MINUTES OF MEETING HELD TUESDAY, AUGUST 22, 1995
The meeting was called to order at 6:30 P.M. by Chairman Sanders.
Also present were Committee Members Salentine and Rasmussen, Mayor
• De Angelis, Ald. Suhr, Attorney Don Molter, City Engineer Ken
Ward, Utility Superintendent Scott Kloskowski, Plan Director Matt
Sadowski and those on the attached list. Ald. D'Acquisto arrived
at 6:45 P.M. and Ald. Misko arrived at 7:00 P.M.
The Committee noted that the agenda was posted on August 18, 1995,
in accordance with the Open Meeting Law.
The Committee discussed the Boxhorn, Ryan, Groveway Sewer
Contract. City Engineer Ken Ward provided a time line for the
project. Atty. Molter recognized the City's legal standing in
regard to the request from the Contractor, Gustafson Construction,
for a time extension. Attorney Molter suggested that we look at
getting a portion of the project done this year and the remainder
done next year. The reason was to retain the $300,000 savings
between the current contract and the next lowest bid. Attorney
Molter also indicated that legal options could delay the project
while the outcome was debated in court. He stated that the cost
increase proposed by the Contractor was not justified.
Because the differences were still outstanding, Chairman Sanders
suggested that we temporarily adjourn so details could be
discussed between the Mayor, attorneys, engineers and Utility
Supt. Ald. Salentine moved to adjourn at 7:00 P.M. with the
intention to reconvene after the Finance Committee meeting.
• Seconded by Ald. Rasmussen, motion carried 3-0.
The Committee reconvened at 7:50 P.M. The Chairman reflected that
all members at above meeting were also present for this meeting.
City Engineer Ken Ward gave a revised schedule for installation as
follows:
Complete by November 17, 1995:
Boxhorn to Groveway
Groveway from Boxhorn to as close to Ryan Rd. as possible.
Complete by May 31, 1996:
Remainder of Groveway
Remainder of Boxhorn
Ryan Road
Lift Station
Final Inspection June 30, 1996
No additional charges would be accepted.
Mayor De Angelis expressed his concerns about the delay of the
start of the project. He also indicated that the contractor knew
• we had 90 days before we had to issue the Order to Proceed. He
expressed a dislike in the delay, but did not want to lose the
$300,000 price advantage.
Ald. Rasmussen echoed the Mayor's comments and expressed his
disappointment with the contractor. He indicated that the

• contractor had not begun work for over three (3) weeks. Because
the Contractor had not executed the Contract in a timely manner,
the citizens were negatively impacted and it was not fair.
Ald. Salentine moved to adopt the revised schedule. Seconded by
Ald. Sanders, motion carried 3-0.
The meeting adjourned at 8:00 P.M.
