PAGE 2 CITY OF MUSKEGO PLAN COMMISSION MINUTES 6:00 PM Tuesday September 6, 2011 Muskego City Hall, W182 S8200 Racine Avenue Mayor Chiaverotti called the meeting to order at 6:00 PM. Those present recited the Pledge of Allegiance. PRESENT Mayor Kathy Chiaverotti, Ald. Borgman, Commissioners Noah, Burk Stinebaugh, and Director Muenkel and Recording Secretary McMullen. ABSENT Commissioners Hulbert and Jacques Recording Secretary McMullen noted that the meeting was properly noticed on September 1, 2011 in accordance with the Open Meeting Law. APPROVAL OF THE MINUTES OF THE JUNE 7, 2011 MEETING Commissioner Burke made a motion to approve the minutes of the June 7, 2011 meeting. Commissioner Noah seconded. Upon a voice vote, motion to approve the minutes was ADOPTED unanimously. PUBLIC HEARING for a Conditional Use in accordance with Section 14 of the City of Muskego Zoning Ordinance for Frey Auto for the purpose of an auto sales and service/repair facility along Loomis Road, in the NE '/4 of Section 34. Director Muenkel explained Frey Auto is currently operating their auto service and used car business off of Loomis Road. Mr. Frey bought land across the street to build on and has submitted plans for approval. Any auto repair facility requires a Conditional Use Grant and the Business Site and Operation Plan is also on the agenda for approval. The proposed building will be 7,084 square feet, including a 2,340 square foot office and storage mezzanine. The building will contain a showroom, offices, parts area, large repair bay area and auto detailing area. The business hours will be from 8:00 AM to 6:30 PM Monday — Friday and 8:00 AM to 4:00 PM Saturdays and closed on Sundays. Nine employees will be moving to this new location. The building will be angled towards Highway 36 and is shown to be constructed with different colors of split face CMU. The majority of the block will be a standard gray color with the accent stripes being black ash and crimson. The building will have a flat rubber roof with a parapet wall. The front of the building will be mostly glass with an aluminum store front with clear anodized aluminum framing. The glass will be tinted for exterior looks. The overhead doors will contain two rows of full -light window panels and will be colored to match the building. The City's Design Guide requires 50% masonry product and this building will be 100% masonry product. Access to the site will be off of Muskego Dam Road. There are separate parking stalls on the site for designated purposes including: sales, parts drop off, customer and employee parking, repair stalls, loaner cars, and one for the flatbed tow truck. A 90' x 55' enclosed gravel area is proposed for outdoor storage and will be screened by an 8-foot tall board on board fence. A landscape plan is being reviewed and additional landscaping may be required. Lighting is proposed and meets the city's requirements not exceeding 0.5 foot candles at the lot line. The proposed pole height will be 20 feet with a six inch max height concrete base. Phase two of this project includes additional parking and paving of the western side. Future staff approvals would be needed. Plan Commission Minutes, continued September 6, 2011 All advertisements must be internal on the cars. Temporary signage would be allowed with a permit. Mayor Chiaverotti opened the public hearing for questions or comments. Kevin Patel, owner of the current building that Frey Auto operates from, questioned what would be allowed in his building once Frey Auto moves. Director Muenkel explained the Conditional Use Grant would stay with the property and would allow sales and service of vehicles, but a new business would have to come to Plan Commission for site and business operation approval. With no further questions or comments, Mayor Chiaverotti closed the public hearing at 6:13 PM. OLD BUSINESS FOR CONSIDERATION None. OLD BUSINESS SCHEDULED FOR DEFERRAL None. CONSENT BUSINESS Commissioner Noah requested Resolution #P.C. 037-2011 be removed from the consent agenda for discussion. Ald. Borgman made a motion to ADOPT Resolutions #P.C. 034-2011, and 035-2011 engross. Commissioner Burke seconded. Upon a voice vote, the motion passed unanimously. RESOLUTION #P.C. 034-2011 — Approval of an annual review for Schaefer Snowplowing and Grading LLC located in the NW '/4 of Section 29 (W195 S9775 Racine Avenue / Tax Key No. 2274.998). Resolution #P.C. 034-2011 was ADOPTED unanimously. RESOLUTION #P.C. 035-2011 — Approval of a Two Lot Extraterritorial Certified Survey Map for the Malchine property located in the SW 1/4 of Section 17 in the Town of Norway. Resolution #P.C. 035-2011 was ADOPTED unanimously. NEW BUSINESS FOR CONSIDERATION RESOLUTION #P.C. 036-2011 — Approval of a Building, Site, and Operation Plan for Frey Auto located in the NE '/4 of Section 34 (Tax Key No. 2293.996.002 / Loomis Road). Commissioner Stinebaugh made a motion to ADOPT Resolution #P.C.036-2011. Commissioner Burke seconded. Director Muenkel discussed in detail during the public hearing portion. Commission Noah questioned what the gravel storage area would be used for and what the second phase of the project will consist of. Mr. Frey was present and explained he will be using it as a holding area for cars that need to be worked on. Commissioner Noah requested that the fence be stained or painted to match the building and noted that more landscaping along fence should be added. Nathan Laurent, architect for the project, was present and stated that phase two would only add more capacity and landscape islands. There would not be any new buildings added and the basic layout would not be changing. Mr. Laurent stated that all the landscape islands will be curbed but questioned if Plan Commission would allow the perimeter of the site to not be curbed. Mr. Laurent noted that it is not functional for snow removal and storm water will naturally run off the site to the storm water ponds without the curbing. Director Muenkel explained curbs are used for directing storm water and also for aesthetics in the more urban areas. The neighboring properties currently do not have curbing. Commissioner Noah agreed it isn't a necessity for the curbing and does not feel it will be a problem if the perimeter did not have it. Due to the setting and the location the Commissioners agreed curbing would not be required around the perimeter, but all landscape islands will be curbed. Commissioner Noah PAGE 2 Plan Commission Minutes, continued September 6, 2011 made a motion to AMEND Resolution #P.C. 036-2011 to add: BE IT FURTHER RESOLVED, Additional landscaping will be installed around the outdoor storage area along Muskego Dam Road; and BE IT FURTHER RESOLVED, The fence around the outdoor storage area will be painted to match the color of the structure; and remove wording relating to the curbing of the perimeter of the site. Commissioner Burke seconded. Upon a voice vote, Resolution #P.C. 036-2011 was AMENDED unanimously. Upon a roll call vote, AMENDED Resolution #P.C. 036-2011 was ADOPTED unanimously. Discussion took place relating to the requirements of street trees. Mr. Laurent explained street trees will block the views of the used cars and the new building. Commissioner Burke suggested placing the trees on either end and keeping the front visible. Mr. Laurent will work with staff for placement of the street trees. The Commissioners agreed the new building will be a nice addition to the area. RESOLUTION #P.C. 037-2011 - Approval of a Building, Site, and Operation Plan for Veolia located in the NE '/4 of Section 2 (Tax Key No 2301.998 / 10629 South 124th St). Commissioner Burke made a motion to ADOPT Resolution #037-2011. Ald. Borgman seconded. Director Muenkel explained Veolia is proposing to construct a 5,894 square foot building to house the equipment required to process and pump the methane gas to the Milwaukee Metropolitan Sewer District. The structure is proposed to be 32' wide x 32' tall x 139' long with metal sides to house equipment and a 48' wide x 14' tall x 32' long masonry building for electrical controls, offices, and a meeting room. The building will be prefinished metal wall panels and the office portion will be made of split and smooth face block. The equipment will run 24 hours a day and monitored by one employee on site approximately ten hours a day. Equipment will be on the west side of the structure and will operate at low sound. Commissioner Noah expressed concerns related to the safety aspects of the operation such as specifications and codes, design features for public safety, and how high the gas is compressed. Jay Warzinksi, representative from Veolia, was present and explained it is relatively low compression at 100 psi; which meets the DOT requirements. The wiring in the building will be safe in the processing area. The gas comes in through blowers from the landfill and is routed through treatment systems that include hydrogen sulfide removal. It is then sent through chillers to remove moisture and is compressed to be able to move it down the pipe to MMSD. Mercaptan, odorant, will be added at the end for the natural gas smell. A wicking system will be used, with smaller bottles, as the gas comes through it will pick it off the wick. There will be methane monitors in the building with an automatic shut down for emergencies. October 4, 2011 REQUEST: Annual Review for Wal-Mart Tax Key No. 2169.999.003 / W 159 S6530 Moorland Road NE'/4 of Section 3 PETITIONER: Community Development Department — Planning Services INTRODUCED: April 5, 2011 LAST AGENDA: April 5, 2011 PREPARED BY: Jeff Muenkel, AICP BACKGROUND PC 038-2011 In 2008, Wal-Mart received Building, Site, and Operation Plan approval by Resolution #P.C. 045- 2008 for a new store on the site. The BSO included a requirement for an annual review six months after occupancy so Planning Commission could make sure the requirements of the BSO are being followed related to delivery routes, decibel levels, and 24 hour operations. Plan Commission reviewed Wal-Mart in April 2011 for their 6-month review and found substantial compliance. However, there was a request by the local Alderman to re -review Wal-Mart in October of 2011 in order to allow the business to operate over the summer to see if any issues may arise with the area residents. STAFF DISCUSSION PC 038-2011 Staff sent letters to all surrounding residents along College Avenue (north of Wal-Mart) and Lawndale Place (west of Wal-Mart behind berm in the Glenbrook Subdivision). The letters notified them of tonight's Planning Commission review of Wal-Mart and invited them to contact staff, their local Alderman, or show up to Planning Commission to let us know of any concerns they may have. As of the writing of this supplement, staff had only received feedback from one resident who stated that they have had no issues with Wal-Mart and that more noise comes from Veolia to the east in the Tess Corners Business Park. Staff knows that the local Alderman Kert Harenda was going to go door to door as well and Alderman Harenda should be at our meeting to discuss any issues he came across. As far as the delivery routes, decibel levels, and 24 hour operations, staff has still found compliance with all. Since the opening of Wal-Mart in the Fall of 2010 staff has not received any complaints in relation to delivery routes, operation noise, or the 24 hour operations originally approved in the BSO. Truck deliveries were limited to the hours of 5 am to 11 pm and trucks are required to shutdown engines during loading/unloading. A decibel level was limited to 50 db at the east lot line of the Wal-Mart parcel. Staff does have a calibrated Sound Level Meter on hand. A field inspection was completed on March 28, 2011 to verify decibel levels in a variety of locations along the east lot line. Staff found decibel levels to be no more than 40 db along the entire east lot line of Wal-Mart (in a light wind). Most levels were below 40 db behind the wall that has been erected. In fact, db levels were over 50 db when you were within 15 feet of the decompressors along the southern facade of the structure. These decibel levels were confirmed again per an inspection on September 23, 2011. There will be no further annual reviews for Wal-Mart unless Planning Commission directs to do so. October 4, 2011 REQUEST: Building, Site, and Operation Plan for new medical clinic structure Tax Key No. 2167.995.009 / Moorland Road SW '/4 of Section 2 PETITIONER: Briohn Building Corporation INTRODUCED: October 4, 2011 LAST AGENDA: N/A PREPARED BY: Jeff Muenkel, AICP BACKGROUND PC 039-2011 On September 19, 2011 a submittal was received from Briohn Building Corporation for a new medical clinic structure along Moorland Road (Tax Key No. 2167.995.009). The structure would be a western anchor to the Kohl's Department Store complex located on the northeast corner of Moorland Road and Janesville Road. CONSISTENCY WITH ADOPTED PLANS 039-2011 Comprehensive Plan: The 2020 Plan depicts the property for commercial uses. The petition is consistent with the Plan. The property is zoned PD-34 as part of the original Dreamland Planned Zoning: Development and is under the auspices of the B-3 General Business District. The use is permitted subject to BSO approval. STAFF DISCUSSION PC 039-2011 The submittal is included in the supplement consisting of a narrative, site/utility/grading plans, building elevations, colored renderings, landscape plans, photometric plan, and lighting details. As stated above, the petitioner requests approvals for a new medical clinic which would become the western anchor to the Kohl's Department Store complex located on the northeast corner of Moorland Road and Janesville Road. The proposed building will be 24,178 SF square feet, with 16,000 SF being initially used by the tenant and the remaining space for future expansion. Hours of the business are likely to be Monday - Saturday 8:00 AM to 8:00 PM. Architecture The proposed building is shown to be constructed mainly with architectural concrete brick (4" and 8"), 8" concrete block, standing seam metal roofs, aluminum glazed windows, some EIFS banding, and prefinished metal copings. The colors of the structure are shown to be masonry materials of reds and tans along with greenish colored aluminum window copings and standing seam roofs. The building will have a flat roof and will be 17 feet in height with parapets that will aid in screening any rooftop mechanicals. This area of the City is governed by the General Design Guide, but more directly the Moorland South Design Guide. The General Design Guide calls for 50% masonry product and the proposed structure meets this main requirement. The Moorland South Design Guide gets into more detail and looks to promote structures with Craftsman and Prairie Style Architecture. The petitioner's narrative states the following on how they believe that they meet these architecture requirements in some ways: Its placement on the site is in near alignment with the existing Kohl's and utilizes similar materials, complementary proportions and horizontal banding, and hip roofed tower elements at the corners. The design takes these complimentary elements and enhances them with prairie -styled concepts. To do this, the architectural concrete brick masonry will utilize a darker, richer red/brown than found on Kohl's. The masonry areas will have buff colored accent banding to help strengthen the horizontal prairie -style image. The roof forms will have broader overhangs, and be of green standing -seam steel roofing. This wide overhang roof form will also be placed as a porte-cochere covered drive -up entrance at the front entrance. The Planning Commission should pay the most attention to the architecture in this submittal. The petitioners have provided some detail to make the structure adapt to the Moorland South Design Guide and the Planning Commission may wish to have more details added. This site is a bit different than a standalone site in that the Kohl's Department Store architecture has already been approved almost a decade ago and does lack detail according to the Moorland South Deign Guide already. Thus, allowing some reduced architectural elements of prairie styles in the proposed building may make sense in this case. The alternative may be to ensure prairie style architecture is more strictly adhered to at the stand alone sites that surround the retail complex instead since these have more visibility. However, as we look thru the past minutes, it is evident from the Planning Commission that they don't view the Kohl's structure as truly meeting the design guide anymore. That fact can be seen throughout the progression of buildings under that design guide: Jetz-Aldi- M & I-Walgreen's-Waukesha State Bank -Dr. Thompson Dental Office. If anything, staff was thinking that a bit more attention could be made on the western fagade of the proposed structure. The western fagade will be very visible from Moorland Road and the possibility of adding a couple more prairie style rooflines (like the one on the front southwest corner of the proposed structure) might add to the design. Also adding one of these rooflines on the southwest corner of the building as well might add a bit more detail? Site, Parking, and Access The overall site is already pad -ready and has adequate access existing from traffic controlled intersections at both Janesville Road and Moorland Road. However, the parking lot was never installed as part of the Kohl's Department Store development. The city allowed the majority of the parking lot to be undeveloped until future users were approved for the complex. The petitioner's propose to convert the grass area in front of the new building to a parking lot per the past concept plans for the overall complex. A total of one hundred twenty-one (121) new parking stalls will be developed all in a pattern that will maximize the parking when future users develop to the east. The 121 parking stalls equal 5 stalls per 1,000 SF of new construction. The parking is more than adequate per code. In fact, once the entire complex is developed the site will have well more parking than what the city even saw at the Wal-Mart complex approved a couple years back. Fire Department Approval The site plan is still subject to Fire Department approvals at the time of building permits as well. Possible changes to the site plan may be required based upon the final Fire Department review. Dumpsters/Refuse Containers/Outdoor Storage A dumpster enclosure is proposed along the north side (back) of the building, as required by code. The enclosure will be constructed of similar materials to the overall structure. Landscaping A landscape plan has been submitted as part of the proposal. Review of the landscape plan is pending and the City Forester will work with the petitioner based upon any changes/additions that are needed. In all, a wealth of landscaping is proposed in the new parking lot and along the foundations of the entire structure. Signage No exact signage is part of the submittal and will be subject to future staff approvals. Wall signage is shown on the rendering to occur in the future along the south and western facades. Lighting Site lighting is proposed to match the existing lighting found around the Kohl's Department Store complex. Lighting details and photometrics show that all City of Muskego requirements are being met. Sewer, Water, Storm, Grading The development will be served by existing public sanitary sewer and water. Further, all stormwater arrangements have been accommodated for when the Kohl's Department Store development was constructed. Minor grading will need to occur when the installation of the new parking lot is completed. Other It is not expected that issues pertaining to door vibration, odor, emissions, hazardous pollutants, or excessive noise will occur. MRI, x-ray, and use of other related equipment may occur, and medical waste will be generated. All of these issues will be controlled within the building. The following is also part of the Plan Commission resolution: BE IT FURTHER RESOLVED, That a separate sign permit will be required before any signage (temporary or permanent) can be installed and this includes any signage on the building. BE IT FURTHER RESOLVED, The site plan is still subject to Fire Department approvals at the time of building permits. BE IT FURTHER RESOLVED, All lighting fixtures must be full cut-off with a zero degree tilt and the concrete bases for the pole lights cannot exceed 6 inches in height above grade. BE IT FURTHER RESOLVED, A final landscape plan will need to be approved by the City Forester prior to the issuance of building permits. BE IT FURTHER RESOLVED, Formal approvals from the Engineering Division of grading and stormwater plans will be required before the issuance of building permits. BE IT FURTHER RESOLVED, That any bollards must be painted to match the colors of the principal structure. BE IT FURTHER RESOLVED, That any new handicap signs be incorporated into bored bollards. BE IT FURTHER RESOLVED, That all roof top and ground mechanicals (including HVAC devices, electrical transformers, etc.) must be screened from view and/or incorporated into the design of the site/structure (screening, etc.) and should be approved by the Planning Division. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation Plan for a medical clinic located along Moorland Road (Tax Key No. 2167.995.009). BE IT FURTHER RESOLVED, That a separate sign permit will be required before any signage (temporary or permanent) can be installed and this includes any signage on the building. BE IT FURTHER RESOLVED, The site plan is still subject to Fire Department approvals at the time of building permits. BE IT FURTHER RESOLVED, All lighting fixtures must be full cut-off with a zero degree tilt and the concrete bases for the pole lights cannot exceed 6 inches in height above grade. BE IT FURTHER RESOLVED, A final landscape plan will need to be approved by the City Forester prior to the issuance of building permits. BE IT FURTHER RESOLVED, Formal approvals from the Engineering Division of grading and stormwater plans will be required before the issuance of building permits. Plan Commission City of Muskego Adopted: Denied: Deferred: Introduced: October 4, 2011 ATTEST: Kellie McMullen, Recording Secretary BUILDING, SITE AND OPERATION PLAN APPLICATION FOR BOULDER VENTURE 28, LLC - MUSKEGO MEDICAL CLINIC INTENDED USE: Boulder Venture 28, LLC, developer and land owner adjacent to the current Kohl's Department store development at the intersection of Moorland Road and Janesville Road, proposes to build a 24,178 square foot medical clinic facility for a major regional healthcare provider. The facility will be on the 26.47 acre portion of the site (CSM 9335, parcel 3). Zoned PD-34 (B-3), the site has been previously master planned and physically prepared for development. On -site roadways, utilities, building pads, and wetland/conservancy areas exist, and are ready for this building, which will be the first at the development since the construction of Kohl's Department store. See site plan for information on overall site. The proposed Muskego Medical Clinic is being proposed as a 24,178 square foot building shell, of which approximately 16,000 square feet will be initially utilized by the tenant. The remaining space will be for future expansion. Its location will be at the West end of the building pad that is in -line with the front of Kohl's. That will leave approximately 64,000 square feet available for future construction. Though primarily for future mercantile space, it may also include some physical expansion of the medical clinic. The proposed medical clinic conforms to the setbacks, easements, traffic flow, wetland/conservancy designations, utilities, storm water management, and building use intended by the original site development. The building will be designed within the guidelines of the City of Muskego Zoning Ordinance, including the City of Muskego-Moorland Corridor South Design Guide. As a conventional medical clinic, its typical hours of operation are likely to be Monday through Saturday from 8:00 a.m. to 8:00 p.m., though specific tenant requirements have not been finalized. It is not expected that issues pertaining to door vibration, odor, emissions, hazardous pollutants, or excessive noise will occur. MRI, x-ray, and use of other related equipment may occur, and medical waste will be generated. All of these issues will be controlled within the building. The design of the medical clinic addresses the design standards in the following ways. Its placement on the site is in near alignment with the existing Kohl's and utilizes similar materials, complementary proportions and horizontal banding, and hip roofed tower elements at the corners. Tenant signage will occur on the South and West sides of the medical clinic corner. The design takes these complimentary elements and enhances them with prairie -styled concepts. To do this, the architectural concrete brick masonry will utilize a darker, richer red/brown than found on Kohl's. The masonry areas will have buff colored accent banding to help strengthen the horizontal prairie -style image. The roof forms will have broader overhangs, and be of green standing -seam steel roofing. Some EIFS will be used at soffits and parapet details, but the use will be limited, and serve as an accent. Though the interior layout is still in very conceptual stages, large areas of glazing will occur on the highly visible South and West facades. The glazing will be green -tinted high performance glass in a factory painted aluminum frame system. The rear (North) fagade will have the service door and dumpster enclosure. Along this back side the masonry will be painted concrete block to match the color and texture to the front facades. The painted masonry bands will continue these colors and banding on the east wall as well, as this wall will be completely hidden once additional buildings infill the space between this facility and Kohl's. The building height is proposed as 17 feet which will create a parapet that hides potential roof top equipment from view. Line -of -sight studies have shown this parapet will block the view of the equipment from within the site and from the West site entrance at Moorland Road and the South entrance drive off Janesville Road, approximately 900 feet away. On Janesville Road, at the far East end of the Kohl's portion of the site, the road rises and it may be possible to view the roof top units of the medical clinic from that point; yet, at 1100 feet away, we feel that it would not be recognizable. Additionally, future out buildings intended for the site would block this line -of -sight. The site amenities will follow the pattern developed when the overall site preparations occurred. Spacing and location of parking aisles and parking islands, site lighting, utilities, and drainage have been pre -determined, and along the internal roadways, these items already exist. Therefore, new site lighting, parking aisles, and parking islands are being done to match the existing pattern. The site lighting photometrics will meet City of Muskego requirements. One hundred twenty one (121) parking stalls are being proposed, providing Five (5) stalls per 1,000 square feet of new construction. Landscaping is being proposed within the scope area of the new building and parking areas, as per size, spacing, and species requirements adopted by the City of Muskego.
