Plan Commission Minutes PC-11-17-PH1 PLAN COMMISSION PUBLIC HEARING MINUTES OF PUBLIC HEARING HELD NOVEMBER 17, 1998, 6:55 P.M. Conditional Use in accordance with Section 6.03 of the Muskego Zoning Ordinance for an th extractive permit at the property addressed as W124 S10629 124 Street. Upon the petition of Superior Emerald Park, for a Conditional Use for the purpose of an extractive permit. Present were Mayor De Angelis, Alderman Salentine, Engineer Zoppa, Commissioner’s Gummer, Smith, Hulbert and Planning Director Sadowski. Absent: Commissioner Schaumberg. Secretary reported that the Public Hearing was properly noticed in accordance with the Open Meetings Law. Mayor De Angelis declared the Hearing open at 7:00 P.M. Director Sadowski stated that petitioner’s requesting an extractive operation located south of their current landfill site. The operation would consist of removing 560,000 cubic yards of clay to create a pond which could also be used as the next cell for the proposed future expansion of the existing landfill. If the approval were not granted for the landfill expansion, the resulting pit would be maintained as a pond. Mayor De Angelis asked the petitioner if they wished to speak on this matter. The petitioner, Mr. Gene Kramer, expressed that he agreed with staff comments. Mayor De Angelis asked if anyone else in the audience had any comments. Mr. Tom Campbell, S103 W14797 Loomis Drive, stated that he feels this is premature to be making a decision considering that the State has not made any decision or given any approvals. Ms. Roseann Campbell, S103 W14823 Loomis Drive, stated she was not happy with this proposal and she, too, feels that this is a premature issue. Nothing has been decided and no approvals for expansion have been given. Ms. Campbell wanted clarification of statements made at previous Plan Commission meeting regarding approvals for this issue. Ms. Jackie Schweitzer, S110 W14230 Union Church Drive, stated she was not for nor against the clay extraction but had issues she would like to have acknowledged. 1) depth of the proposed pit – is this similar to present landfill? 2) would like to see the Saturday hours removed. Tremendous amount of traffic on Saturday with Al’s Auto Salvage and this extra traffic would add to congestion. 3) rain day operations, Ms. Schweitzer drives this road everyday and the amount of clay on normal days is heavy. Would like to see no operation on rain days. 4) disagrees with the number of trips calculated in handouts. Feels there will be more trips made than being reported. 5) no onsite storage of trucks. Warming up of vehicles should not be allowed before 7:00 A.M. Trucks should not be allowed to arrive at site before 7:00 A.M. 6) landscape plans should be submitted before any permits are issued. 11-17-98 PH Min-Emerald Park- Page 2 Attorney Patrick Hudec, attorney for Siting Committee, addressed Commission that he is working on negotiations to obtain local approvals. Attorney Hudec suggested that this item be processed through all appropriate procedures for review and final agreement. Mr. Skip Bartes, 12878 Loomis Road, asked why clay is being trucked off site. Requested to have research done as to why clay is taken off site. Mayor De Angelis stated that this matter would be heard through a resolution under New Business later this evening.
