PAGE 2 CITY OF MUSKEGO PLAN COMMISSION MINUTES UNAPPROVED 6:00 PM Tuesday October 4, 2011 Muskego City Hall, W182 S8200 Racine Avenue Mayor Chiaverotti called the meeting to order at 6:00 PM. Those present recited the Pledge of Allegiance. PRESENT Mayor Kathy Chiaverotti, Ald. Borgman, Commissioners Hulbert, Burke, Stinebaugh, Jacques and Planner Trzebiatowski and Recording Secretary McMullen. ABSENT Commissioner Noah Recording Secretary McMullen noted that the meeting was properly noticed on September 27, 2011 in accordance with the Open Meeting Law. APPROVAL OF THE MINUTES OF THE SEPTEMBER 6, 2011 MEETING Commissioner Jacques made a motion to approve the minutes of the September 6, 2011 meeting. Ald. Borgman seconded. Upon a roll call vote, motion to approve the minutes was ADOPTED unanimously. Commissioner Hulbert questioned if the current Fry CUG will remain with the property when he moves across the street. Planner Trzebiatowski explained the CUG will remain with the property unless the City or property owner petition for the removal. OLD BUSINESS FOR CONSIDERATION None. OLD BUSINESS SCHEDULED FOR DEFERRAL None. CONSENT BUSINESS. None. NEW BUSINESS FOR CONSIDERATION RESOLUTION #P.C. 038-2011 — Approval of an Annual Review for Wal-Mart located in the NE '/4 of Section 3 (Tax key No. 2169.999.003 / W159 S6530 Moorland Road). Commissioner Jacques made a motion to ADOPT Resolution #P.C. 038-2011. Commissioner Burke seconded. Planner Trzebiatowski explained Plan Commission reviewed Wal-Mart in April this year for their 6 month review and found substantial compliance. The Alderman of the district requested one more review in October to allow the business to operate over the summer. Staff sent out letters notifying the neighboring residents of the meeting and to let staff or the Alderman know of any concerns. One comment was received and they had no issues with Wal-Mart, but that more noise comes from the Veolia property to the east. A field inspection was completed on September 23, 2011 to verify decibel levels. Staff found levels were below 40db along the entire east lot line of Wal-Mart. Planner Trzebiatowski noted that the Resolution states there will be no further reviews. No one in the audience wished to speak and the alderman of the district was not present. Upon a roll call vote, Resolution #P.C. 038-2011 was ADOPTED unanimously. RESOLUTION #P.C. 039-2011 — Approval of a Building, Site, and Operation Plan for a medical clinic structure located in the SW '/4 of Section 2 (Tax Key No. 2167.995.009 / Moorland Road). Ald. Borgman made a motion to ADOPT Resolution #P.C. 039-2011. Commissioner Burke Plan Commission Agenda, continued October 4, 2011 seconded. Planner Trzebiatowski explained a submittal was received from Briohn Building Corporation for a new medical clinic along Moorland Road. This structure will be a western anchor to the Kohl's Department Store complex. There will still be a vacant space in between the two. The proposed building will be 24,178 square feet with 16,000 square feet being used by the tenant and the remaining space for future expansion. The building will be 100% masonry with architectural concrete brick, 8" concrete block, standing seam metal roofs, aluminum glazed windows, EIFS banding, and prefinished metal copings. This area is governed by the General Design Guide and the Moorland South Design Guide, and the plans meet the bulk requirements of the Design Guides and the Zoning Code. The only question that came up by staff was should there be more prairie -craftsman style architecture along the western fagade as required by the Moorland South Design Guide. Mr. Trzebiatowski noted that Kohl's was built a while ago and wasn't the best example of prairie -craftsman style architecture. This style architecture is more present on the recent buildings such as Jetz, Aldi, M&I, Waukesha State Bank and Dr. Thompson's Dental Office. Bob Goehner of Briohn Building was present and gave a brief presentation on the proposed medical clinic. Mr. Goehner explained the architecture used on the building is to add balance to the Kohl's non -prairie -craftsman style architecture and the future development of the outlot using prairie —craftsman style architecture. The colors are from the City's Design Guide and the beige color will match Kohl's. The landscape plan was reviewed and approved by the City Forester. Discussion took place on what will be going in between Kohl's and the medical clinic. Mr. Goehner stated the infill building is not known at this time, but when it does go in there will not be any space in between the buildings. The type of material that will be used on the east side of the building will be a 12" painted block. Mr. Trzebiatowski explained there usually is a little different style architecture on the infill side of a building. Mr. Goehner added there will be a wealth of landscaping along this side also. Commissioner Burke expressed concern with the lack of prairie -craftsman style architecture along the western side. Commissioner Burke suggested adding the green roof element along the west side about half way down near the bump out. Mr. Trzebiatowski noted the added roof element should be 4-side architecture too. Mr. Trzebiatowski added that this building is back from the road and will not be as visible as the future buildings in the outlots. Any future developments in these outlots should be held to a high level of prairie -craftsman style architecture. Commissioner Stinebaugh questioned what the noise level would be coming off the mechanicals on the roof. Mr. Goehner stated the mechanicals would not be heard from the ground. The units are in the middle of the building surrounded by a parapet wall. Discussion took place relating to sound levels that should be allowed. Commissioner Burke suggested an amendment be made similar to what was required of Wal-Mart. Mayor Chiaverotti noted this situation is different because there are no residents nearby as there are with Wal-Mart. Commissioner Stinebaugh requested staff look into some type of requirement through the Design Guide that limits the amount of noise from new developments. Commissioner Burke agreed. Commissioner Burke made a motion to AMEND Resolution #P.C. 039-2011 to read: BE IT FURTHER RESOLVED, That another green prairie -craftsman style roof element be added to the western fagade by the center bump out. Since this accessory structure is in addition to one existing accessory structure and a garden shed, Plan Commission approval is required. PLAN CONSISTENCY PC 040-2011 Comprehensive Plan: The 2020 Plan depicts the area for medium density residential land use. The proposal for this residential outbuilding is consistent with the Plan. The property is zoned RS-2 Suburban Residence District. Accessory structures totaling around 1,222 square feet are permitted on the subject property. The current proposal measures 736 square feet in area. There is one other Zoning: accessory structure that exists on the lot, which totals 232 square feet in size and a garden shed which totals 120 square feet in size. The grand total of all accessory structure square footage with the proposed accessory structure equals 1,088 square feet. The proposal meets the bulk requirements of the Zoning Code. STAFF DISCUSSION PC 040-2011 Design Guide requirements state that Planning Commission approval is needed for more than one accessory structure on a lot when it is being used for residential purposes. Planning Commission approvals are being sought due to this concern since one other accessory structure and a garden shed exist on the lot. The petitioner proposes a residentially sided structure with a shingled roof. The colors and materials of the accessory structure will need to match the colors of the existing house. The location of this building meets the required setback and offsets. The height of the structure is about 11.5 feet, as measured according to code, which meets code requirements. Staff has no concern with the placement or architecture of the added accessory structure, as long as the colors match the existing house. SITE PLAN/SURVEY: A site plan/survey has been submitted for the project. Access to the site is gained off of Boehm Court. Overall the building meets the zoning requirements for the RM-3 district in regards to setbacks/offsets, open space, density, height, floor area ratio, etc. PARKING: Parking is handled with two -car attached garages for each unit. There also is a large driveway shown for parking for numerous guests for each unit if necessary. LANDSCAPING: A landscape plan has not been submitted at this time. A landscape plan must be submitted and approved before building permits can be issued. All landscaping must be installed before occupancy can be granted for either unit within the building. I`j contestant whose conduct, in the sole opinion of shoot management, is unsportsmanlike or whose participation is in any way detrimental to the best interests of the shoot. 3. Disqualify any shooter from a shoot for misrepresentation of his/her status under the eligibility rules (SANDBAGGING). 4. Expel or disqualify any shooter physically assaulting a Field Judge or any shooter using abusive language to a Field Judge upon sufficient evidence presented. 5. The shoot management shall report to NSCA all cases of disqualification and expulsion and the reasons for the same. The circumstances under which any shooter is expelled from or disqualified from any NSCA function, event, or club will be reviewed by the Executive Director after giving the shooter involved an opportunity to be heard. The Executive Council will direct the Executive Director to notify the shooter, in writing, of his/her membership status: A) No action taken, B) Expul- sion/loss of membership for a term to be determined by the Executive Council, or C) Probation for one (1) year and if any other mishaps, immediate expulsion and loss of membership for one (1) year. The Executive Council can amend the length of expulsion or probation. Members may be suspended for failing to pay for goods orservices ordered from NSSA/NSCAMember Club or who give to NSSA/NSCA Member Club a check that is returned for insufficient funds or other cause. Members MAY BE reinstated upon receipt in full of the outstanding balance and any fees incurred, such as bank charges, as a result of the incident. The Executive Council can determine any penalties and/or suspensions as each case merits. (See I-13-4) 6. Any disqualified shooter or one that does not finish an event for any reason will remain as an entrant of said shoot for the purposes of awarding punches. V. NSCA 5-STAND SPORTING TM NSCA 5-STAND Sporting events consist oftargets shot in 25 bird increments from five shooting stands with each shooter rotating from station to station. The game offers several different skill lev- els and utilizes six or eight automatic traps to simulate game birds. Targets are released in a predetermined set sequence marked on a menu card in front of each shooting cage. Targets are registered separately under a special set of rules; however, they utilize the NSCA Classification system and all targets are included for total targets shot for the year. NSCA 5-STAND Sporting rules must be followed at all times while conducting this event. A. LAND 1. Minimum area 50 yards wide along shooting stand line. 2. Minimum 300 yards deep left and right ofthe center ofshooting. stand line creating an 80 degree arc for safe shot fall. (Game can be overlaid on a skeet and/or trap field.) B. EQUIPMENT 1. Six (6) or eight (8) automatic traps are recommended. 2. Machines should include a rabbit trap and a vertical trap (minimum 60 percent). 3. Five shooting stands not less than seven (7) feet tall and not more than 54 inches across the front opening. 4. One tower not less than twelve (12) feet in height is recom- 38 V-B-4 mended. 5. Shooting stands must be in a STRAIGHT LINE (for safety) not less than four (4) yards apart or more than six (6) yards apart (recommended five (5) yards) center -to -center. 2. Trap placement and target flight paths may be arranged to include the following: a. Left to right crossing and/or quartering away target. b. Right to left crossing and/or quartering away target. c. Vertical target (Springing°Teal). d. Rabbit target. e. Tower target going away. f Incoming target. 3. For safety reasons, traps must be placed in a position that prevents broken targets from hitting the competitors orcaus- ing a competitors gun to be pointed in an unsafe direction. Traps placed parallel or too close to the shooting stand line can create a serious hazard. Recommended five yard mini- mum for any traps placed in front of shooting stands. Tower placement must be a sufficient distance back or to the side of the shooting stand line to prevent broken targets from falling on the competitors. Traps placed to the side of the shooting stand line should be a sufficient distance forward or behind the shooting stands to prevent competitors from selecting a hold point too close to the shooting stand line when calling for the target. 4. Multiple Layouts- When the squad moves to the next layout, the original first shooter will rotate to the end of the line; the rest of the shooters on the squad will move up (toward the first cage) one position, thus rotating who is the first shooter at each subsequent layout. D. RULES 1. Gun must be open and empty while changing stands. 2. Shooters may not leave their station until instructed to doso by the referee or until the last shooter has fired his/her last shot. 3. May only load gun while in shooting stand in ready position. 4. Shooter's feet must be behind the front openingofthe shooting stand except when changing stands. Shooters will be warned, a NO -BIRD will be called, continued disregard will result in losing a target or being disqualified. 5. No chokes may be changed after the round has begun.
