PCM20050906 PH BIRKLEY CUG CITY OF MUSKEGO PLAN COMMISSION PUBLIC HEARING MINUTES APPROVED 7:00 PM Tuesday September 6, 2005 Muskego City Hall, Muskego Room, W182 S8200 Racine Avenue 7:00 PM PUBLIC HEARING Upon petition of Mike Birkley be granted a Conditional Use Grant in accordance with section 6.03 of the City of Muskego Zoning Ordinance for the purpose of operating a tree service/landscaping business at the property located at the NE ¼ of Section 14 (Tax Key No. 2213.984 / Durham Drive). The audio for this meeting was not working, therefore no audio exists. PRESENT Mayor Damaske, Alderman Buckmaster, Commissioners Hulbert, Schaumberg, Simpson, Michalski, Plan Director Muenkel and Recording Secretary Asti. ABSENT Commissioner Stinebaugh Mayor Damaske declared the Public Hearing open at 7:00 p.m. Plan Director Muenkel stated that this Public Hearing is for a Conditional Use Grant to allow petitioner to operate a tree service and landscaping business on the property located on Schultz Lane just south of Durham Drive. Petitioner submitted for a Building, Site and Operation Plan for the property to run the business and Plan Commission determined that a Conditional Use Grant would be required for the use. This determination was made when the property was zoned RS-2/OHS, Suburban Residence District with a Highway Service Overlay. The Conditional Use Grant and Building, Site and Operation Plan Resolutions will be heard in detail during the Plan Commission Meeting as certain aspects of the zoning have changed. Mayor Damaske asked for members in the audience to address the Commission with their input of concerns, questions, comments, etc. Mr. Mike Birkley, W144 S7931 Durham Drive, addressed the Commission stating that he did not know why this meeting was being held as it is a done deal. The zoning has been removed and nothing will be granted. Is this a formality to have the meeting? Director Muenkel answered that petitioner submitted for a Conditional Use Grant which requires a Public Hearing. This is part of the process and needs to be accomplished. The Building Site and Operation Plan had been deferred until the Conditional Use Grant came forward to be discussed at the same time. This Public Hearing is to discuss the allowance for the operation of the business.
