Mayor Johnson called the meeting to order at 6:00 PM.
Those present recited the Pledge of Allegiance.
PRESENT
Mayor Johnson, Ald. Borgman, Commissioners Hulbert, Stinebaugh, Jacques, and Noah and
Director Muenkel and Recording Secretary McMullen.
ABSENT
Commissioner Burke
Recording Secretary McMullen noted that the meeting was properly noticed on September 3,
2010 in accordance with the Open Meeting Law.
APPROVAL OF THE MINUTES OF THE AUGUST 3, 2010 MEETING Commissioner Jacques
made a motion to approve the minutes of the August 3, 2010 meeting. Commissioner
Stinebaugh seconded. Upon a voice vote, motion to approve the minutes was ADOPTED
unanimously.

NEW BUSINESS FOR CONSIDERATION
RESOLUTION #P.C. 067-2010 — Approval of an amended Building, Site and Operation Plan
for Bauer Sign Company located in the SW 1/4 of Section 16 (Tax Key No. 2223.994.009 / W184
S8408 Challenger Drive). Commissioner Stinebaugh made a motion to ADOPT Resolution
#P.C. 067-2010. Commissioner Noah seconded. Director Muenkel explained this is a BSO for
Bauer Sign Company located off of Enterprise Drive. As part of the Redevelopment District #3
and the property maintenance ordinance Bauer needed to clean up and screen the outdoor
storage needed to operate their business. Bauer is proposing to refurbish two large storage
containers as barriers with fencing and gates. One large storage container will be located to the
east and one storage container will be located on the west with a 14-foot fence to the north and a
gate on the south side. Open trailers will be parked along the west side. Director Muenkel noted
that the Resolution discusses employee and truck parking also, which has been an issue in the
past.
Commissioner Noah explained his only issue is if each tenant in the building would want to use a
different type of screening and suggested there should be one standard type of screening
around the entire area.
Mayor Johnson noted this is the most visible problem in the Business Park and agreed there
should be a standard for fencing. Mayor Johnson explained this screening plan is fine as a
temporary solution, but there should be a more permanent plan. Commissioner Hulbert agreed
and suggested not more than two years for permanent screening. Ald. Borgman stated he
wouldn't want to put a definite date on the tenant and drive them away because of financial
restraints. Mayor Johnson understood, but also feels there should be some standards. Director
Muenkel explained he would make Bauer Sign Co. aware of this requirement because there will
be an expense to refurbish the containers and the CDA has a $500 grant to help with property

maintenance. Commissioner Hulbert added there needs to be a level of quality in the Business
Park. Commissioner Hulbert made a motion to AMEND Resolution #P.C. 067-2010 to read:
BE IT FURTHER RESOLVED, That the Plan Commission approves of an amended Building,
Site, and Operation Plan submitted by Bauer Sign as temporary screening for the outdoor
storage area located at S83 W18622 Challenger Drive (Tax Key No. 2223.994.009).
BE IT FURTHER RESOLVED, That within two (2) years Bauer Sign must submit a
permanent screening plan for the outdoor storage area.
Upon a roll call vote, Resolution #P.C. 067-2010 was AMENDED unanimously. Upon a roll call
vote, AMENDED Resolution #P.C. 067-2010 was ADOPTED unanimously.
RESOLUTION #P.C. 068-2010 — Approval of an amended Building, Site and Operation Plan
for Veolia Environmental Services located in the NE'/4 of Section 2 (Tax Key No. 2165.998.009 /
W144 S6350 College Ct). Commissioner Noah made a motion to ADOPT Resolution #P.C. 068-
2010. Commissioner Stinebaugh seconded. Director Muenkel explained that Veolia, located at
the end of College Court in the Tess Corners Industrial Park, is requesting to remove an existing
vehicle maintenance facility and build a new one. The new building will be similar to the
administration building located on this property. The new building will be 100% masonry with
split face decorate block and painted standard concrete block. The new building proposed is
located closer to the front lot line and to side lot line than the requirements allow. Veolia has
agreed to combine this lot and their adjacently owned lot into one to alleviate the side offset
concern. The front setback requirement is 50-feet and Veolia is proposing 32.5-feet. Plan
Commission approval is based on Zoning Board of Appeals approval or Veolia must vacate the
right of way at the end of College Court and reconstruct the cul-de-sac to give them more room.
Commissioner Hulbert and Stinebaugh both stated the building plans look good. Mayor Johnson
noted that the company is under financial restraints to get this project done this year and
changing the cul-de-sac would take more time. It was the consensus that this project would be a
welcomed addition to this area and a variance would be looked on favorably by the Planning
Commission to help get this project completed. Commissioner Noah added that this project
would clean up the area considerably.
Tim Knepprath, a representative of MSI General, was present and requested that the two lots be
adjoined prior to occupancy instead of building permits being issued. Director Muenkel agreed.
Upon a roll call vote, Resolution #P.C. 068-2010 was ADOPTED unanimously.
RESOLUTION #P.C. 069-2010 — Approval of a Building, Site and Operation Plan for an in-law
suite for Marcelo and Regina Santos located in the NW % of Section 21 (Tax Key No. 2242.016 /
S90 W18724 Acorn Drive). Commissioner Hulbert made a motion to ADOPT Resolution #P.C.
069-2010. Commissioner Noah seconded. Director Muenkel explained the request is for an in-
law unit within the basement of the dwelling at S90 W18724 Acorn Drive. The proposed in-law
unit meets all the City's requirements being; 683 square feet, occupied by relatives, has an
independent wing that is self supporting in livable needs, and is dependent on the utilities from
the primary residence. Neighbors within 100-feet were notified and there were no questions or
complaints received.
Commissioner Hulbert questioned if this should be reviewed every 5 years to see if the situation
has changed. Director Muenkel explained the Assessor has brought forward any listings for
other than an in-law suite if the house goes on the market.

Deb Olson, representative for Kingsway, was present and explained the plans are for a full
kitchen, full bath, and full den. The only requirement to make it an in-law unit is the full range as
opposed to just a microwave. Ms. Olson added the homeowners have relatives from out of the
country that would be staying for an extended amount of time. Upon a roll call vote, Resolution
#P.C. 069-2010 was ADOPTED 5-0, with Commissioner Stinebaugh having to leave the meeting
at 6:30 PM.

The petitioner is proposing to divide one parcel by Certified Survey Map to create four (4) parcels. The
lots range in size from 45,000 square feet (1.03 acres) to 84,598 square feet (1.94 acres). There is a fifth
lot, but since it is a remnant over 20 acres it does not need to be shown on the CSM.
PLAN CONSISTENCY PC 072-2010
Comprehensive Plan: The 2020 Plan depicts the area for Low Density Residential uses. The
proposal is consistent with the Plan.
Zoning: FTheroperty is currently zoned RC-3 — Country Residence District,
requires a minimum lot size of 40,000 SF and average lot width
feet per lot.
Parks and Conservation Plan: The 2007-2011 Plan does not depict any park areas on this site. The
plan does show the wetlands are being a medium priority area. The
wetlands are being preserved along with a 15 foot wetland protection
buffer. The proposal is consistent with the Plan.
Street System Plan: All right-of-way is been dedicated as required.

DISCUSSION PC 072-2010
Upon initial review of the CSM, the bulk requirements of the code appear to be met. Final Engineering
review is pending and any review comments will need to be addressed before the CSM can be recorded.
All Engineering review comments will need to be addressed before the CSM can be signed by the City
and recorded.
Since municipal sanitary sewer is being expanded as part of this project, construction plans, a letter of
credit, and a developer's agreement need to be approved by the City. This CSM cannot proceed for
Common Council approvals until all of these items are ready.
Staff recommends approval subject to meeting all technical corrections received from the Engineering
Department. The Resolution is drafted accordingly.

Upon initial review of the CSM, the bulk requirements of the code appear to be met. Final Engineering
review is pending and any review comments will need to be addressed before the CSM can be recorded.

BACKGROUND PC 070-2010
Naturescape was approved for one mini storage unit in the Muskego Business Park a couple a months
ago by Planning Commission. This past approval included a Conditional Use Grant approval as well.
They are now looking to amend those plans by adding a second, identical, 34-unit mini -storage (self
storage) facility to the overall plan. This development is to all occur on an existing vacant lot within the
Muskego Business Park along Gemini Drive. Naturescape will still use 5-10 units within one of the
buildings for their business equipment storage and the rest of the units will be leased out to the public.
The proposed use requires an amendment to the existing Conditional Use Grant (CUG). A public hearing
for the CUG has been scheduled before the Plan Commission on October 5, 2010.
CONSISTENCY WITH ADOPTED PLANS PC 070-2010
Comprehensive Plan: The 2020 Plan depicts the property for industrial use. The petition is
consistent with the Plan.
The property is zoned M-2, General Industrial District. The proposal

As noted above, the proposal is to construct a second mini -storage facility/building on this vacant lot
within the Muskego Business Park.
Architecture
The proposed second structure will be identical to the Plan Commission approved first structure. The
building is proposed to be clad with a mix earth tone colored river rock, cultured stone, taupe colored
cement board siding, tan fascia and trim, and wood simulated dimensional asphalt shingles.
The front and back elevations are proposed to contain over 50% masonry/stone with the remainder of the
elevation being the cement board siding. The side elevations consist mostly of the overhead doors for
the storage units with cement board siding on the wall areas. There is only about 16" of space in
between each set of doors, once the trim is placed around each door. However, the petitioners are
including masonry in these areas as well.

Some signage details have been provided at this time for a monument sign. It appears that there will
need to be some minor modifications made to the existing sign size and/or location. In general the sign is
of a quality design. A separate formal sign permit will be required to be submitted before the sign should
be ordered/purchased and installed.
Lighting
The proposal states that there will be wall lighting installed on the building. No details or a photometric
plan have been submitted at this time. Final lighting details and a photometric plan will need to be
submitted before building permit can be issued.
Landscaping
A landscape plan has been submitted. The plan appears to show a good amount of plantings throughout
the property. Most of the landscaping is concentrated towards the front of the property, shielding the view
from the street. Formal landscape review is pending and any comments must be addressed before
building permits can be issued. As noted above, additional landscaping should be added along the sides
of the property to help further screen the sides of the building, since there is less masonry/stone on the
side elevations.
Redevelopment District #3
The BSO petition is within Redevelopment District #3. The improvements that are being proposed work
towards the clean-up efforts and goals that the plan identifies. The proposal follows the districts goals.
The CDA approved the amendment to the original plans at their September 2010 meeting.
Miscellaneous
The hours when the business equipment/storage would typically be used would be Sunday -Saturday from
7:00 AM until 5:00 PM and the public access will be accessible 24 hours a day via a keypad entry gate.
No outdoor storage is proposed or allowed on site at any time. The Resolution states that no outdoor
storage or display is allowed on site at any time, including, but not limited to trailers, trucks, cars,
materials, boats, campers, etc.
The development is served by City sewer and water. The proposal is near the size that may require a
storm pond. Review from the Engineering Division is pending and any Engineering comments must be
fully addressed before building permits can be issued.
Any dumpsters/refuse containers and any mechanical devices must be screened with proper screening
devices that must be approved by the Planning Division.
The Resolution also states the following conditions of approval:

Proposed Naturescape Self -Storage
Naturescape is purchasing an additional 70 feet to the east of our existing site (Lot 2) that
will have a self -storage on it. Naturescape is proposing to build an identical 34-unit self -
storage on the remainder of the existing site as well as part of the additional 70 feet while
maintaining all proper setbacks. The buildings will be identical to provide a cohesive,
uniform site. Naturescape will use between 5 and 10 units with the remaining leased out.

9. INSTALL BASE COURSE OF ASPHALT PAVEMENT.
10. FINISH BIORETENTION BASIN CONSTRUCTION INCLUDING DRAINTILE,
ENGINEERED SOIL AND PLANTINGS.
11. FINAL GRADING OF SLOPES, TOPSOIL, CRITICAL SLOPES; VEGETATE
AND MULCH/MAT ALL DISTURBED AREAS.
12. ALL EROSION CONTROL PRACTICES WILL BE INSPECTED WEEKLY AND
AFTER RAINFALL, NEEDED REPAIRS WILL BE PERFORMED IMMEDIATELY.
13. AFTER SITE IS STABILIZED, REMOVE ALL TEMPORARY MEASURES AND
VEGETATE THE DISTURBED AREAS.
14. ESTIMATED TIME BEFORE FINAL STABILIZATION - 6 MONTHS.
MAINTENANCE PLAN
1. ALL EROSION AND SEDIMENT CONTROL PRACTICES WILL BE
CHECKED FOR STABILITY AND OPERATION FOLLOWING EVERY
RUNOFF -PRODUCTION RAINFALL BUT IN NO CASE LESS THAN ONCE
EVERY WEEK. ANY NEEDED REPAIRS WILL BE MADE IMMEDIATELY TO
MAINTAIN ALL PRACTICES AS DESIGNED.
2. SEDIMENT WILL BE REMOVED FROM BEHIND THE SILT FENCE WHEN
IT BECOMES ABOUT 0.5 FT. DEEP AT THE FENCE. THE SILT FENCE
WILL BE REPAIRED AS NECESSARY TO MAINTAIN A BARRIER.
3. ALL SEEDED AREAS WILL BE FERTILIZED, RESEEDED AS NECESSARY,
AND MULCHED ACCORDING TO SPECIFICATIONS IN THE VEGETATIVE
PLAN TO MAINTAIN A VIGOROUS, DENSE VEGETATIVE COVER.
4. ANY SEDIMENT REACHING A PUBLIC OR PRIVATE ROAD SHALL BE
REMOVED BY STREET CLEANING BEFORE THE END OF EACH DAY.

1. Construction silt fence around the disturbed
areas as shown on Erosion Control Plan, to
prevent sediment from being washed into
the drainage system.
2. Locate posts per DNR CPS (1056)
3. When joints are necessary, refer to
DNR CPS (1056).
4. Filter fabric to be of nylon, polyester,
propylene or ethylene yarn with extra
strength - 50 LB/lin. in. (Minimum) -
and with a flow rate of at least 0.3 gal./sq. ft./min.
Fabric should contain ultraviolet ray inhibitors
and stabilizers.
5. The filter fabric shall be anchored by spreading
at least 8 inches of fabric in a 4' x 6' trench.
6. The filter fabric shall be stapled and/or
nailed to the upslope side of the posts.
7. Post to be 1 1/8% 1 1/8" hickory or oak, 3 feet long, spaced
a maximum of 3 feet apart.
8. Use wire reinforcement in unstablilized minor swales,
ditches or diversions.
