MINUTES OF MEETING HELD WEDNESDAY, DECEMBER 20, 1995
The meeting was called to order at 7:05 P.M. by Chairman Sanders.
Also present were Committee Members Rasmussen and Salentine,
Utility Superintendent Scott Kloskowski, Richard Eberhardt
(Ruekert & Mielke) and those per the attached list. Mayor De
Angelis arrived at 8:45 P.M.
The Committee noted that the meeting was posted on December 15,
1995, in accordance with the Open Meeting Law.
Boxhorn, Groveway, Ryan
The Contractor expects to start easement and lift station in mid
January. It was noted that the City Engineers are recommending
that the release of payment to the Contractor be significantly
less than requested because of work outstanding. Mayor will be
meeting with City Engineers and Contractor on Thursday, December
21, 1995, to review project and payment. The City Engineers are
compiling information on existing and previous road elevations and
will report results as soon as compiled.
Woods Road Sewer & Water Project
The lift station has been relocated and plans will be sent to MMSD
and DNR for approval.
Racine Avenue Water Project
The installation has been completed and restoration must be
completed and checked in Spring of 1996. Ald. Rasmussen
questioned plastic shavings found in pipes as a result of the
project and Mayor De Angelis explained that he has been in touch
with the Contractor and that all fitting repairs will be done by
the Contractor and parts have been ordered.
Hillendale (Raboine) Sewer Extension
Plans are being finalized by the City Engineers for submittal to
MMSD and DNR. Ald. Salentine moved to include the Daliege
property (Tax Key 2177.936) in the project and request that the
Plan Director advise the City Engineers of the assessable frontage
and units for all properties in the project. Seconded by Ald.
Sanders, motion carried 3-0. Rich Eberhardt will provide a map
for Plan Director determination.
Hi -View Acres/Holz Dr. Sewer Extension
• City Engineers have started drafting work on the project. Design
work will start the week of December 26th.

Waukesha County Park Sewer & Water Project
• The City is awaiting MMSD and DNR approval. Super Excavators are
ready to start work as soon as approval is received.
Loomis Road Lift Station
Work is continuing with substantial completion by mid May 1996.
The Committee reviewed the new timeline and the City Engineers
will monitor time closely. Contractor has been advised that there
will be no time extensions given.
Southeast Forcemain
Restoration must be checked in Spring of 1996. Electricity to
flow meter has not been completed. A punch list with minor items
to be completed has been given to the Contractor. As builts
should be completed and submitted to MMSD in December.
Loomis/North Cape Sewer Project
Rich Eberhardt, Ruekert & Mielke, presented quotes from the
Contractor for various options to install the gravity main under
the proposed new HWY 36 to the new lift station. The Committee
rejected the proposals as being too expensive and Supt. Kloskowski
suggested exploring the possibility of extending the main up to
the new highway right-of-way with future extensions to be done
• with the Loomis Drive Sewer project.
Sanitary Sewer & Water Study/Industrial Park Sites
City Engineers are completing draft which will be available the
first week of January 1996.
Sewer Timeline Update -Southeast District
No changes at this time.
The Committee reviewed the status of REC Allocation and noted that
with removing RECs for Southeast Sewer Projects (275), the REC
allocation available is 768.
Supt. Kloskowski reported on the status of commercial sewer
metering and reported that installations are continuing.
Affected property owners appeared, at the Committee's request, to
further discuss requests for sewer service for several properties
on Martin Drive and Lannon Drive. Rich Eberhardt, Ruekert &
Mielke, reviewed with those present a cost analysis provided by
the City Engineers dated December 1, 1996. A representative from
the Baas property expressed concerns on how the sewer would be
constructed and the cost of the project. Mr. Reynolds indicated
• that he may be interested depending on the cost. Utility Supt.
Kloskowski indicated that the Committee is required to provide
service to failing systems, if practical. Mr. Stack asked if,the

item had to be decided tonight. Ald. Rasmussen indicated that we
can proceed to provide more refined cost and project information.

Citizens questioned whether interest could be paid each year on
the assessment. The method would eliminate paying interest on
interest. Ald. Salentine moved to investigate the feasibility of
paying interest on a yearly basis. Seconded by Ald. Rasmussen,
motion carried 3-0. Ald. Salentine moved to direct Ruekert &
Mielke to proceed with development of design for the project.
Seconded by Ald. Rasmussen, motion carried 3-0. Ald. Rasmussen
asked that alternatives for the Reynolds properties be researched,
including potential connection at tennis court on Reynolds
property. The Committee also asked that the City Engineers
explore servicing Lannon Drive and Martin Drive properties through
an easement in the Marlan Meadows Subdivision, from Rossmar Court.
Seconded by Ald. Salentine, motion carried 3-0.
The Committee further discussed assessment policy and hardship
policy and reviewed correspondence from City Attorney and City
Financial Consultant in regard to qualifications for candidates.
Ald. Salentine moved to leave interest the same, use May 1st as
the required annual date for application renewal, amend page 2,
No. 1, to add "and be determined to qualify" after the words
"persons must apply", and to use the following language for
qualification for Hardship Status:
Individuals or Families with an annual income not in excess of
50% of the median family income for Waukesha County with
adjustments for family size, shall be qualified for hardship
status by the Common Council, committee or representative
making said determination following Rules and Regulations as
the City may from time to time direct.
Seconded by Ald. Sanders, motion carried 3-0. The Committee will
review final draft at the January meeting.
The Committee discussed Emerald Park Landfill Sewer project. Rich
• Eberhardt, Ruekert & Mielke, advised that site plans have been
sent to Briggs & Stratton for approval. EPI received
clarification of connection date per agreement. The City is

looking at project and will research possible easement for future
extension.
The Committee discussed 1996 RCA rates and interest payment plan
rates. Ald. Sanders moved to decrease the interest rate for RCA
payment plan from the present 9% to 8%. Seconded by Ald.
Salentine, motion carried. Ald. Sanders moved to recommend
approval of the following rates for 1996:
Interest rate for ten (10) year payment plan for
front foot and lateral assessment will remain at 8%
1996 RCA Rate: $2,715.00 Single Family/New Construction
$ 452.50 Existing Family
Duplex: 3 Bedroom Each $5,430.00 (2.0 REC's)
2 Bedroom Each $4,072.50 (1.5 REC's)
1 Bedroom Each $2,715.00 (1.0 REC)
Multi -Family Charge Per Unit:
3 Bedroom $2,715.00 Each Unit
2 Bedroom $2,036.25 Each Unit

Seconded by Ald. Salentine, motion carried 3-0.
The Committee discussed establishing an assessment policy for
• wetland frontage. The Committee determined if the wetland is part
of the lot and necessary to meet the zoning requirements, the
frontage for wetlands would be assessed. If a larger expanse of
wetlands occur, the assessment would not be applied because the
property does not derive a benefit. Decisions would be made on a
case -by -case basis.
The Committee reviewed Amended Engineering Report for the
Boxhorn,Groveway/Ryan Sewer project and letter from Mrs. Kathie
Rivera requesting her house be assessed, but that she not be
required to connect at this time. Ald. Salentine moved to remove
property with the house from the project and verify new land
division for property on north/south of Boxhorn. Seconded by Ald.
Rasmussen, motion carried 3-0.
The Committee reviewed additional 7 ft. of possible assessment for
the Boxhorn/Groveway/Ryan Sewer project for tax key
2262.999/2261.982. Rich Eberhardt covered a number of problems
with the assessment roll, including the following:
1. The 7 ft. easement noted above was not previously included.
2. The Krause property is being overcalculated on frontage.
3. Calculation for frontage on end of Groveway in cul de sac.
jo Ald. Rasmussen moved to use the straight frontage calculation for
cul de sac because of the:

1. Layout of the properties.
• 2. The lack of the normal configuration of the cul de sac, with
properties all around the cul de sac.
3. The cul de sac is primarily for the benefit of school buses,
city plows, and other vehicles that need to turn around at
the end of Groveway.
Seconded by Ald. Salentine, motion carried 3-0. Ald. Salentine
moved to include the 7 ft. of additional footage. Seconded by
Ald. Sanders, motion carried 3-0. Ald. Salentine moved to adopt
option "C" assessment roll which recalculates assessment based on
removal of 1,230 ft. from Krause property and redistributing
through the remaining properties. Seconded by Ald. Sanders,
motion carried, 2-1, with Ald. Rasmussen casting the dissenting
vote.
The Committee reviewed the assessment policy for dividable lots.
Rich Eberhardt discussed with the Committee the problem where
houses are in the middle of a dividable lot. If the Plan Director
has specific examples of these cases; they should be presented to
the Committee for their review and determination on a case -by -case
basis.
The Committee discussed status of Well Site Investigation. Well
should be done in late December and well testing should be
• completed by early January 1996.
The Assessment and Hardship policy for water utility was discussed
along with sewer utility discussion.
The Committee discussed status of Well Testing requirement. Nancy
Payne, DNR, will have to come to properties to look at well and
determine if a variance can be granted. Property owner must
initiate contact.
The Committee reviewed establishing Second Amended WCA District.
Ald. Sanders moved to defer. Seconded by Ald. Salentine, motion
carried 3-0.
Mr. Dave Koscielniak, representing from Muskego Regency, appeared
before the Committee with water and sewer plans. Ald. Sanders
moved to agree on the conceptual plan, as submitted, subject to
review and negotiations for payment for a) hydrant review for
Racine Avenue; b) Extension of 12" on Woods Road; c) hydrant
review by the Fire Department; and d) stub end valve on
intersection of Jean Drive and Racine Avenue on 16" main.
Seconded by Ald. Rasmussen, motion carried 3-0. Utility Supt.
Kloskowski will contact the Fire Department to insure timely
review of the project. Scott also expressed a concern on Woods
Road connection so that the road is not paved prior to connection.
Mr. Mark Longstaff, PCS PrimeCo, appeared before the Committee to
request approval to lease antenna space on top of water tower

along with Mr. Brad Reynolds, Spring Telecommunications Venture
• who is also requesting to lease space on or under the water
tower. Ald. Sanders questioned how they are attached. Mr.
Reynolds indicated that they weld the equipment to the tower at
three points and liability is part of the lease agreement. Ald.
Rasmussen asked for pricing. Mayor De Angelis asked if buildings
had to be separate. Scott suggested single building with common
wall. Petitioners were agreeable to the proposal of a single
building. Ald. Salentine moved to have Mayor pursue negotiations
with the applicants. Seconded by Ald. Rasmussen, motion carried
3-0. Ald. Sanders asked if screening would be available to make
it more uniform looking. Applicants indicated that equipment can
be painted same color as the tower and screening was available.
Ald. Rasmussen suggested that the antennaes be below the ball of
the tower so they are more hidden and screening was available.
The Committee reviewed WCA, front foot for residential/Commercial
and interest payment plan rates for water plans for 1996. Ald.
Salentine moved to approve the following:
Front Foot - $33.85 Residential
Front Foot - $38.20 Commercial
WCA (5/8" Meter) - $1,230.00 New Construction
- $ 738.00 Existing
• Lateral: $875.00 as set by the PSC
Seconded by Ald. Sanders, motion carried 3-0.
The Committee reviewed proposal for participation in sandstone
aquifer study received from Bonestroo, Rosene, Anderlik &
Associates. Ald. Salentine moved to not participate at this
time. Seconded by Ald. Sanders, motion carried 3-0.
Ald. Rasmussen moved to defer review of quotes for internal paint
inspection for the water tower. Seconded by Ald. Salentine,
motion carried 3-0.
The Committee discussed external painting of water tower. Ald.
Salentine moved to direct Ruekert & Mielke to develop design and
specifications for painting and obtain bids. Seconded by Ald.
Rasmussen, motion carried 3-0.
The Committee reviewed assessment policy for dividable lots for
water projects in above section where they discussed policy for
sewer projects.
Supt. Kloskowski discussed with the Committee illegal water
connections. Ald. Sanders moved to write a letter to each
property owner that has an illegal connection billing them for the
• $522.00 Water Capacity Assessment for each dwelling, advise that
they must have a meter installed within fifteen (15) days, and
also advise the property owner of property addressed S74 W17314

Lake Drive that they have thirty (30) days to disconnect house and
• provide separate water service to property addressed S74 W17314
Lake Drive and that they have thirty (30) days to locate and
expose the service valve box on the water lateral. Seconded by
Ald. Rasmussen, motion carried 3-0.
Ald. Rasmussen moved to adjourn the meeting at 12:15 A.M.
