PC MIN 04-18-2000 PH AAA ASPHALT CITY OF MUSKEGO PLAN COMMISSION PUBLIC HEARING MINUTES Tuesday April 18, 2000 PUBLIC HEARING for a Conditional Use in accordance with Section 6.03 of the City of Muskego Zoning Ordinance for AAA Asphalt for the purpose of operating a vehicle maintenance and storage facility, located in the E 1/2 of the SE ¼ Section 30 (Tax Key No. 2280.999 / S99 W20523 Parker Drive). Present: Mayor De Angelis, Alderman Chiaverotti, Commissioners Hulbert, Schaumberg, Brodel, Smith, Gummer, Assistant Plan Director Wolff and Recording Secretary Asti. Secretary reported that the meeting was properly noticed in accordance with the Open Meeting Law. Mayor De Angelis declared the Public Hearing open at 7:40 p.m. Assistant Plan Director Wolff stated that petitioner is requesting approval to store business related seasonal equipment. Zoning code permits non-agricultural indoor storage as a Conditional Use. Petitioner plans to purchase the northern 35 acres of the parcel. The 40 acres located adjacent to Kelsey Drive are proposed to be divided for residential country estate purposes. Mayor De Angelis asked the petitioner if he wished to speak on this matter. Mr. Brian Hrin stated that he has been a long time resident of Muskego and is requesting to keep his business vehicles on the farm land he plans to purchase. There will be no outdoor storage. All vehicles will be kept inside the existing buildings. Mr. Hrin’s business is seasonal with the busiest time being in the summer months. Mr. Hrin purchases needed materials in advance, and materials are delivered to the jobsite. No asphalt or materials will be transported back to the farm. There will be no storage tanks or refuse brought back to the proposed property. Mr. Hrin stated that he has no future plans to subdivide this property. Mayor De Angelis asked for members in the audience to address the Commission with their input of concerns, questions, comments, etc. Mrs. Geri Gordon, S99 W20367 Parker Drive, read a prepared opposition statement to this proposal (available at the Planning Department). Mrs. Gordon feels that this business would have a detrimental effect on this area. Other concerns from Mrs. Gordon were: hours of operation; snow plowing equipment containing salt or other chemicals being stored on property; will this property be subdivided in the future; how does this land use compare with the proposed 2010 Comprehensive Plan; general maintenance of the trucks may turn this property into a dumping ground; damage done by chemicals soaking into the ground; damage done to the roads by the trucks, and this proposal does not fit into this rural country atmosphere. PLAN COMMISSION PUBLIC HEARING, AAA ASPHALT, Continued April 18, 2000 Mr. Bruce Peters, S104 W20914 Cindy Drive, opposes this proposal as it is not in keeping with the rural area. This business belongs in the Industrial Park, not in a country setting. Ms. Mary Ann Brunner, S106 W20182 North Shore Drive, opposes this proposal as the land is zoned for rural living not for business. If this is approved, what will prevent someone else from bringing in another business to this area. Mr. Harold DeBack, W198 S10955 Racine Avenue, feels it is important to keep our farm land and farm buildings preserved. If we have people running businesses from their homes on farm land then we can be assured that the property will be kept in good working order. Mr. De Back is in favor of this proposal as it will maintain open space and use the buildings on this property. Mr. Norm Pratt, S104 W20917 Cindy Drive, opposes for same reasons that have been stated previously. Mr. Pratt feels that a precedent will be set for other businesses to want to come into the area. Mrs. Renee Graziano, S105 W20952 Patricia Court, feels that if this business starts to grow then numerous buildings will be used for storage and the area will become unsightly. Mrs. Graziano opposes this proposal. Mr. Harold Gordon, S99 W20367 Parker Drive, opposes this proposal and would like to see business stay in the Industrial Park. Mr. Gordon opposes the asphalt and chemicals that are associated with this product. Ms. Sara Clough, W190 S9808 Parker Drive, stated that this will damage the value of the lands around proposed property. Ms. Clough stated that no one would want to build or buy in the area after seeing a business located in this area. Ms. Julie Loeding, W208 S10639 Karen Court, feels that coordinating plans needs to be put into place for attractive planning in these areas. Ms. Loeding opposes this proposal. Mr. Wayne Salentine, S79 W20465 Tyler Drive, owner of the property, feels that this proposal is the only way to maintain farmland and utilize buildings. Mr. Salentine would like to see restrictions placed on this Conditional Use. The lands will continue to be worked by the present tenant to keep this property as a farm. Mr. Salentine stated that Mr. Hrin’s truck would not do damage to the roads and that there are a number of businesses being run from homes in this same area. Mr. Jim Merk, W204 S10369 North Shore Lane, opposes proposal and is concerned with potential damage to the soil and seepage of chemicals into the wells. Mr. Harold Gordon, S99 W20367 Parker Drive, addressed the Commission for a second time, stating his concern with products that used for this type of business. Mr. Gordon purchased an asphalt driveway patch product and read the ingredients to the Commission. His concern is the amount and type of chemicals being used for this type of business. Mr. Greg Shuler, W204 S10346 Cindy Court, opposes this proposal due to the smell of the asphalt trucks. PAGE 2 PLAN COMMISSION PUBLIC HEARING, AAA ASPHALT, Continued April 18, 2000 Alderman Sanders feels that all of the above statements are worth considering. Alderman Sanders does not believe this use is compatible. He has heard complaints from a number of residents that feel this business should be kept in the Industrial Park. Mr. Jay Pakalski, from Seal Master, told the Commission that the products Mr. Hrin purchases are solid matter and will have no leakage effect. The material is 52% solid and cannot soak into the ground. That exposure to this product is less dangerous than using latex paint. Mr. John Giove, S98 W21442 Parker Drive, would like to see this property remain a farm. He feels that this proposal would damage the roads in the area and will have a negative approach to the quality of life for the residents. Mr. Mike Pastorek, W204 S10475 North Shore Drive, stated that if this proposal is allowed in this area but the business does not become successful, what will happen to the next person that will purchase this property. Mr. Pastorek is not in favor of this proposal. Mayor De Angelis stated this matter would be heard through a resolution under New Business later this evening.
