Mayor Chiaverotti called the meeting to order at 6:00 PM.
Those present recited the Pledge of Allegiance.
PRESENT
Mayor Kathy Chiaverotti, Ald. Borgman, Commissioners Hulbert, Noah, Burke, Stinebaugh and
Jacques and Director Muenkel and Recording Secretary McMullen.
Recording Secretary McMullen noted that the meeting was properly noticed on March 30, 2012
in accordance with the Open Meeting Law.
APPROVAL OF THE MINUTES OF THE March 6, 2012 MEETING Ald. Borgman made a
motion to approve the minutes of the March 6, 2012 meeting. Commissioner Jacques seconded.
Upon a roll call vote, motion to approve the minutes was ADOPTED unanimously
PUBLIC HEARING for a Conditional Use in accordance with Section 14 of the City of Muskego
Zoning Ordinance for Morgan's Collision Repair Center for the purpose of an auto collision repair
facility along Loomis Road, in the NE'/4 of Section 34. Director Muenkel explained the petitioner
is proposing to build a 5,660 square foot building including two font offices, a reception counter,
lounge area, two bathrooms and the shop area. The building will also contain a paint booth, four
work stations, a frame rack, wash bay, estimating bay and a tool area. Hours of the business
will be Monday — Friday from 9:00 AM to 6:00 PM. A public hearing is required for the auto
repair/body work use on this site.
The proposed building will have a steel frame and is clad with CMU, brick, and steel panels. The
steel panels will be taupe sand color and the roof/trim will be slate gray. The CMU masonry units
will be red clay in color and the bricks will be a winter white blend with rough facing and the CMU
revel has a brick accent band. The front office area of the building contains 100% masonry with
aluminum windows and a standing seam steal roof. The other facades contain at least 50%
masonry as well. Parking, access, signage and lighting all meet the code requirements.
There is a 65' x 40' enclosed area to the south of the building that will have a gravel surface and
will be screened with an 8-foot tall board -on -board fence that will be used to house the
dumpsters, LP tanks, and all vehicles waiting to be repaired. The resolution states that no
unscreened outdoor storage of damaged vehicles awaiting repair or junked vehicles is allowed
on the site.
A landscape plan has been submitted as part of the proposal. Additional landscaping is
required, per the resolution, around the outdoor storage area and around the front parking area.
Street trees will need to be added along the road property lines also.
The resolution states an annual review will occur in March, after the first full year the business is
in operation. If no issues are found, no further review will be required.
Director Muenkel noted the property owner to the south, with the large pond, did stop in and was
concerned with water run-off and cars being parked along the street. Director Muenkel
explained he showed the property owner the grading plan and the water will not flow towards his
direction, but will flow to the north to the wetlands. Also, the site should contain employee cars
and cars waiting to be worked on. If it becomes a problem that these cars are being parked

along the street, staff can address this. Commissioner Hulbert agreed there is a problem in this
area with Frey parking cars along the street.
Ald. Borgman stated the building looks nice. Mayor Chiaverotti opened the public hearing to any
questions or comments. With no further comments or questions, Mayor Chiaverotti closed the
public hearing at 6:07 PM.

NEW BUSINESS FOR CONSIDERATION
RESOLUTION #P.C. 023-2012 — Approval of a Conditional Use Grant and Building, Site and
Operation Plan for Morgan's Collision Center located in the NE '/4 of Section 34 (Tax Key No.
2293.996.001 / Loomis Dr.). Commissioner Jacques made a motion to ADOPT Resolution
#P.C. 023-2012. Commissioner Stinebaugh seconded. Nathan Laurent, from Keller Inc., was
present and went over the colors and sample materials of the proposed building. Upon a roll call
votes, Resolution #P.C. 023-2012 was ADOPTED unanimously.
RESOLUTION #P.C. 024-2012 — Approval for the outdoor sale of plants and flowers for Holtz
Garden Centers at the Elliott's Ace Hardware property located in the NE'/4 of Section 3 (Tax Key
No. 2169.999.007 / S64 W15732 Commerce Center). Commissioner Jacques made a motion to
ADOPT Resolution #P.C. 024-2012. Commissioner Hulbert seconded. Director Muenkel
explained the petitioner is proposing a temporary greenhouse structure for the sale of plants and
flowers for 2012. This temporary garden center is proposed within Elliot's ACE Hardware
parking lot by Holtz Garden Centers. The merchandise will be sold in two greenhouses (25'x60'
and 21'x36') and surrounding tables. The garden center will take up approximately 15 parking
spaces and a fence will enclose the display area. The fence will be made of landscape timbers
and concrete blocks. Operations are proposed from April 15th to July 15th from 8:00 AM to 8:00
PM weekdays and Saturdays and 9:00 AM to 5:00 PM on Sundays. The proposal is consistent
with other venders in Muskego. Staff is recommending approval. Commissioner Jacques
questioned what they did last summer. A representative of ACE Hardware was present and
explained this year the outdoor area will be filled with yard goods and fountains. They would like
the greenhouse to be in the parking lot like it was at the old location. Upon a roll call vote,
Resolution #P.C.024-2012 was ADOPTED unanimously.
RESOLUTION #P.C. 026-2012 — Approval of a BSO amendment to Elliott's Ace Hardware
property located in the NE '/4 of Section 3 (Tax Key No. 2169.999.007 / S64 W 15732 Commerce
Center). Commissioner Hulbert made a motion to ADOPT Resolution #P.C. 026-2012.
Commissioner Jacques seconded. Director Muenkel explained ACE Hardware is also
requesting a change to their original site approval involving outdoor sales. The petitioner is
requesting to remove the planting racks that were originally approved and replace them with
pallets of material. They are proposing 3-4 pallets west of the garden center entrance, 10-12
pallets between the garden center entrance and main entrance, and 4-6 pallets east of the main

entrance. The merchandise would be up until November. They have submitted guidelines if the
approval is granted, which include: pallets would be kept at one pallet high and only one pallet
deep, pallets would be kept free of all shrink wrap and kept neatly stacked, broken bags will be
removed and repaired immediately, and pallets would not exceed seven feet in height. Staff is
recommending approval for one year, similar to the Wal-Mart approvals that were given last year
for one year. In the future ACE Hardware should work out a way to use the previously approved
planters and planting racks to display their materials. Commissioner Stinebaugh noted with the
amount of pallets they are requesting to display it seems they do not have enough room.
Commissioner Hulbert stated allowing the outside storage until November is too long and should
be shortened to the timeframe of the flower and plant sales. The manager of ACE was present
and explained they are requesting the outdoor storage to make people aware they offer this
product. Commissioner Hulbert made a motion to AMEND Resolution #P.C. 026-2012 that
pallet height cannot exceed 5 feet. Commissioner Jacques seconded. Upon a roll call vote,
Resolution #P.C. 026-2012 was AMENDED unanimously. Upon a roll call vote, AMENDED
Resolution #P.C. 026-2012 was ADOPTED unanimously.
RESOLUTION #P.C. 025-2012 — Recommendation to Common Council for Approval of
updates to Chapter 41 Section 41.06 Adopting the 2012-2016 Parks and Conservation Plan.
Commissioner Hulbert made a motion to ADOPT Resolution #P.C. 025-2012. Commissioner
Jacques seconded. Director Muenkel explained Parks and Conservation staff has been working
on updates to the Parks and Conservation Plan. Some of the main changes include:
• New inventories of park lands, conservation lands, and trails.
• Overall needs assessment of both parks and conservation land/park facility needs
• Park Recommendations
• Conservation Recommendations
• Rec Trail Recommendations
Staff is recommending approval. Council will make any final changes and will have final
approval. Council will make any necessary amendments based on the direction the Lake Park
goes. Commissioner Hulbert explained there was a change in the plan by moving the Woods
Road trail up due to the Janesville Road project. Upon a roll call vote, Resolution #P.C. 025-
2012 was ADOPTED unanimously.

The CSM is being created by the City of Muskego as part of the Boxhorn Boat Launch acquisition
between the City of Muskego and 13960 Boxhorn Drive, LLC. City acquisition is being warranted so this
vital boat access launch can be preserved well into the future. The existing launch is simply maintained
via leasing by the city and the lease was to run out in less than 10 years.
PLAN CONSISTENCY PC 028-2012
Comprehensive Plan: The 2020 Plan depicts the area for rural density residential and
conservation preservation. The proposal is consistent with the Plan.
Zoning:
The property is zoned BL-1 (Lakeshore Business) and SW (Shoreland
Wetland). The proposal is consistent with the Plan.
Parks and Conservation Plan: The 2007-2011 Plan depicts Conservation areas on this site. The
proposal is consistent with the Plan.
Street System Plan: All right-of-ways have been or will be dedicated as required.
Adopted 208 Sanitary Sewer The lots are served by municipal sewer. The proposal is consistent with
Service Area: Ithe Plan.
ater Capacity Assessment The lots are served by private well. The proposal is consistent with the

DISCUSSION PC 028-2012
As mentioned, the CSM was created by the City of Muskego as part of the Boxhorn Boat Launch
acquisition between the City of Muskego and 13960 Boxhorn Drive, LLC. The CSM is setup to divide off
Lot 1 from the larger Boxhorn Gun Club and Lot 1 is to be acquired by the City of Muskego for ownership
of the existing Boxhorn Boat Launch.
The CSM meets the bulk requirements of the code and approval is recommended subject to any
Engineering technical corrections being addressed first.

discrepancies as identified by the City Planning Department and City Engineers, and payment of all

BE IT FURTHER RESOLVED, That the configuration of the CSM, allowing a landlocked parcel, is
allowed due to the existing easements and commercial land uses of the area.
BE IT FURTHER RESOLVED, That all technical corrections from the City will need to be addressed
before the Certified Survey Map can be signed and recorded.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in

Retail Stand
The plan that I am proposing is a retail greenhouse selling stand that would be
located in the west corner of the Salentine parking lot on Janesville and Tess Corners.
I will be selling an array of annual flowers. Most of them will be in four, six, ten,
and 12 inch pots. I will also sell hanging flower bags and a small number of perennials.
The greenhouse itself will be 21' wide, 11' high, and 25' long. Outside of the
greenhouse will be a 21' wide, 32' long "Garden Area". This area will be fenced in withh
an all wood handmade picket fence (I have provided pictures), and the entrance to the
garden area will have a wood arbor which is also handmade. Inside will be all wood
tables and beautiful flowers.
The stand would be open May 9sh through July 30h at the latest. The fours
would be 9 a.m. to 7 p.m. seven days a week.
With the exception of some holidays such as Mother's Day, 4th of July, and
Memorial Day there will only be one person working the stand at a time. I will be the
primary person there. If 1 am not, a member of my family would be in my place. No plug
in electrical devices will be used.
I look forward to working with a respected business like Salentine, and I am also
excited to sell flowers in Muskego, that were grown in Muskego.

gallon. The proposed site meets the guidebook requirements.

On April 2, 2012 a submittal was received from Steven Meyer for AAA Tess Corners Storage to convert
the existing 80' x 168' building into indoor and outdoor storage on the property located at W145 S6550
Tess Corners Drive (Tax Key No. 2165.998.012). The City of Muskego had previously approved outdoor
storage in the rear of the property years back and that has been fully built. The front warehouse structure
was once home to Stella and Chewy's and the owner sees a future for more indoor/outdoor storage units
in the warehouse. The front office will remain for future lease.
A conditional use grant amendment hearing is scheduled tonight before PC as the amendment is required
per the M-2 zoning to allow more storage units on the property.
CONSISTENCY WITH ADOPTED PLANS 027-2012
Comprehensive Plan: The 2020 Plan depicts the property for commercial uses. The petition is
consistent with the Plan.
Zoning: The property is zoned M-2, General Industrial. The use is permitted subject
to CUG and BSO approval.
STAFF DISCUSSION PC 027-2012
As mentioned above, the proposal is to convert the front warehouse structure to more indoor/outdoor
storage units. Currently on the site exists, from west to east, a front office structure attached to the
warehouse structure, along with mini storage structures to the rear of the property with 68 units within
them.
The City of Muskego had previously approved outdoor storage units in the rear of the property years back
(PC Resolution #069-2006) and those are fully built. The current warehouse structure (80'x168') is
currently a metal pole barn with a metal roof and a fagade clad with greyish white metal siding and a 6
course cinder block band (painted blue) along the bottom. A few overhead and entry doors adorn the
sides of the warehouse structure. Overall, the fagade is in deteriorating shape (see pictures herein the
supplement).
The proposed changes for the site only include those to the south fagade of the warehouse structure at
this time and those changes consist of the following:
• Installing new gutter and downspouts (blue to match newer existing storage buildings).
• Installing new metal siding (material and color to match existing newer storage buildings).
• Install new vinyl brick that was recently installed on the front office facades and this brick along
with the office brick is to be painted the blue color that adorns the rest of the base colors on the
newer existing storage structures.
• Install new overhead doors throughout the fagade for more outdoor accessed storage units
(Approx. 16 units).
• Install a new access door that will lead to some new indoor storage units (Approx. 12 units).
Overall, the updates will enhance the look of the building as seen from Tess Corners Drive. The
resolution is written for approval and that the annual review and all other past Planning Commission
approvals still apply for the site.
A public hearing is required at the May 1, 2012 Plan Commission meeting as a conditional use grant
amendment requires a hearing per the M-2 zoning to allow more storage units on the property.

The petitioner is proposing to construct a 720 square foot metal accessory structure on site. Plans are attached for
your review.
Plan Commission may waive the architectural requirements for accessory structures when any of the following are
met:
1. The structure is screened from view,
2. The principal structure is composed of materials, colors, or styles that are inappropriate in their applications
to an accessory structure,
3. The Plan Commission finds other circumstances to be present which would result in no undue harm to the
property or its surroundings,
4. When the area is not found to be predominately residential.
Plan Commission may approve the materials as submitted, or require modifications prior to release of building
permits.
PLAN CONSISTENCY PC 031-2012
Comprehensive Plan: The 2020 Plan depicts the area for Medium Density Residential uses. The
proposal for a residential outbuilding is consistent with the Plan.
The property is zoned RS-2, Suburban Residence District. Accessory
structures totaling 2,428 square feet are permitted on the subject property. The
proposal is to add a new 720 square foot accessory structure. There are
Zoning: several other existing accessory structures on the lot that are going to be
removed after the construction of the new building. There is a detached garage
that is going to remain totaling 1,068 SF. The proposal meets the bulk
requirements of the Zoning Code except the architectural requirements of
accessory structures.
STAFF DISCUSSION PC 031-2012
The architectural requirements state that the accessory structure should have similar materials and colors as the
principal residence. Planning Commission approval is being sought due to this concern.
The petitioner is proposing a steel sided, steel -roofed structure with 3- foot overhangs. The walls are proposed to
be beige color and the roof, wainscoting, and trim will be reddish color, which are all similar to the colors of the
home and garage. The location of this building about 350 feet from the street. The proposed building is shown
having decorative elements such as wainscoting, windows with decorative mullions/lattices (on two sides of the
building), pedestrian door, and overhangs similar to the house.
The petitioner has stated that the proposed building will be used for personal storage and gardening equipment.
The Resolution also states the following items:
BE IT FURTHER RESOLVED, That the building cannot be used for the operations of a business.
BE IT FURTHER RESOLVED, That the floor of the accessory structure must be asphalt, sealed concrete block, or
concrete slab per the Zoning Code and it must meet all applicable building codes.
BE IT FURTHER RESOLVED, That the colors of the new accessory structure must be similar to the colors of the
house/garage.
STAFF RECOMMENDATION PC 031-2012
Approval of Resolution #PC 031-2012, finding that there will be no undue harm to the surrounding
properties, the building is located about 350' from the nearest street, and the location of the overall

WHEREAS, A site plan and building drawings were submitted by Jeff & Melanie Sinner to
construct a 720 square foot metal accessory structure on their property located at W194 S6961
Hillendale Drive (Tax Key No. 2180.986), and
WHEREAS, The property is zoned RS-2, Suburban Residence District and said structure is a
permitted accessory use and subject to Plan Commission review due to the proposed
architectural materials shown, and
WHEREAS, There is an existing house on the property with five other accessory structures, and
WHEREAS, A few of the existing accessory structures are being removed to make way for this
one new larger building. and
WHEREAS, The owner stated that the accessory structure will be used for personal storage and
gardening equipment, and
WHEREAS, The total allowed square footage for accessory structures on this property is limited
to 2,428 square feet, and said proposal meets the bulk requirements of the Zoning Code, and
WHEREAS, The structure is proposed to be constructed with steel walls and a steel roof and said
proposal does not meet the Plan Commission's standards for administrative approval of
residential accessory structures as the siding and roofing does not match the materials used on
the primary residence, and
WHEREAS, The walls will be a beige color and the wainscoting, roof, and trim will be a reddish
color, which are all similar to the colors of the home/garage, and
WHEREAS, The accessory structure will have 3-foot overhangs, and
WHEREAS, The building is shown having decorative elements such as wainscoting, windows
with decorative mullions/lattices (on two sides of the building), pedestrian door, and overhangs
similar to the house, and
WHEREAS, The structure is located about 350' from the nearest street and the location of the
overall property is fairly secluded from the neighboring properties.
THEREFORE BE IT RESOLVED, That the Plan Commission approves a 720 square foot metal
accessory structure submitted by Jeffrey & Melanie Sinner for their property located at W194
S6961 Hillendale Drive (Tax Key No. 2180.986).
BE IT FURTHER RESOLVED, That the building cannot be used for the operations of a business.
