PUM19970421CORRECTED PUBLIC UTILITIES COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD MONDAY, APRIL 21, 1997 .- The meeting was called to order at 7:10 p.m. by Chairman Sanders. Also present was Committee member Salentine, Mayor DeAngelis (arrived at 9:00 p.m.), Utilities Superintendent Kloskowski, Rich Eberhardt (Ruekert & Mielke), and those per the attached list. Ald. Slocomb was absent. The Committee noted that the meeting was posted on April 17, 1997 in accordance with the Open Meeting Law. Ald. Sanders read the Notice of Closed Session. The Committee reviewed minutes of meeting held March 17, 1997 and Ald. Sanders moved to correct minutes to reflect Rawson Contractors bid amount to be $470,261.00. Seconded by Ald. Salentine, motion carried 2-0. Rich Eberhardt updated the Committee on the status of the following projects: Boxhorn, Groveway, Ryan Sewer - Lien has been received from L. W. Allen. City Attorney has issued opinion that lien should be paid directly to L. W. Allen and deducted from Gustafson's contract. Ald. Salentine moved to release funds in the amount of $3,168.28 to L. W. Allen and deduct from amount owed to Gustafson for the Ryan isRoad sewer project. Seconded by Ald. Sanders, motion carried 2-0. Lien has been received from JMS Trucking. City Attorney's opinion of last Fall was that JMS had to file suit, in a specific timeframe against Gustafson. If JMS does not take action (and they haven't) they are out of options. If City takes no action, lien becomes invalid and Gustafson could be paid. Gustafson was to respond by April 15, 1997, to items brought up in the March meeting. Contractor has asked for extra time. City and Ruekert & Mielke need to transmit data on two items; liquidated damages and final payment. City Attorney has Ruekert & Mielke's recommendation on damages and Ruekert & Mielke is working on final quantities. The Committee discussed complaints from Contractors connecting laterals about inaccurate as -built measurements. Rich Eberhardt responded that if inaccuracy is suspected outside the normal tolerances (1-2 ft. vertical - 3 ft. horizontal) and field verified by Ruekert & Mielke, Ruekert & Mielke will work with the contractor to pay for fair and reasonable extra costs, if any. The Committee discussed the current procedure should an inaccuracy in the as -built drawings be suspected. • This procedure is: The Owner or Contractor contact Public Utilities Supt. Kloskowski. Utilities Supt. Kloskowski contacts Ruekert & Mielke, and Ruekert & Mielke sends a representative to the site to review allegation. Response time is usually 30-45 minutes if someone has to come from Ruekert & Mielke office. Ald. Slocomb asked if contact could be made direct to Ruekert & Mielke. EPI Lift Station - Redesign is completed and will be resubmitted to Wisconsin DOT this week. MMSD approval was granted on August 15, 1996. Well #7 - Muskego County Park - Correspondence from Ruekert & Mielke, dated April 10, 1997, was reviewed regarding the redrilling. Well screen should be in place this week. Substantial completion date is April 28, 1997 (except final site restoration and demolition) with final payment on May 22, 1997. Ald. Salentine moved to approve change order #2 for eight (8) day time extension and $1,000.00 increase in price. Seconded by Ald. Salentine, motion carried 2-0. Pumphouse for Well #7 - City Engineers are working on documents to • rebid the project. A number of changes need to be made to the site plan (with new location, additional sewer and water, and grading). The proposed unisex bathroom will be converted to a food pre/serving area for the park with no effect on construction cost anticipated. All bid documents will be prepared at the time of well completion with the exception of the well pump assembly. This will be prepared as soon as the test pumping is completed. Ad will be placed for bid on May 15, 1997, and May 22, 1997 and open bids on May 30, 1997. Well #5 - Kristin Downs - The Committee reviewed quotes for rehabilitation of well as follows: Layne Northwest $ 16,123.00 Municipal Well & Pump $ 27,815.00 Ald. Salentine moved to accept quote from Layne Northwest in the amount of $16,123.00 for rehabilitation of Well #5. Seconded by Ald. Sanders, motion carried 2-0. Loomis Drive - Punchlist items remain to be completed. North Cape Sewers - Minor restoration items remain to be completed. The Committee noted there are 1,013 RECs remaining to allocate. • The Committee reviewed the status of the Town of Norway contract. The Mayor noted that he is meeting with the Town of Norway on April 24, 1997. The Committee reviewed the status of Town of Norway sewer connection request by Don Pionek. Ald. Salentine moved to defer. Seconded by Ald. The Mayor stated that he will be meeting with the School District on April 22, 1997. Ald. Salentine moved to defer. Seconded by Ald. Sanders, motion carried 2-0. The Mayor updated the Committee on the status of the MMSD Facilities Plan and the M.I.S. Rehabilitation Plan. Ald. Sanders moved to name Mr. Bill Mielke to Technical Review Team of M.I.S. Rehabilitation. Seconded by Ald. Salentine, motion carried 2-0. There was nothing new to report on the 208 Sewer Plan Amendment. The Committee discussed interest rates for sewer and water deferred assessments, and reviewed memorandum from Finance Director Gunderson which indicated her concurrence with City Auditor Don Vilione that interest rates should remain at 8.0%. Ald. Sanders moved to have assessments remain at 8.0%. Seconded by Ald. Salentine, motion carried 2-0. The Committee reviewed quarterly bill from the Town of Norway. Ald. Sanders moved to approve payment to the Town of Norway in the • amount of $18,321.75. Seconded by Ald. Salentine, motion carried 2-0. The Committee reviewed quarterly bill from M.M.S.D. Ald. Sanders moved to approve payment to M.M.S.D. in the amount of $142,219.68. Seconded by Ald. Salentine, motion carried 2-0. The Committee reviewed Preliminary Assessment Roll and Public Hearing minutes for HiView Drive sewer project. Ald. Salentine moved to adjust assessment roll to reflect that property tax key #2209.936 and #2209.941 have been deed restricted to prevent division, and that deferred unit assessments for each should be deleted from the roll. Seconded by Ald. Sanders, motion carried 2-0. Ald. Sanders moved to delete tax key #2210.994 and #2210.995 from the roll, per the request of the property owners as they do not wish to be part of the project. Seconded by Ald. Salentine, motion carried 2-0. Ald. Sanders moved to set interest rate at 8.0% for the HiView Drive sewer project. Seconded by Ald. Salentine, motion carried 2-0. Ald. Sanders moved to set November 1, 1998 as the date for assessments to commence for the HiView Drive sewer project. Seconded by Ald. Salentine, motion carried 2-0. • Ald. Sanders moved to direct engineer to relocate lift station for the HiView sewer project to alternate site in the easement, and to serve farm house, and to apply one unit assessment only to tax key #2209.999, with no deferred assessment. Seconded by Ald. Salentine, motion carried 2-0. • PUBLIC UTILITIES COMMITTEE - PAGE 4 APRIL 21, 1997 The Committee directed that Clerk -Treasurer send resident Ralph Hoeft, W133 58070 Northview Drive, the necessary paperwork for a Waiver of Assessment for another lateral requested at Public Hearing. The Committee reviewed Public Hearing minutes for the Holz Drive sewer project. Ald. Salentine moved to direct Ruekert & Mielke pursue getting a written response from the State of Wisconsin as to parameters required to service properties by hung plumbing. Seconded by Ald. Sanders, motion carried 2-0. Ald. Salentine moved to defer action on project. Seconded by Ald. Sanders, motion carried 2-0. The Committee reviewed sewer service extension request for Miller for property on Racine Avenue north of Simandl Drive. Ald. Sanders moved to approve plans contingent on Ruekert & Mielke approval of plans for four connections (8 RECs), and to direct Ruekert & Mielke to forward plans to M.M.S.D. Seconded by Ald. Salentine, motion carried 2-0. The Committee discussed plans for sewers on North Cape Road-HiView Drive south of Durham Drive. Ald. Salentine moved to direct • Ruekert & Mielke to begin preliminary engineering for project from HiView Drive to as far south as practical. Seconded by Ald. Sanders, motion carried 2-0. The Committee reviewed sewer requirements for Industrial Park sites. The Committee reviewed supplemental report for Industrial Park Site I4 and I5. Superintendent Kloskowski updated the Committee on the status of well abandonments. The Committee reviewed sketch of relocation plan for the Muskego Center (Berg) with City Engineer. The Committee reviewed correspondence from City Engineer regarding Regional Groundwater Management Plan. Ald. Salentine moved to send letter supporting 3-D groundwater simulation model. Seconded by Ald. Sanders, motion carried 2-0. Superintendent Kloskowski reported that the proposed ordinance regarding meter reading has been sent to Atty. Molter for review. Ald. Salentine moved to go into Closed Session at 10:55 p.m. pursuant to State Statute 19.95 (1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect • to litigation in which it is or is likely to become involved; more specifically, allocation of sewer connections for the Norway Sanitary District.
