PC MIN 08-15-2000 PH QUIETWOOD CREEK EXTRACTION CITY OF MUSKEGO PLAN COMMISSION PUBLIC HEARING MINUTES Tuesday August 15, 2000 Muskego Public Library, Conference Room 5, S73 W16663 Janesville Road PUBLIC HEARING for a Conditional Use in accordance with Section 6.07 of the City of Muskego Zoning Ordinance for the purpose of screen processing and sale of excess topsoil from the Quietwood Creek Development, located in the SE ¼ of Section 3 and NE ¼ of Section 10 (Tax Key No. 2197.999 / Janesville Road). Present: Mayor De Angelis, Alderman Chiaverotti, Commissioners Hulbert, Gummer, Schaumberg, Smith, Brodel, Plan Director Turk, and Recording Secretary Asti. Secretary Asti reported that the meeting was properly noticed in accordance with the Open Meeting Law. Mayor De Angelis declared the Public Hearing open at 6:55 p.m. Plan Director Turk stated that petitioner proposing to sell surplus of 60,000 cubic yards of topsoil from the development site. Petitioner is requesting that the Conditional Use expire in December of 2001. Municipal Code states that Saturday operation may not begin before 8:00 am. Access point to Janesville Road will be the farmhouse driveway. Janesville Road will be cleared daily of any tracked material. Dust shall be controlled by periodic sprinkling of water on all disturbed areas which create airborne dust particles. Watering shall occur as needed to prevent migration of dust to surrounding properties. Mayor De Angelis asked the petitioner if he wished to speak on this matter. Mr. Ken Servi addressed Commission stating the stockpile has been recalculated and will consist of 22,000 cubic yards not the proposed 60,000 cubic yards. The existing farmhouse driveway consists of stone and concrete. Calcium and water have been applied to keep the dust to a minimum. Daily sprinkling will be done to keep the tacking pad and Janesville Road clear of tracked or residue material. Screening process will be done on site. Due to change in cubic yards the stockpile should be completely down before the end of this year. Mayor De Angelis asked for members in the audience to address the Commission with their input of concerns, questions, comments, etc. Ms. Betty Stephens, S73 W16079 Linda Court, stated that not everyone in the neighboring vicinity received notices of this public hearing. Ms. Stephens is irritated with the noise and dust from the trucks and objects to the screening process on site due to the additional noise and dirt that will be created. Director Turk informed Ms. Stephens that according to City Ordinance, notices were sent to neighbors within 200 feet of property. Mr. Dick Paccagnella, S73 W16056 Linda Court, addressed Commission that the 22,000 cubic yards would be a more tolerable amount than the original 66,000. Mr. Paccagnella stated that the new homes will need additional topsoil and requested that this excess be used for the new construction. The screening will create more noise and excessive dirt. Mr. Ken Servi explained that there are three stockpiles for this development and the 22,000 cubic yards are above and beyond what will be needed for the grading of the site, and the return of topsoil to each lot.
