PUM19961118PUBLIC UTILITIES COMMITTEE - CITY OF MUSKEGO l J • MINUTES OF MEETING HELD MONDAY, NOVEMBER 18, 1996 The meeting was called to order at 6:00 p.m. by Chairman Sanders. Also present were Committee members Rasmussen (arrived at 6:15 p.m.) and Salentine, Utilities Superintendent Kloskowski, Richard Eberhardt (Ruekert & Mielke), and those per the attached list. The Committee noted that the meeting notice was posted on 11/13/96 in accordance with the Open Meetings Law. Chairman Sanders read the Notice of Closed Session. Richard Eberhardt, Ruekert & Mielke, updated the Committee on the status of the following projects: Boxhorn,Groveway,Ryan Sewer - A notice of consideration to declare the contractor "in default" has been sent to the contractor and their surety company. Woods Road Sewer & Water Project- Lift station work proceeding; as builts have been started. The Committee reviewed request from contractor for a time extension from November 1, 1996 to December 13, 1996. Ald. Salentine moved to defer time extension request. Seconded by Ald. Sanders, motion carried 2-0. Racine Avenue Water Project (AF Muskego Regency Center) - City restoration has been completed. ollo to Pioneer and Pioneer to is finalizing payment and all Hillendale (Raboine) Sewer Ext. - The City is still waiting to receive a copy of sewer plans for Raboine. The contractor has requested final payment and the City Engineers have submitted to the contractor the final change order with list of needed documents. A video tape has been received. HiView Acres/Holz Drive Sewer Extension - The City has received information from the City Engineers listing three possible sites on the Schweitzer property for installation of one of the required lift stations. The relocation order for the Durham Drive lift station has been approved by the Common Council. Waukesha County Park Sewer & Water Project - The project is on hold pending resolution of payment of engineering review fees for construction that are being disputed by the County. Well #7 - Muskego County Park - A new site has been established by the County and the City has been given permission to install test well next week. Pumphouse for Well #7 - Muskego County Park - Bid date has been put on hold. • Loomis Road Lift Station - Final completion was determined to be November 1st. Mayor and Dan Warren (R & M) are meeting with contractor on 11/21/96 to determine liquidated damages. Contractor was sent a letter listing documents needed to close out project. PUBLIC UTILITIES COMMITTEE - PAGE 2 November 18, 1996 • Loomis Drive Sewer Project - Paving has been completed and punch item list has been sent to the contractor. Video tape has been received. North Cape Road Sewer Project - Project is completed with minor restoration left. Punch list has been sent to contractor and video tape has been received. The City reviewed request from the contractor, Super Excavators, for an extension of time, along with correspondence from City Engineers addressing the following issues: Three days time extension for addition of an 8-inch sanitary sewer in an easement between Manhole 13a and Manhole 13b. City Engineers recommend request for extension be granted. Additional three days for addition of an 8-inch sanitary sewer from Manhole 16a to a point on the opposite side of North Cape Road. City Engineers recommend request for extension be granted. One additional day for the cut in of a new connection and riser to the property at the northeast corner of Loomis Drive and North Cape Road. City Engineers recommend request be denied as lateral placement is the contractor's responsibility. • Additional days for the restoration adjacent to the bypass lane installed on the east side of North Cape Road. City Engineers recommend request be denied until resolution of whether or not there will be an additional cost for this restoration. Additional five working days for "unanticipated quick ground conditions". City Engineers felt request for extension should be denied based on the terms and conditions of the contract. Additional time after receipt of punch list. City Engineers recommend denial for time extension for punch list items as there would not be any items if project was done in accordance with contract. Correspondence from City Engineers was also reviewed regarding Super Excavators Inc. requesting compensation for the repair of two drain pipes encountered on the extension of the sanitary sewer for the Ritzmann property as the pipes were not shown on the drawings. The City Engineers agree that the pipes were not shown on the drawings but feel that it is the contractor's responsibility to review the site which included an existing catch basin. The claim for additional repair work compensation is • $373.60. Ald. Salentine moved to approve six (6) day time extension. Seconded by Ald. Sanders, motion carried 3-0. Ald. Sanders moved to approve additional repair work compensation in the amount of $373.60. Seconded by Ald. Salentine, motion carried 3-0. PUBLIC UTILITIES COMMITTEE - PAGE 3 November 18, 1996 • Sewer & Water Study/Industrial Park Sites Nothing new to report. Hillendale Water Reservoir - Reservoir and Booster Station has been completed and warranty is in progress. The Committee noted that the number of REC allocations remaining is 1124 as of November 1, 1996. The Committee reviewed a memorandum from Plan Director Matt Sadowski on the status of Lake Denoon sewer connections. Ald. Rasmussen moved to file Notice of Claim for sewer connections. Seconded by Ald. Salentine, motion carried 3-0. There was nothing new to report on the status of Candlewood Creek sewer & water extensions. Ald. Sanders moved to defer action on request to waive past due charge (Zielski). Seconded by Ald. Rasmussen, motion carried 3-0. Ald. Salentine moved to go into Closed Session at 7:00 p.m. pursuant to §19.85(1)(e), Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive • or bargaining reasons require a closed session, and (g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved; more specifically, allocation of sewer connections for Norway Sanitary District. Action may be taken in Closed Session. Seconded by Ald. Sanders, motion carried 3-0. The Public Utilities Committee reconvened into Open Session at 7:45 p.m. to continue with agenda items. The Committee reviewed request for sewer connections for the Muskego Norway School District and the Town of Norway. Ald. Sanders moved to approve 35 connections contingent on the Muskego/Norway School District indemnifying the City of Muskego Sewer Utility against any and all lawsuits. There was no second. Ald. Salentine moved to defer, pending legal review regarding Notice of Claim. Seconded by Ald. Rasmussen, motion carried 2-1, with Ald. Sanders voting "no". The Committee reviewed memorandum from Plan Director Sadowski listing the most recent estimates for population by the year 2020 for existing expanded areas of the Norway Utility District (208 Sewer Service Boundary). The Committee reviewed the 208 Service Area map with proposed sewer service area expansions identified by • staff. Ald. Sanders moved to approve the area designated on map presented, and to forward information to MMSD, SEWRPC, and the Town of Norway. Seconded by Ald. Rasmussen, motion carried 3-0. PUBLIC UTILITIES COMMITTEE - PAGE 4 November 18, 1996 • Mayor De Angelis informed the Committee of correspondence received from Metropolitan Metropolitan Sewerage District advising of the creation of a Municipal Customer Network as an ongoing mechanism for sharing information between MMSD and the communities. MMSD is requesting that the City provide a representative for this committee. The Mayor stated that Utilities Superintendent Scott Kloskowski has been designated as the City's representative. The Committee reviewed request from Don Pionek for six (6) sewer connections for the Schuler property (Denoon Beach Estates) from the Town of Norway. Ald. Rasmussen moved to approve six (6) lateral connections. Seconded by Ald. Salentine, motion carried 3-0. Ald. Salentine moved to refund $100.00 main approval fee to Mr. Pionek, as a main extension cannot be approved at this time. Seconded by Ald. Rasmussen, motion carried 3-0. Utilities Superintendent Kloskowski updated the Committee on the status of Well Abandonment permits. Status of Water Reservoir site was removed from the agenda. Information Systems Director Joe Sommers appeared before the Committee to further discuss status of Utility Billing Software. Ald. Sanders moved to approve expenditure in the amount of $25,590.00 for BRC for utility billing software, and the amount of • $11,206.00 for bar coding. Seconded by Ald. Salentine, motion carried 3-0. The Committee discussed Well #7 repairs. Ald. Salentine moved to reject all bids. Seconded by Ald. Rasmussen, motion carried 3-0. Correspondence from City Engineer Ken Ward was reviewed with recommendations for the 1997 Front Foot Assessment for the Water Utility. Mr. Ward's review included past rates, current inflation rate, the construction price index rate and current construction costs. Based upon his review, Mr. Ward is recommending the following: Commercial & Industrial $39.10 (presently $38.20) Residential $34.65 (presently $33.85) Ald. Sanders moved to recommend approval of the above rates for 1997 for water front foot assessments. Seconded by Ald. Salentine, motion carried 3-0. Correspondence from Ruekert & Mielke, dated November 18, 1996, was read regarding the watermain extension plan presented by Muskego Health (Boldt/St. Luke's) for review. Ald. Sanders moved to approve watermain plans, contingent on items listed in Ruekert & • Mielke's letter. Seconded by Ald. Salentine, motion carried 3-0. SUBDIVISIONS PUBLIC UTILITIES COMMITTEE - PAGE 5 November 18, 1996 • The Committee reviewed acceptance of improvements for the MSI General site (commercial). Ald. Salentine moved to accept water system improvements as requested. Seconded by Ald. Sanders, motion carried 3-0. There nothing new to report on Deer Creek Subdivision. Ald. Salentine moved to adjourn at 8:00 p.m. Seconded by Ald. Rasmussen, motion carried 3-0.
