PUM19950622• PUBLIC UTILITIES COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD THURSDAY, JUNE 22, 1995 The meeting was called to order at 7:30 P.M. by Chairman Sanders. Also present were Committee Members Salentine and Rasmussen, Mayor De Angelis, Utility Superintendent Scott Kloskowski, Richard Eberhardt (Ruekert & Mielke arrived at 7:55 P.M.), and those per the attached list. The Committee noted that the meeting was posted on June 15, 1995, in accordance with the Open Meeting Law. There was nothing new to discuss on the Candlewood Creek, Senior Citizen Complex or Deer Creek Subdivision. The Committee reviewed status of request for Sewer Connection to Town of Norway (Roland Haut - Tax Key 2282.999) and noted that the City has not received a reply to their letter of May 17, 1995, requesting available connections. The Committee reviewed renewal of SCADA maintenance agreement and memorandum from Information Systems Joe Sommers, dated June 22, 1995, requesting the annual renewal of maintenance agreement, in the amount of $1,455. Ald. Salentine moved to recommend approval • of renewal of SCADA maintenance agreement. Seconded by Ald. Sanders, motion carried 3-0. The Committee reviewed proposal to purchase Sewer Utility Billing System along with recommendation from Information Systems Director Joe Sommers to defer until the costs of integration into our existing system are more clearly identified, and license fees are negotiated. Seconded by Ald. Sanders, motion carried. Mr. D. J. Koscielniak appeared before the Committee representing Regency Senior Communities to request additional RECs for the proposed Senior Housing Development on Racine & Woods Road. Ald. Rasmussen moved to approve an additional 45 RECs contingent upon rezoning and review of additional capacity. Seconded by Ald. Sanders, motion carried 3-0. The Committee reviewed draft of Public Hearing minutes on Boxhorn/Groveway/Ryan Sewer Project of June 19, 1995, and made spelling and typing corrections, along with changing the beginning of the sixth paragraph to read: "Scott Krause reviewed the history regarding bringing sewer to the Country Club. He stated that since his villages will be using the Ryan Road Lift Station internally, why should they be assessed $223,000?" Ald. Rasmussen moved to leave the assessments for Country Club • Villages (Tax Key 2258-994, 2258-996, and 2261-999) on the assessment roll. Seconded by Ald. Salentine, motion carried 3-0. Ald. Rasmussen moved to remove Tax Key 2252.963 from the assessment roll and that amount be added to the non -assessable Public Utilities Committee - Page 2 June 22, 1995 costs of the project. Seconded by Ald. Salentine, motion • carried. The Committee reviewed five page submittal from Mr. Mark Slocomb and noted that the submittal will be placed in the project file. Ald. Rasmussen moved to extend the project 36 feet on the southern end of Groveway to allow access to service property (Tax Key 2261.980) to rear of home along south lot line. Seconded by Ald. Salentine, motion carried. Ald. Salentine moved to approve the 50% unit/508 front foot assessment policy for this project. Seconded by Ald. Sanders, motion carried. Ald. Rasmussen moved to forgive the assessments on the lakeside lots of Tax Key 2252.987, 2252.989, and 2252.991, pending combination of the lots and securing utility easement to Tax Key 2252.993) and removal of all sewers from the Boxhorn easement leaving a 30 ft. stub to the property Tax Key 2252.985. The Committee discussed with Beth Lindberg, Towne Realty, their request for inclusion in the WCA (Water Capacity Assessment District) the proposed Candlewood Creek Subdivision. Ald. Rasmussen moved to include the Candlewood Creek Subdivision, the • Luedke properties (Tax Key 2172.997 & 2197.999) and the Schaefer properties (Tax Key 2201.994/.994.001 ), and to contact properties abutting Woods Road to determine if they would like to be included. Seconded by Ald. Sanders, motion carried. The Committee reviewed maintenance agreement for the Neptune meter reading software and hardware system (Schlumberger) in the amount of $1,524. Ald. Salentine moved to approve the agreement. Seconded by Ald. Sanders, motion carried. The Committee reviewed the draft minutes from the Public Hearing held June 19, 1995, and determined that a new Public Hearing will be scheduled for Tuesday, July 11, 1995, before the Common Council meeting as there was no quorum for the June 19, 1995 meeting. Utility Superintendent Kloskowski discussed with the City a possible water emergency as between 6:00 P.M. and 10:30 P.M. we are using more water than can be pumped. Ald. Salentine moved to authorize Mayor De Angelis to declare a water emergency when needed. Seconded by Ald. Sanders, motion carried. Ald. Salentine moved to adjourn at 11:50 P.M. Seconded by Ald. Robert Rasmussen W.142 S.7513 Freedom Ave. Muskego, WI 53150 Dear Bob: My compliments on your excellent work ad thanks for your efforts in presenting your research and amendments to the sewer assessments in our area. Unfortunately, as so often seems to be the case, our representatives seem to rely on their understanding of precedents instead of reasoning out the best ways to do things for each individual case. You seem to use the reasoning process and understand that each situation is different and needs objective analysis. I watched the entire process on TV but got a little lost in some of the discussion. It seemed that the Mayor said our CCV land assessments would be 100% deferred though the sheets detailing the assessments seem to indicate that this isn't so. At the same time I think I understood the Mayor to say that if we don't connect to the Ryan Road sewer line we wouldn't be assessed. However, that seems to beggar the question. For example, what would we be assessed if our only connection were a single point from the sewers within a Village - such as happened with Lake Forest? I understand the contention that, because we haven't presented definite plans for these areas we must be assessed on some basis. However, if we are forced to pay an assessment before the fact I have no idea what the reaction of our partners will be. As I mentioned, we have no objection to paying assessments for individual lots fronting on Ryan Road but also believe it unfair to assess us for more than a connection if we build everything internally.
