MINUTES OF MEETING HELD MONDAY, February 16, 1998
The meeting was called to order at 7.10 PM by Chairman Sanders. Also present were Committee
members Aid. Woodard and Aid. Slocomb, Mayor DeAngelis, Utility Supt., Scott Kloskowski, Richard
Eberhardt (Ruekert & Mielke), and those per the attached list.
The Committee noted that the meeting was posted in accordance with the Open Meeting Law.
NOTICE OF CLOSED SESSION: Chairman Sanders read the Notice of Closed Session.
Review Minutes of Previous Meeting: No corrections or additions were made.
Status of Projects: Mr Eberhardt provided an update on existing projects with items italicized that
had recent activity (attached). Specific discussion regarding the following projects:
Sal Ferrito Sewer (Private Sanitary Sewer): Aid. Slocomb reported the dewatering well on the Ferrito
property was still in place and that ground water from the sewer trench is flowing from the well. Aid.
Slocomb asked Rich Eberhardt if the sewer pipe and gasketed joints are designed to withstand these
types of hydrolic pressures. Rich indicated that they are. Discussion continued about the high water
levels in the sewer trenches in the Boxhorn, Ryan and Groveway area and possible solutions. The
Committee referred Aid. Slocomb to the Public Works Committee to investigate the feasibility of
installing a French drain to relieve the pressure. Aid. Slocomb reported that there seemed to be a lot
of water running into the Ryan Road lift station and wondered if it was from infiltration. Scott K., said
he would look into televising the area again.
• Spitzner - Woods Road: MMSD just located basin change request. Change map is going out
tomorrow. Same for Bennett/Boxhorn Gun Club.
Holz Drive Re -bid: R&M calculated a cost estimate for the project of $105,000. Rawson Contractors
bid came in at $72,726.00. Rawson Contractors has done several jobs in the area. R&M
recommends that the project be awarded to Rawson Contractors. A cost to residents in the area is
approximately $3,000. Residents affected need to be contacted and asked where they would like the
grinder pumps located. An Assessment Roll was provided for Committee members review in order to
provide them with the necessary data.
Scott K., discussed the possibility of an open forum to discuss this project with the residents, one hour
prior to the meeting on the 251" of this month.
North Cape/Schaefer Committee members need to determine assessable frontage for these
properties. It was determined to assess one lot immediately and 2 deferred assessments for the May
property. Tax key 2211.998.
Lannon/Martin Sewer Project: Assessment Roll was provided. Rich questioned a potentially dividable
Stack property. Tax key #2171.991 not currently included in the Roll. Depending on the sewer
method used the resident could have a sewer along his property. Hook-up would be mandatory.
Sewer service and future area development was discussed. Summary of charges on this project to -
date are $12,410.92. Scott K., to check Assessment Roll to determine if parcel has already been
assessed.
Well No. 2 Rehabilitation Quotes: Scott K., provided a copy of the quotes for the project (attached).
The recommended vendor was awarded the job and has begun the project.

Linnie Lac Sewer Allocation (New Berlin): The City Attorney is working on this determination at this
time. The main issue is how to handle and determine peak flow.
• SEWER UNFINISHED BUSINESS
Status of REC Allocation: 956 as of 2/1 /98
Status of Town of Norway Contract: Closed Session Topic
Update on MMSD Facilities Plan: The Mayor reported that comments were submitted last Friday.
The questions posed were returned with MMSD's responses. The plan goes to the DNR in April for
approval. The Mayor stated that the 1/1 Subcommittee was being reconvened by MMSD due to the
questions raised at the public hearing.
Status of 208 Sewer Plan Amendment: The Mayor reported that the amendment has not yet been
adopted.
Status of MMSD Non-WPAP Charges: The Mayor received a response from Anne Spray Kinney,
Executive Director of MMSD (attached). In her response, she acknowledges the City's position and
agrees that the City does not waive or relinquish its rights by agreeing to the delay of non-WPAP
charges.

• SEWER NEW BUSINESS
Discuss Emerald Park Landfill's Dedication of Generator: Mr Gene Kramer is requesting a
waiver from the requirement to install a generator for the Emerald Park Landfill site lift station. The
Committee discussed the options of a portable or a fixed generator Aid. Sanders moved to require
Emerald Park Landfill to install either a fixed generator in a permanent structure or portable
generator, accessible to Scott Kloskowski 24-hours. Aid. Slocomb seconded. Carried by all.
Reauest for three sewer connections on Pioneer Drive (Holtz ProDertv): Residents Dan and
Lana Arrowood were present for this agenda item. Rich Eberhardt provided a brief overview of the
project. There is no conceptual approval from Plan Commission so that sewer service approval could
be obtained. Three connections are requested. There is an existing property that would be required
to be hooked -up. The revised 100-year flood plain in relationship to the existing property was
discussed. The resident on the existing property, has indicated that he will not flood proof his
basement. Due to this, the Committee discussed a first floor only hook-up. Aid. Sanders moved to
approve 3 connections, contingent upon existing home have first floor only hook-up. Aid.
Woodard seconded. Carried by all.
amendments to Municiaal Code to clarifv sewer
-k Jean Marenda's written request, Aid. Woodard moved to
Sanders. Carried by all.
Clarification of RCA charges - Rozman True Value and Ryan Rd., Cottage: Renee Kowalik,
. Sewer Utility Clerk provided a written explanation on the difference between "existing users" and
"future users" (attached). The two above -mentioned properties, both fell under the "future user"
definition. However, at the December Utilities Committee meeting, Mr Goetsch, owner of a cottage on
Ryan Road was advised he would owe the 1997 rate as an "existing user", and the fee was paid. The

the resident will occur. Seconded by Aid. Slocomb. Carried by all.
Committee determination of whether lot must be connected to sewers: Resident Richard
was present to discuss his situation. The resident wishes to subdivide the lots on his
property located on Hillendale Drive. Due to the number of lots and the proximity to the sewer line, he
will connect those properties to the system. The resident would like to circumvent the sewer on his
one parcel which already has a 2-year old Class A septic system. Options to bypass the connection
were discussed. The Mr Knudsen is requesting deviation from the current policy. The Committee
discussed the legality of allowing the resident to deviate from policy. Mr Eberhardt strongly
suggested that no deviation occur for any resident. Aid. Slocomb moved to defer until legal
counsel is obtained and an opinion is ascertained. Aid. Woodard seconded. Carried by all.
Review sewer connection allocation approval: The sewer approval expired for the Peterson
development on McShane Drive in 1995. 6 lots were intended to be developed. Rich Eberhardt
advises that the City ask for those connections back from the MMSD. Aid. Sanders moved to apply
to MMSD to get 6 allocations back. Aid. Woodard seconded. Carried by all.
WATER UNFINISHED BUSINESS
Status of Well Abandonment & Forced Hookup: Contractor has completed The Mash Ian job at
S76 W18261 Janesville Road. Another hookup remains to be finalized for B. Snowball at S80
W19002 Janesville Road. Scott K., is working to obtain a quote.
• WATER NEW BUSINESS - None
REPORT OF UTILITY SUPERINTENDENT:
Scott received a call from the DNR that alerted him to the presence of Vinyl Chloride in 2 individual
wells located on Hillendale Drive approximately 2,000 feet south of Janesville Road. Waste
Management rechecked the water and found those materials present in the water. The DNR is
looking for other wells to test in the area. The DNR may also be looking to the City to provide
permanent water service to these affected individuals. Scott mentioned to the DNR that this would not
be able to be performed until next fiscal year due to no budgetary funds available for a project of this
magnitude.
A resident contacted Scott regarding some difficulties he was having with his lateral for many years. A
contractor hired by the resident dug up the pipe and found it cracked, with additional problems with the
pitch of the pipe. Due to the pipe being in the right-of-way the City will be contacted by the resident for
reimbursement.
Hydrant flushing will occur again. Scott will be trying two new methods to inform residents of the
flushing in addition to notification on quarterly water bills currently done. A brief mention of the project
will be in the next City newsletter, additionally, a telephone number will be set up so that individuals
may call and find out where and when the next flushing will occur
Aid. Sanders moved to convene into closed session pursuant to State Statute 19.85(1)(g)
. conferring with legal counsel for the government body who is rendering oral or written advice
concerning strategy to be adopted by the body with respect to litigation in which it is or is
likely to become involved; more specifically, contract with the Town or Norway. Action may be
taken in closed session. The Public Utilities will then reconvene into open session for the

purpose of adjournment. Woodard seconded. Roll call vote 3-0, carried by all. The Recording
Secretary was dismissed at 10:00 p.m.

The following are project updates for the projects the water dept. is currently involved with in the
City of Muskego:
1. Well No. 7 Pump Station - Project has been delayed by WEPCO but power is now
available and contractor is back to work. Mechanical work is proceeding. Substantial
completion in mid May.
2. Water Tower Painting - Scheduled to begin May 1.
3. Well No. 2 Rehabilitation - Quotes were opened for the test pumping and pulling of
the existing pump and were as follows:
Municipal well and Pump $ 3,420.00
Layne NW $ 3,700.00
CTW $ 6,495.00
Based upon these quotes the project was awarded to Municipal Well and Pump. Work should
begin at the site the week of the 16' and be complete within 10 days. We will make a
recommendation as to the next steps at that time.

that number and Notice -to -Proceed to Municipal Well & Pump, Inc. and the work can
begin.
Please let me know if there are any times you would not want this well out of
service. Otherwise, the contractor will be instructed to proceed as soon as possible.

Dear Mayor DeAngelis:
In our letter of December 8, 1997, we stated that the ongoing discussions about
the calculation of Exhibit 10 charges for the City of Muskego included estimates
developed by the District staff and that the final calculation under the Agreement is to
be made within three months after the final draw on the subsidized loans. The District
expects the final draw to occur after April 1, 1998. We went on to say that, assuming
the final draw occurs in April or May, 1998, we would then be able to discuss a final
• resolution without risk of any unknown factors.
In your letter of January 30, 1998, you indicate that this matter was discussed at
your Public Utilities Committee and by the Common Council and that the City is willing
to agree to the delay suggested in our letter of December 8, 1997 under the condition
that it is specifically understood that the delay in no way relinquishes the City's rights
under the contract for dispute resolution or arbitration as it relates to this billing.
Our suggestion that further discussion of the calculation of non-WPAP charges
for the City of Muskego be delayed to approximately May of 1998 was to enable both
parties to have all relevant information in hand when those discussions are resumed. It
was not intended to result in the relinquishment by the City of Muskego of any of its
rights under the contract for dispute resolution or arbitration as these rights relate to this
billing. We agree that Muskego does not waive or relinquish such rights by agreeing to
delay the discussion of the matter until the time suggested by the District.

FINAL RESOLUTION AUTHORIZING
AREA -WIDE RESERVE CAPACITY ASSESSMENT FOR DEBT SERVICE
• FOR SEWER SERVICE UNDER §66.60, WI STATUTES,
AND LEVYING RESERVE CAPACITY ASSESSMENTS (RCA)
AGAINST BENEFITED PROPERTY
WHEREAS, the Common Council of the City of Muskego, Wisconsin,
held a public hearing at City Hall at 7:00 p.m. on the 16th day
of September, 1991 for the purpose of hearing all interested
persons concerning the preliminary resolution and report of the
City Engineer on the proposed reserve capacity special
assessments for providing the availability of sewer capacity in
the area described in documents attached hereto, made a part
hereof and marked Exhibit "A", and heard all persons who desired
to speak at the hearing;
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the
City of Muskego, as follows:
1. That the report of the City Engineer pertaining to the
above described reserve capacity for sewer service, including
any amendments and modifications thereto, and including plans
and specifications, is adopted and approved.
2. That the Common Council shall advertise for bids and
carry out the improvements in accordance with the report and any
• amendments or modifications thereto of the City Engineer.
3. That payment for the said capacity be made by assessing
part of the cost to the property benefited as indicated in the
report and amendments and modifications thereto.
4. That assessments shown on the report, including any
amendments or modifications thereto, do represent an exercise of
the police powers as per Section 66.60(1)(b), Wis. Stats., have
been determined on a reasonable basis and are hereby confirmed.
That the number of residential equivalency units to be assigned
for future development shall be determined as stated in the City
Engineers report, including any amendment of modifications
thereto as adopted by the City of Muskego. The reserve capacity
charge shall be as follows:
Existing Users
Property owners whose improved lot has been connected to
City sewer prior to January 1, 1992 will pay a reserve
capacity assessment of $340 per residential equivalency
connection. Properties being served prior to public sewer
connection by septic system, mounds and holding tanks will
pay this assessment on or before November 1 in the year the
plumbing permit is obtained to connect to the sewer except
if said permit is obtained after November 1 in any calendar
. year, the assessment will be paid on or before November 1
of the next calendar year. This $340 assessment shall
increase by $22.50 per residential equivalency connection
per year commencing January 1, 1992.

Future Users
• Properties where public sewer connection takes place or
additional capacity is made available after January 1,
1992, and which are not being served by a septic system,
mounds or holding tank, will pay a reserve capacity
assessment of $2040 per residential equivalency connection
on or before November 1 of the year of connection or the
year when additional capacity is made available after
November 1 in any calendar year, the assessment will be
paid on or before November 1 of the next calendar year.
This reserve capacity assessment will increase by $135 each
January 1 commencing on January 1, 1992.
5. That the assessments for those connecting to the City
of Muskego sewer system on or before the dates of passage of
this resolution may be paid in cash in full on or before
November 1, 1992, or in five (5) equal annual installments of
principal together with 12 months interest per installments at
the rate of 9% per annum on the unpaid balance commencing on
November 1, 1992 and said first installment being due on the
date when real estate taxes are due and annually thereafter.
All assessments or installments which are not paid by the date
specified shall be extended upon the tax roll as a delinquent
tax against the property and all proceedings in relation to the
collection, return and sale of property for delinquency real
estate taxes shall apply to such special assessment, except as
• otherwise provided by statute. Existing users as defined above
who are not connected will be given the five installment method
provided, however, the first installment shall be due and
payable on or before November 1 in the year the plumbing permit
is issued except if said permit is obtained after November 1 in
any calendar year, the assessment will be paid on or before
November 1 of the next calendar year.
Future users may pay their assessment in five (5) equal
annual installments of principal together with 12 months
interest per installment at the rate of 9% per annum commencing
on November 1 in the year of connection or in the year
additional capacity is made available except if said connection
or additional capacity is made available after November 1 in any
calendar year, then commencing on November 1 of the next
calendar year and said first installment being due on the date
when real estate taxes are due and annually thereafter. All

7. That the City Clerk shall publish this resolution as a
Class I Notice in the assessment district and mail a copy of
this resolution and a statement of the final assessment against
the benefited property to every property owner whose name
appears on the assessment roll whose post office address is
known or can with reasonable diligence be ascertained.
