PLAN COMMISSION PUBLIC HEARING
MINUTES OF PUBLIC HEARING HELD SEPTEMBER 07, 1999, 6:55 P.M.
Upon the petition of Burke Properties, Inc. for a Conditional Use in accordance with
Section 6.03 of the City of Muskego Zoning Ordinance for the purpose of operating a
gasoline service station at the property located in the NE ¼ of Section 25.
Present were: Mayor De Angelis, Alderman Salentine, Commissioners Smith,
Schaumberg, Hulbert, Plan Director Turk, and Recording Secretary Asti.
Absent: Commissioner Gummer
Secretary reported that the Public Hearing was properly noticed in accordance with the
Open Meeting Law.
Mayor De Angelis declared the Hearing open at 7:02 P.M.
Plan Director Turk stated that petitioner proposing to build a gasoline service station /
car wash and convenience store. Petitioner seeking a 24 hour operation however the
residents would like to have the operation closed from 11:00 pm to 5 am. The proposal
indicates a modified prairie style building however the standards established for
Durham Hill Design Guide by the Mayor’s Task Force on Economic Development calls
for agrarian or rural design of buildings in this area. The Plan Commission must
determine if this fits the theme of this area. The proposed layout does not conform to
the Guide. The Design Guidelines call for buildings to be located at the base setback
line with parking to side and rear. Location of mechanicals are not illustrated. No
detailed lighting information has been submitted. Staff recommends photometrics be
required for all fixtures to assure light tresspass does not affect nearby residential uses
and does not hinder highway visibility. Details regarding sign lighting have not been
provided.
Mayor De Angelis asked the petitioner if he wished to speak on this matter. Mr. Bill
Pucillo, Burke Properties, Inc., stated that he has no objection to adjusting the hours of
operation to meet the concerns of the residents. Mr. Steve Smith, Smith ODA
Architects, addressed the Commission describing the siting layout and design. Mr.
Smith stated that several layouts had been designed however, this is the one that was
most suitable for petitioner’s site and structure. Petitioner would prefer to use dryvit but
will change to masonry with horizontal cedar. Photometrics would be provided.
Discussion ensued wherein the Commission would like more information on the car
wash operation. Mr. Smith stated that this was not a “full blown” car wash and that that
the doors would need to be down during operation. Commission asked for verification
on this issue.
Mayor De Angelis asked for members in the audience to address the Commission with
their input of concerns, questions, comments, etc.
Mr. John O’Malley, O’Malley Investments, addressed the Commission stating that at the
September 21 Plan Commission meeting he will be presenting a similar operation
located at the opposite corner of the Burke operation. Mr. O’Malley would like to have
an opportunity to present his gas station / convenience store operation to the
Commission before a final decision is voted on for Burke Property. Mr. O’Malley stated
that he has called the State Highway Department and that Burke Properties have not

applied for access at this location. Access approval should have been determined prior
to a public hearing. Mr. O’Malley gave a lengthy presentation on the benefits of North
site location versus the South site. Examples of traffic hazards, bike path, rural
touches, and wetlands were discussed.
Mayor De Angelis stated this matter would be heard through a resolution under New
Business later this evening. There being no further questions or comments, the Public
Hearing was adjourned at 7:35 P.M.
