PAGE 2 CITY OF MUSKEGO PLAN COMMISSION MINUTES 4:30 PM Tuesday June 7, 2011 Muskeqo City Hall, W182 S8200 Racine Avenue Mayor Chiaverotti called the meeting to order at 4:30 PM. Those present recited the Pledge of Allegiance. PRESENT Mayor Kathy Chiaverotti, Commissioners Hulbert, Stinebaugh, Jacques and Director Muenkel and Recording Secretary McMullen. ABSENT Ald. Borgman, Commissioners Noah and Burke Recording Secretary McMullen noted that the meeting was properly noticed on June 3, 2011 in accordance with the Open Meeting Law. APPROVAL OF THE MINUTES OF THE MAY 3, 2011 MEETING Commissioner Hulbert made a motion to approve the minutes of the May 3, 2011 meeting. Commissioner Jacques seconded. Upon a voice vote, motion to approve the minutes was ADOPTED unanimously. OLD BUSINESS FOR CONSIDERATION RESOLUTION #P.C. 022-2011 — Approval of an Annual Review for Frey Auto located in the NE '/4 & SE '/4 of Section 34 (S107 W16311 Loomis Road / Tax Key Nos. 2296.996 & 2293.996.002). Director Muenkel explained another inspection was completed and the site is in full compliance. Citations have been processed and there will be a couple of days' worth of fines the business owner will have to pay. Director Muenkel noted that Mr. Frey is working on plans for a new building. Commissioner Hulbert expressed concern that cars are parking on the street. Director Muenkel explained there are only about 8 parking stalls for customer parking, but Mr. Frey has a location outside the city where he stores overflow cars. Commissioner Hulbert questioned why citations are going to the tenant instead of the property owner. Director Muenkel explained in the past citations could go to either the property owner or the tenant. Commissioner Hulbert requested that in the future citations be issued to the property owner for this property. Upon a roll call vote, Resolution #P.C. 022-2011 was adopted unanimously. OLD BUSINESS SCHEDULED FOR DEFERRAL None. CONSENT BUSINESS Commissioner Hulbert made a motion to ADOPT Resolutions #P.C. 031-2011, and 032-2011 engross. Commissioner Jacques seconded. Upon a roll call vote, the motion passed unanimously RESOLUTION #P.C. 031-2011 — Approval of a three lot Certified Survey Map for the Anderson property located in the NE '/4 of Section 12 (Tax Key No. 2205.991 / S71 W 13031 Tess Corners Drive). Resolution #P.C. 031-2011 was ADOPTED unanimously. RESOLUTION #P.C. 032-2011 - Approval of a One Lot Extraterritorial Certified Survey Map for the Pakulski property located in the NW '/4 of Section 36 in the Town of Vernon. Schaefer INTRODUCED: September 6, 2011 LAST AGENDA: N/A PREPARED BY: Adam Trzebiatowski AICP BACKGROUND PC 034-2011 The Plan Commission originally authorized an annual review for the property for every year in the month of August until further notice. Due to no August meeting, the review was pushed to September. The petitioner received Plan Commission approval as per PC Resolutions #155-1990 and 012-2004. The provisions of those approvals are discussed below. PLAN CONSISTENCY PC 034-2011 Comprehensive Plan: The 2010 Plan depicts the area for agriculture and open lands use. The use as a business existed and is consistent with the Plan. Zoning: The property is zoned A-1 Agricultural District. The proposal is consistent with the Municipal Code and past petitions. DISCUSSION PC 065-2010 The property has had prior approvals for the snowplowing and grading business since 1990. The property currently has an existing 252' x 60' metal farm pole building of which 40' is used for shop area and the rest used for the agricultural practice of the property. The property also houses an approved 32' x 40' salt storage structure. The previous approved resolutions both state that no outside storage of any equipment or LP fuel tanks be located next to the building, and that the business be limited to 17 drivers. Plan Commission requested the annual review during the approvals of February 2004 to make sure the site does not become unsightly and that the outside storage is outside of the public view and mostly contained in the approved storage buildings. If PC recalls, staff met with Mr. Schaefer in early 2009 to discuss the ongoing cleanup of the site and it was agreed that Mr. Schaefer would begin to remove any storage of vehicles that exist on the east side of the main accessory structure to the southern and western sides of the structure to further reduce outside storage, unless the vehicles are being actively used on that day for business purposes. Upon a site inspection on August 26, 2011, Planning Division staff found the site to be in good shape. Last year Mr. Schaefer has worked on a berm for the east side and most of the equipment is now on the south and west sides of the main structure. Barely anything is visible from Racine Ave or Parker Drive. Continued monitoring of the site will continue throughout the year. Staff is recommending that the annual review be moved to March, with all of the other annual reviews. A better view of the site will be achievable since the crops will be harvested at that point. STAFF DISCUSSION PC 037-2011 As mentioned above, Veolia Environmental Services is proposing to construct a 5,894 sq. ft. building to house the equipment required to process and pump the methane gas generated by the landfill to the Jones Island sanitary treatment facility in Milwaukee. This is part of the Milwaukee Metropolitan Sewage District Plans to re -use this gas. Site As shown in the site plans and the orthophoto in the supplement, the proposed building will be internal to the property and will not be visible from any surrounding roadway. The landfill site is protected by various landscape berms and existing structures along 124th Street already. The proposed structure will be approximately 1,000 feet into the site from the roadway. There are no additional impervious surfaces being added around the proposed structure. Building The 5,894 SF structure proposed will consist of a 32' wide x 32' tall x 139' long metal sided building to house equipment and a 48' wide x 14' tall x 32' long masonry building for electrical controls, offices, and meeting room. STAFF DISCUSSION PC 036-2011 The submittal is included in the supplement consisting of a narrative, site/grading plans, building elevations, colored renderings, photometric plan, and lighting details. As stated above, the petitioner requests approvals for a new auto sales and service business on a piece of land along Loomis Road in the southern portion of Muskego. The proposed building will be 7,084 square feet, including a 2,340 square foot office and storage mezzanine. The building will contain a showroom, offices, a parts area, a large repair bay area, and an auto detailing area. Hours of the business are going to be 8:00 AM to 6:30 PM M-F, 8:00 AM to 4:00 PM on Saturdays, and closed on Sundays. If business grows they would like to extend their hours to 9:00 PM M-S. Currently there are 9 employees that will be moving to this new location. Architecture The proposed building is shown to be constructed mainly with a single score split face CMU, with areas of accent stripes with a triple score smooth face CMU. The majority of the block will be a standard natural gray color with the accent stripes being black ash and crimson. The building will have a flat rubber roof with a parapet wall. The front of the building (north side) is mostly all glass with an aluminum store front with clear anodized aluminum framing. The glass will be tinted for exterior looks and to prevent UV rays from entering the show -room area. The overhead doors will contain two rows of full -light window panels. The overhead doors and maintenance doors must be colored to match the building. This area of the City is governed by the General Design Guide. The guide calls for 50% masonry product unless the Planning Commission finds reasons not to apply the full extent of the guide. All non -glass and non -door areas of all facades of the proposed building are masonry, with the small exception of some metal coping and metal building accents. The building basically contains 100% masonry. Based upon the design and material usage on this building, staff feels this will be a great addition to this area of the City. Site, Parking, and Access There are a few separate parking areas on the site for designated purposes. Here is a breakdown of the various parking areas and their sizes: • Sales Stalls — 100 (9'xl8') • Parts Drop Off/Delivery Stalls — 3 (10'x20') • Customer Stalls — 12 (10'x20') • Employee Stalls — 11 (10'x20') • Repair Stalls — 14 (10'x20') • Loaner Car Stalls — 10 (9'x20') • Flatbed Tow Truck Stall — 1 (10'x30') NOTE: The narrative lists some slightly different numbers of stalls, but the numbers of stalls/vehicles listed above is the correct amount. The sale vehicle areas may not have fully marked stalls, but instead they may have either a rear line or a front and back mark. As long as the number of cars in each area do not exceed the approved numbers this should not be a problem. This will allow more flexibility within the layout of the vehicles. Also, some of the stalls listed above are under the typical 10'x20' size, but staff does not have a problem with this since these are not stalls typically used by the public. There is an elevated car display pad shown on the northeast corner of the site. Staff does not seem any issues with this as long as it is only for one vehicle and as long as it is located outside of the vision corner. Access to the site is located off Muskego Dam Drive via a 30 foot wide driveway. Throughout the site all two-way traffic areas are at least 25 feet wide and one-way traffic areas are at least 18 feet wide. All one- way traffic areas must be properly marked with signage and pavement markings. The narrative states that curbing will only be installed around the landscape beds. Upon detailed review of the overall project, staff feels that in keeping with the aesthetics of newly developed commercial properties in the City, the entire perimeter of the site and all internal landscape islands should be curbed. The only exception is the western portion of the lot where there is future expansions proposed. Fire Department Approval The site plan is still subject to Fire Department approvals at the time of building permits as well. Possible changes to the site plan may be required based upon the final Fire Department review. Dumpsters/Refuse Containers/Outdoor Storage A dumpster enclosure is proposed along the south side of the parking lot, as required by code. Details of the enclosure will need to be provided before building permits can be issued. There also is a 90'x55' enclosed area on the southern portion of the site that will have a gravel surface and be screened with an 8 foot tall board -on -board fence. This area will be used to house all vehicles waiting to be repaired and any other miscellaneous vehicle items. Any vehicles that are junk or in pieces must be stored within this area or in the building. The resolution states that no outdoor storage of junked vehicles of any type are allowed on the site, other than in the enclosed storage area. All other storage, parts, equipment, etc. must be kept within the building or within the screened storage enclosure. Landscaping A landscape plan has been submitted as part of the proposal. Review of the landscape plan is pending and the City Forester will work with the petitioner based upon any changes/additions that are needed. There is the possibility that street trees will be required along each of the lot lines adjacent to the roads. A final landscape plan will need to be submitted and approved by the City prior to the issuance of building permits. Signage A location for a sign is shown along Loomis Road, but no details have been provided at this time. A separate sign permit will be required before any signage can be installed. This includes any signage on the building. Lighting Site lighting is proposed to be comprised of pole mounted fixtures and wall mounted fixtures. All lighting proposed is metal halite, which is preferred by car dealership. All fixtures must be full cut-off with a zero degree tilt. The proposed pole height is 20 feet with a six (6) inch max height concrete base. The photometric plan shows that no lighting levels will exceed 0.5 foot-candles at the lot lines. Sewer, Water, Storm, Grading The development will be served by two private onsite holding tanks and a new private water well. Municipal water and sewer are not near this property. A stormwater pond is proposed on the western portion of the site. Formal approvals from the Engineering Division of grading and stormwater plans will be required before the issuance of building permits. Phase 2 Phase 2 of this project includes additional parking/paving off of the western side of the proposed parking area. Approvals of this area are included in the resolution, but more detailed site/parking plans will need to be submitted for staff review and approval. Additional landscape islands may be required. Other The site plans show that there may be wetlands just off the western portion of this site. With possible wetlands being so close, a wetland delineation will need to be done for the western portion of this site before building permits can be issued. This may change the location of the stormwater pond. As with Frey Auto's previous approvals, no vehicles can be used as signage (i.e. box van, etc.) and signage and banners cannot be displayed on the outside of the vehicle/windshield. The following items are only allowed on the inside of the vehicle/windows: price, year, and any vehicle disclosure information that is required by State Law. Also, no advertisements, signage, banners, etc. are allowed, except for proper temporary or permanent signage. Any temporary or permanent signage will require a separate sign permit through the City. The following is also part of the Plan Commission resolution: BE IT FURTHER RESOLVED, That all bollards must be painted to match the colors of the principal structure. Frey Automotive currently operates out of a facility across the street from the proposed site for the use of Used Car Sales and Automotive Service. Frey Automotive has been in operation for over 15 years in the city of Muskego. They provide a good valuable service to the people of Muskego and are looking forward to continuing to service their customers better with this new facility. They have outgrown their existing location and in planning for the future purchased the 3 acre lot across Muskego Dam Drive a number of years ago. The future is now present and it is time for their new facility and further expansion of their operation. After construction is complete Frey Automotive will no longer occupy its current location. Frey Automotive is working with Keller, Inc. on the development and execution of this project. The current Zoning of this property is B-4 and the proposed use is an acceptable use by City Standards. Currently the land is used for some storage of sales vehicles by Frey Automotive. There are two entrances and a paved area designated for these vehicles. The remainder of the lot is a grass field with a fairly flat grade. Frey Automotive will be using the new facility for the same use as its previous location. The three (3) acre site that Frey Automotive is proposing will be developed in two phases. The first phase being the main portion of the work and the second is an extension of the parking lot to the West. The building is positioned on the lot with the offices / showroom facing Loomis Road with its full glass curtain wall. In the first phase there is area designated for ninety-nine (99) sales cars. All areas with parking for sales cars will not have striping in between each car but at the front and back where necessary. These stalls will have a 9' x 18' dimension. There will be twelve (12) stalls designated for the parking of the loaner cars. Nine (9) employee parking spots are also located on the south end of the building. There are three (3) parking stalls on the west side of the building that will be designated for parts, uniforms, and other deliveries only. There is one (1) dedicated 10'x 30' stall to park the flat-bed tow truck. Fourteen (14) Parking stalls for the vehicles waiting for repairs are located to the West of the building. Thirteen (13) parking stalls for general customer parking are located to the North and East side of the building. The stall and parking layout submitted with this Conditional Use application is NOT final. The final Parking lot layout will be submitted with the full BSO submittal. This however is a very close representation of the lot layout. With only one entrance to the property the driveway has a width of 30' for two way traffic. The majority of the lot utilizes 25' two-way traffic aisles except for the One-way drive lane between the rows of sales cars. This One-way drive lane will be marked with a sign at the entrance and exit to one-way traffic. Also there will be Parking lot stripping arrows directing the flow of the traffic.
