PLAN COMMISSION MINUTES

Mayor Slocomb called the meeting to order at 7:02 p.m.
Those present recited the Pledge of Allegiance.
PRESENT
Mayor Slocomb, Alderman Buckmaster, Commissioners Hulbert, Schaumberg, Simpson, and
Michalski, Associate Planner Trzebiatowski and Recording Secretary Asti.
ABSENT
Commissioner Stinebaugh
Recording Secretary Asti noted that the meeting was properly noticed on October 1, 2004 in
accordance with the Open Meeting Law.
MINUTES
Commissioner Schaumberg made a motion to approve the minutes of the September 21, 2004
meeting. Commissioner Simpson seconded. Upon a voice vote, motion to approve the minutes
was adopted unanimously.

NEW BUSINESS FOR CONSIDERATION
Resolution #P.C. 103-2004 was taken out of order. Due to a conflict of interest regarding
Resolution #P.C. 103-2004, Mayor Slocomb recused himself and turned the meeting over to
Alderman Salentine.
RESOLUTION #P.C. 103-2004 – Approval of a three lot Certified Survey Map for the Rusdahl
property located in the NW ¼ of Section 13 (Tax Key No. 2210.989). This resolution was read
by title only. Commissioner Schaumberg made a motion to approve. Commissioner Hulbert

seconded. Associate Planner Trzebiatowski stated that petitioners are proposing to create
three residential parcels. The proposed parcels meet the zoning district requirements. The
existing wooden shed located between lots #2 and #3 will be required to be razed within six
months of recording the Certified Survey Map. Technical review will determine if the existing
barn located on lot #1 is larger than 1,387 square feet. If it is larger, the barn will be required
to be razed within six months of recording the Certified Survey Map. Other options would be to
alter the barn to 1,387 square feet or less, or pursue as a rustic structure. If determined to be
less than 1,387 square feet the barn may remain on property. If pursued as a rustic structure, a
conditional use grant would be required. A dedication of fifty feet on Durham Drive is
necessary since the ultimate right-of-way width is 100 feet. The Certified Survey Map must
show the drainage ditch and a minimum of a twenty foot public drainage easement covering the
drainage ditch. Commissioner Hulbert made a motion to amend the resolution to read, BE IT
FURTHER RESOLVED, That research will be done to determine if there is an existing
Conditional Use Grant on the property. Commissioner Michalski seconded. Upon a voice
vote, Resolution #P.C. 103-2004 was Amended unanimously. Upon a roll call vote, Amended
Resolution #P.C. 103-2004 was Adopted unanimously.
Alderman Salentine relinquished the chair back to Mayor Slocomb.
RESOLUTION #P.C. 092-2004 – Approval of a Final Plat for the Fireside Orchard Subdivision
located in the NE ¼ and SE ¼ of Section 18 (Tax Key Nos. 2229.990.002 and 2232.985 /
Hillendale Dale). This resolution was read by title only. Commissioner Simpson made a motion
to approve. Commissioner Michalski seconded. Petitioners proposing thirteen residential
parcels and three outlots. The residential parcels meet the zoning requirements. Associate
Planner Trzebiatowski suggested that Fireside Drive be renamed to Fireside Court since this
road will be a court. A Certified Survey Map is being pursued to divide off lots on the adjoining
southern parcel. Outlots two and three will be deeded over to the owners of the future parcels
to the south. Upon a roll call vote, Resolution #P.C. 092-2004 was Adopted unanimously.
RESOLUTION #P.C. 099-2004 – Approval of a two lot Certified Survey Map for the Erdmann
and Ritzman properties located in the NE ¼ of Section 25 (Tax Key Nos. 2257.981 and
2257.982). This resolution was read by title only. Alderman Buckmaster made a motion to
approve. Commissioner Hulbert seconded. Petitioner proposing to create two parcels. Each
parcel meets the zoning district requirements. The northern portion of this parcel is being
acquired from an adjoining property owner. The City will need a copy of the transaction prior to
Common Council approval. North Cape Road (U.S.H. 45) must be dedicated to the ultimate
width of one hundred feet. This will need to be handled with a letter of no objection from
Waukesha County or the State of Wisconsin Department of Transportation. Upon a roll call
vote, Resolution #P.C. 099-2004 was Adopted unanimously.
RESOLUTION #P.C. 107-2004 – Approval of an Accessory Structure for the Kremer property
located in the SE ¼ of Section 30 (Tax Key No. 2280.999.009 / S102 W20920 Kelsey Drive).
This resolution was read by title only. Commissioner Schaumberg made a motion to approve.
Alderman Buckmaster seconded. Petitioner proposing a 40’ x 99’ steel sided, steel roofed
structure with no eaves. The structure will be clay color to match the house with a charcoal
colored roof. The building will be located approximately 330 feet from the nearest road and 45
feet to the eastern lot line. Petitioner submitted a letter stating that the building will be used for
agricultural purposes. In the past, there have been conflicting interpretations of the zoning
code, as to whether agricultural use buildings should follow the architectural requirements of
accessory

structures in residential districts. Staff and City Attorney have reviewed the code and
determined that agricultural use buildings on residentially zoned lands must meet architectural
requirements unless the Plan Commission wants to wave those requirements. After discussion,
Commissioner Hulbert made a motion to amend resolution to add, BE IT FURTHER
RESOLVED, That a gable end be placed on the side of building facing the road, along with
overhangs that match the house. Upon a voice vote, Resolution #P.C. 107-2004 was
Amended unanimously. Upon a roll call vote, Amended Resolution #P.C. 107-2004 was
Adopted unanimously.

Commission, the meeting was adjourned.
