PLAN COMMISSION PUBLIC HEARING
MINUTES OF PUBLIC HEARING HELD APRIL 20, 1999, 7:45 P.M.
Upon the petition of Payne & Dolan, Inc. for Renewal of Conditional Use in accordance
with Section 6.07(7) of the City of Muskego Zoning Ordinance for the purpose of
continued mining and processing sand and gravel, extension of the accessory use
(portable asphalt plant) located on the NW corner of Crowbar Road and Janesville
Road (CTH L).
Present were: Mayor De Angelis, Alderman Salentine, Commissioner’s Gummer,
Smith, Schaumberg, Hulbert, Acting Plan Director Wolff and Recording Secretary Asti.
Secretary reported that the Public Hearing was properly noticed in accordance with the
Open Meeting Law.
Mayor De Angelis declared the Hearing open at 7:54 P.M.
Acting Plan Director Wolff stated that petitioner will continue operation as in the past.
Staff has received minor complaints in regards to hours of evening trucking. In a recent
meeting between Staff and petitioner all issues were resolved.
Mayor De Angelis asked the petitioners if they wished to speak on this matter.
Petitioner, Mr. Rick Schmidt, Vice President of Payne & Dolan addressed Commission
stating that they have had meetings with three of the neighbors regarding the evening
trucking. Payne & Dolan has agreed to do the following: personally monitor the speed
of trucks, reducing the speed along Racine and Janesville, staying in contact with truck
drivers by walkie talkie; and requiring truck drivers not to use jake or engine brakes.
Payne & Dolan plan to continue to have someone monitor the trucks along this area
and will send out a mailing to residents with both daytime and nighttime telephone
numbers for residents to contact with their immediate concerns.
Mr. Schmidt stated that the next phase for this project will be done during the day with
night work being done in late June, early July and September. Payne & Dolan will do
night work required by contract.
Mayor De Angelis asked for members in the audience to address the Commission with
their input of concerns, questions, comments, etc.
Mr. Rick Petfalski of Highland Park Drive addressed Commission stating that the
neighbors appreciated the efforts made by Payne & Dolan. Mr. Petfalski feels that
Payne & Dolan are established in Muskego and would not be expected to change their
total operation but did ask the Commission to consider any future businesses not be
allowed to work in the evening hours.
Alderman Chiaverotti addressed the Commission stating that neighbors have contacted
her and are pleased with the efforts taken so far but would ask that future businesses
not be allowed evening hours.

Mayor De Angelis stated this matter would be heard through a resolution under New
Business later this evening. There being no further questions or comments, the Public
Hearing was adjourned at 8:05 P.M.
