ward was present to
discuss some of the ordinance changes. The committee discussed the Utility should be
responsible for the cost of the maintenance of the laterals unless there is misuse by the
property owner. Mr. Ken Ward advised the committee that Muskego is one of the few

communities that provide a payment plan for the RCAs & WCAs assessments. The
committee would like the Sewer Utility Clerk to provide the number of RCA
assessments that had been put on the payment plan. Aid. Slocomb requested to meet
with staff prior to the next months meeting.
Review Quarterly Billing- Town Of Norway
The committee reviewed the letter disputing the way the charges had been calculated
along with the payment for the 1 st Qtr bill for 2000, in the amount of $17,435.18 and the
balance of 1999 in the amount of $507.62. Aid. Sanders made a motion to
acknowledge the payment was made under protest. Aid. Slocomb seconded, motion
carried.
Review Request for Sewer Connection - Rausch/Woods Rd.
The committee reviewed the Application for Capacity Utilization submitted by Pegarl
L.L.P, previously had been approved for a total of 12 units; 3 Bedrooms each for tax
key #2228.998 which will be serviced by grinder pumps. Mr. Rich Eberhardt discussed
with the committee the capacity available, he stated the potential of 134 single families
could be served. Aid. Sanders made a motion to approve their request for an additional
8 single families for a total of 20. Aid. Slocomb seconded, motion carried.
Oversizing Sewer & Water The committee reviewed Attorney Molter's letter. Scott
would like the committee to have some provisions on negotiating with the developer on
the responsibility of payment for the oversizing of sewer and water. This item needs to
be on the Public Works agenda for storm sewer. The committee directed Scott to work
with the engineers to make changes in the ordinance and report back to committee.
Review Deferred Assessment - Loomis Drive Sewer Project (#2259.995 - Counter)
The committee reviewed the request to reduce the frontage for the Counter property
(#2259.995). The Sewer Utility Clerk provided minutes from the 5/18/98 meeting,
stating an error of 9.75', but no action had been taken by the committee. Aid. Sanders
made a motion to Amend the Final Assessment roll to reduce the assessment 9.75'
which will become non -assessable. Aid. Le Doux seconded, motion carried.
Discuss Deferred Assessment Policy
The committee discussed the request from Mr. & Mrs. Counter (# 2259.995) to reduce
the minimum payment of $5000.00 on their deferred assessment. Currently the
program for tracking the payments has been an issue. Aid. Slocomb made a motion to
accept partial payments of no less than $1000.00 on the deferred assessment for the
Counter (#2259.995) deferred assessment. Aid. Sanders seconded, motion carried.
Review Request for Sewer Capacity Sarah Estates
The developer had submitted the capacity utilization permit application for the property
located at 16700 W. Woods. Rd. (#2218.990). Aid. Sanders made a motion to approve

the 26 single family homes for the Sarah Estates (#2218.990) development. Ald.
Slocomb seconded, motion carried.
Review Request to Relocate Sewer Easement ( Woods Rd. - Baas)
Mr. Robert Baas property owner of #2228.994.001 is requesting the easement to be
relocated to accommodate an addition on their house. Mr. Eberhardt discussed the
easement and gave the builder a sketch to relocate the easement. Mr. Baas agreed to
the encroachment and agreed to his deck only being 10' off the house. Ald. Sanders
made a motion to recommend to the Common Council to vacate the current easement
that is west of the manhole and relocate to facilitate the Baas addition. Ald. Le Doux
seconded, motion carried. Ald. Sanders made a motion to approve locating an
additional easement 5' wide on the westerly property line of the Baas property and 15'
wide along the eastern portion of the of the Rausch property (common lot line) to
facilitate the grinder line to serve properties along to the west of Woods Rd. Ald.
Slocomb seconded, motion carried.
Acceptance of Improvements (Lakeview Highlands North Sewer)
Ald. Sanders made a motion to approve the acceptance of improvements for the
Lakeview Highlands North subdivision. Ald. Le Doux seconded, motion carried.
Review Chapter 28 regarding Meter Installation
Scott reported the requirement for installing Neptune Meters was not found in Chapter
28. A review of files indicated there is nothing in the City's municipal code requiring
that Neptune meters need to be used. The only correspondence is a letter that was
written by a former building inspector, advising that all meters should be Neptune. The
building department is aware of the correct fittings that are required to install the
meters. Ald. Sanders made a motion to require individual property owners to have
meters for subdivisions that have community wells. Ald. Slocomb seconded, motion
carried.

adjourn at 9: 50 p.m. Ald. Slocomb seconded, motion carried.

MMSD HAS INFORMED R/M THAT THEY WILL BE OPENING MANHOLES 30 DAYS
AFTER BINDER PAVEMENT IS INSTALLED. IF INTERNAL SEALS ARE NOT INSTALLED THEY
PLACE THE CITY'S NAME ON A LIST. EVERY THIRTY DAYS THEY RECHECK. IF YOUR
NAME IS ON THE LIST FOR THREE MONTHS IN A ROW FOR A SINGLE PROJECT, MMSD WILL
STOP ALL APPROVALS.
