Those present recited the Pledge of Allegiance. PRESENT Mayor Kathy Chiaverotti, Ald. Borgman, Commissioners Noah and Jacques and Director Muenkel and Recording Secretary McMullen. ABSENT Commissioner Hulbert, Burke, and Stinebaugh Recording Secretary McMullen noted that the meeting was properly noticed on October 28, 2011 in accordance with the Open Meeting Law. APPROVAL OF THE MINUTES OF THE OCTOBER 4, 2011 MEETING Ald. Borgman made a motion to approve the minutes of the October 4, 2011 meeting. Commissioner Noah seconded. NEW BUSINESS FOR CONSIDERATION RESOLUTION #P.C. 041-2011 — Approval of a Four Lot Certified Survey Map for the Michael Birkley property located in the NE 1/4 of Section 14 (Tax Key 2213.984.001 / W144 S7931 Durham Drive). Commissioner Jacques made a motion to ADOPT Resolution #P.C. 041-2011. Ald. Borgman seconded. Director Muenkel explained the petitioner is proposing to divide a property on Schultz Lane south of Durham Drive. The petitioner created Summertime Lane with a past CSM. These lots were created before the Right of Way Ordinance went into effect requiring streets to be built to City standards. This item went to the Public Works Committee in October and it was found that past approvals apply, which consist of the petitioner adding Plan Commission Minutes, continued November 1, 2011 approximately 50 feet of asphalt stemming from Schultz Lane and then a gravel drive back to the end of Summertime Lane. Access will be off of Schultz Lane with the exception of lot 1, which will be off of Summertime Lane and Lot 4 off of Laura Lane. Staff recommends approval. Ald. Borgman questioned if the lots will be on City sewer. Director Muenkel stated the lots 1-3 will be on City sewer and lot 4 will not. Upon a roll call vote, Resolution #P.C. 041-2011 was ADOPTED unanimously. RESOLUTION #P.C. 043-2011 — Approval of a Building, Site, and Operation Plan Amendment for Boxhorn Sportsman's Club located in the NE '/4 of Section 24 (Tax Key 2254.998.004 / S90 W 13960 Boxhorn Drive). Commissioner Jacques made a motion to ADOPT Resolution #P.C. 043-2011. Commissioner Noah seconded. Director Muenkel explained this is an amendment to an existing BSO. The business operates north of the boat launch on Boxhorn Drive. There is currently a bar/restaurant, warehouse, and shooting range on the property. The petitioner is proposing a 5 STAND sporting clay range. The building is to provide a waiting/viewing area, a safe shooting layout, and additional storage. The building will make events safer and more attractive. No complaints have been received from the Police Department or the Planning Department in the last couple years. Staff recommends approval. Ald. Borgman questioned if the building will replace the existing flattened area. Director Muenkel stated that area will remain. December 6, 2011 REQUEST: Rezoning (045-2011) and Land Divisions (046-2011) Field Drive / Tax Key Number 2185.999, 2185.998, 2190.996.004 & 2190.995 NE'/4 of Section 7 PETITIONER: City of Muskego (Rezoning) and Nancy Borst (CSMs) INTRODUCED: December 6, 2011 LAST AGENDA: N/A PREPARED BY: Jeff Muenkel, AICP BACKGROUND PC 045-2011 and 046-2011 The City of Muskego recently approved an offer to purchase portions of the Nancy Borst lands along Field Drive. The purchase was for conservation purposes of this high environmental quality lands. As part of the purchase agreements the City requires that the lands be rezoned appropriately and that the boundaries of the new lands be properly designated. Please find herein the logistics behind the rezoning lines and the new property lines required to make this purchase a reality. PLAN CONSISTENCY PC 045-2011 and 046-2011 Comprehensive Plan: The 2020 Plan depicts the area for Rural Density Residential. The proposal is consistent with the Plan for the newly proposed parcels. However, the request includes changing the portions of the Rural Density Residential lands to Conservation designations for the portions that the city will now own. Zoning: The property is currently EA Exclusive Agricultural requiring minimum lot sizes of 35 acres and an average minimum width of 1,275 feet. The proposal is consistent with the Plan when rezoned as proposed as the new lands will be zoned CI-1 Conservation for the new city owned lands and RCE Rural Country Estate for the Borst retained residential lands. Parks and Conservation Plan: The 2007-2011 Plan depicts the area as Conservation Preservation on this site and the proposal is consistent with the Plan in that the city will be looking to maintain the new conservation lands for conservation purposes in perpetuity. Street System Plan: All right-of-ways will be dedicated as required per the CSMs. Access to the northern city lots and remaining residential lots to the north are by existing or new easements. [Adopted 208 Sanitary Sewer The lots will be served by private sewer system. The proposal is Service Area: consistent with the Plan. Water Capacity Assessment The lots will be served by private wells. The proposal is consistent with District: the Plan. Stormwater Management Sot rmwater management is not required. Plan: DISCUSSION PC 045-2011 and 046-2011 As mentioned above, the rezoning and CSMs all relate together in order to complete the purchase requirements for the City to purchase portions of the Borst lands for conservation purposes in perpetuity. Rezoning The area proposed under the rezoning is all currently zoned EA — Exclusive Agricultural requiring minimum lot sizes of 35 acres and an average minimum width of 1,275 feet. The proposal is to rezone the properties to either RCE Rural Country Estate District or CI-1 Conservation District per the map boundaries attached. The RCE Rural Country Estate District requires minimum lot sizes of 120,000 SF and an average minimum width of 250 feet. The CI-1 Conservation District minimum lot sizes and minimum widths are not applicable. All parcels requested meet the requirements of these districts. A 2020 comprehensive Plan amendment is required for the lands to be rezoned to CI-1 Conservation District so that these lands are properly shown as for conservation purposes on the 2020 Plan. The reason for the request is ensure that the acquired city owned lands are properly zoned conservation in perpetuity and that the retained Borst lands meet the same residential zoning district that is found in the surrounding neighborhood. A Public Hearing for the rezoning was scheduled before the Common Council on November 22, 2011,and there were no comments for or against. Approval tonight would be contingent on Council approval of the rezoning. Certified Survey Maps There are two (2) CSMs as part of this approval. The northern CSM breaks off a portion of the original northern farmstead of the Borst property and the southern CSM breaks up an existing home and two new residential lots on the southern farmstead of the Borst property. The remaining parcels from both the northern and southern CSMs are the lands to be purchased by the city for conservation purposes. In all, the "outlots" shown on the two CSMs are the general areas that the City is to be purchasing while the "lots" shown on the two CSMs are the areas to be retained by the Borst parties. The CSMs meet the bulk requirements of the code for RCE (Borst retained lots) and CI-1 (City purchased lots) zoned lots. Approval is recommended subject to any Engineering technical corrections being addressed first. The resolution for the CSM is drafted for approval but is contingent upon the rezoning described above being approved by Council per the following: BE IT FURTHER RESOLVED, That this CSM approval is dependent on Council approval of the rezoning as submitted under Plan Commission Resolution #045-2011 or the CSM will have to be reconfigured to meet the present zoning requirements. STAFF DISCUSSION PC 050-2011 As mentioned above, Veolia Environmental Services is proposing to construct a 768 sq. ft. roof structure and electrical control room near the flare at the landfill site and also proposing to remodel and add 597 sq. ft. onto the former Briggs and Stratton building just north of the flare. These structures are required to house the equipment that is needed to process and pump the methane gas generated by the landfill to the Jones Island sanitary treatment facility in Milwaukee. This is part of the Milwaukee Metropolitan Sewage District Plans to re -use this gas. This plan would replace their September 2011 plans. Site As shown in the site plans and on the orthophoto in the supplement, the smaller proposed roof structure and electrical control room building will be in the same location as the previous approval and will be internal to the property and will not be visible from any surrounding roadway. The landfill site is protected by various landscape berms and existing structures along 1241h Street already. The proposed structure will be approximately 1,000 feet into the site from the roadway. The main change relates to the addition and modifications to the former Briggs and Stratton building. This building is located north of the smaller structure. There are some limited additional impervious surfaces being added, but they are well under the 'Y2 acre requirement so no stormwater facilities will be required. Building The smaller (768 sq. ft.) building located near the flame will consist of a 12' x 24' CMU building 14' high with a 480 sq. ft. roofed area. The former Briggs and Stratton building will be modified, including a 597 sq. ft. addition, to house the bulk of the equipment that is needed to process/treat the gas. This existing building is constructed out of two types of CMU block and the addition will include the same materials and colors. There also is a metal roof element that is going to be replaced on portions of the building. The required equipment in this building needs a large amount of air return and ventilation. As such, there are numerous roof top mechanicals/vents being proposed. In order to screen these features, an 80" metal railing system with galvanized perforated metal infill panels will be placed on the top of the building on the north, east, and south elevations. The perforations in these panels measure .25" x .75", which leave 11 % open area. The petitioner believes that this should provide adequate screening along with proper ventilation. You will see in the submittal that there were a few other screening ideas suggested, with this selected option being the most concealing. Operations The equipment will run 24 hours a day, 365 days a year and will be continuously monitored by one employee on site approximately ten (10) hours a day. The petitioner had a sounds analysis done and it is stated that the dBA level is not expected to exceed 63 dBA at the nearest lot line. As part of the landfill agreement with the City, Veolia cannot exceed 65 dBA. The proposal is within the requirement. Miscellaneous As part of the gas treatment, there are numerous pieces of equipment that will be kept outside around the larger building. There are going to be two groupings of outdoor equipment. One is located on the north side of the building and the other is located on the south and southwest side of the building. The northern area will contain various pieces of outdoor equipment and will be enclosed with a 10 foot high chain link fence. The fence will contain vertical cedar boards on the north, east, and south elevations and decorative slatting on the west elevation. This should screen the majority of the equipment. The south/southwest area will contain two electrical transformers and 4 taller storage tanks in the rear. This area will also have a 10 foot high chain link fence on the east and south sides and it will contain vertical cedar boards on the two sides. Some of the upper portions of the tanks will be exposed, they are attempting to screen the bases and given this location by the landfill, this is not seen as an issue. STAFF RECOMMENDATION PC 050-2011 Approval of Resolution PC 050-2011 Resolution #PC 050-2011 LEGEND Agenda Item(s) Property I Zoning Districts Right-of-way Hydrography Aerial Photo Date: April 2010 rIt-MUSKF(;O I Prepared by City of Muskego Planning Department 11/29/2011 Supplemental Map Property Owner: Veolia 124th Street RESOLUTION #P.C. 050-2011 APPROVAL OF AN AMENDED BUILDING SITE AND OPERATION PLAN FOR VEOLIA LOCATED IN THE NE'/4 OF SECTION 36 (TAX KEY 2301.998 and 2301.999 / 124" St) WHEREAS, On November 22, 2011 a submittal was received from Veolia located along 124th St in the southeast corner of Muskego (Tax Key No. 2301.998), and WHEREAS, An approval for a similar use was granted under PC 037-2011 but due to some gas processing changes, this new proposal is being brought forward, and WHEREAS, The property is zoned M-3 Landfill/Extractive and allows landfill activities by right, and WHEREAS, The 2020 Comprehensive Plan shows this property as landfill uses and the proposal is consistent with the plan, and WHEREAS, The proposal is to construct a 768 sq. ft. roof structure and electrical control room near the flare at the landfill site and to also remodel and add 597 sq. ft. onto the former Briggs and Stratton building just north of the flare, and WHEREAS, These facilities are used to house the equipment required to process and pump the methane gas generated by the landfill to the Jones Island sanitary treatment facility in Milwaukee, and WHEREAS, The smaller (768 sq. ft.) building located near the flame will consist of a CMU 12' x 24' building, 14' high, with a 480 sq. ft. roofed area, and WHEREAS, The former Briggs and Stratton building will be modified, including a 597 sq. ft. addition, to house the bulk of the equipment that is needed to process/treat the gas, and WHEREAS, This existing larger building is constructed out of two types of CMU block and the addition will include the same materials, and WHEREAS, The required equipment in the larger building requires a large amount of air return and ventilation and as such, there are numerous roof top mechanicals/vents being proposed, and WHEREAS, In order to screen these features, an 80" metal railing system with galvanized perforated metal infill panels will be placed on the top of the building on the north, east, and south elevations, and WHEREAS, The perforations in these panels measure .25" x .75", which leave 11% open area, and WHEREAS, The equipment in the structure will run 24 hours a day, 365 days a year and will be continuously monitored by one employee on site approximately ten (10) hours a day, and WHEREAS, As part of the gas treatment, there are numerous pieces of equipment will be kept outside around the larger building within two groupings, and WHEREAS, The northern grouping will contain various pieces of outdoor equipment and will be enclosed with a 10 foot high chain link fence and the fence will contain vertical cedar boards on the north, east, and south elevations and decorative slatting on the west elevation, and WHEREAS, The south/southwest grouping will contain two electrical transformers and 4 taller storage tanks in the rear and this area will also have a 10 foot high chain link fence on the east and south sides and it will contain vertical cedar boards on the two sides, and WHEREAS, The petitioner had a sounds analysis done and it is stated that the dBA level is not expected to exceed 63 dBA at the nearest lot line and as part of the landfill agreement with the City, Veolia cannot exceed 65 dBA and their proposal is within the requirement. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended Building, Site and Operation Plan for Veolia located along 124th St (Tax Key No. 2301.998). BE IT FURTHER RESOLVED, Approvals from the Engineering Division of grading plans are required before the issuance of building permits. BE IT FURTHER RESOLVED, That lighting details must be submitted before building permit can be issued. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
