OUTLOT STATEMENT
Each individual lot owner shall have an undividable fractional ownership in Outlot No. 1 & 2. Also,
Waukesha County shall not be liable for any fees or special assessments in the event they become
the owner of any lot or outlot in the subdivision by reason of tax.
BASEMENT RESTRICTION -GROUNDWATER
Although all lots in this plat have been reviewed and approved for development with single-family
residential use in accordance with Section 236 Wisconsin Statutes, some lots may contain soil
conditions which may require additional soil engineering and foundation design with regard to
basement construction. it is recommended that either a licensed professional engineer or other
soils expert design a basement and foundation which will be suitable to withstand the various
problems associated with saturated soil conditions on basement walls or floors or that special
measures be taken. Soil conditions should be subject to each owner's special investigation prior to
construction and no specific representation is made herein.
VISION CORNER EASEMENTS:
The height of all plantings, berms, fences, signs, or other structures within the easement is limited
to 24 inches above elevation of the center of the intersection. No access to any roadway shall be
permitted within the vision easement.
PRESERVATION EASEMENT. -
The Developer will protect the preservation areas with a split -rail fence (see Notes) in the location
shown on the plat. The fencing must be maintained by the individual lot owners in perpetuity and
shall not be removed.
DRAINAGE EASEMENTS:
The drainage easements designated by the words, "...Drainage Easement" on Sheet 1 of 2 shall be
maintained by the owners of each lot that is burdened by such easement. Specifically, the owner
of a lot where an easement is located shall maintain said easement located on such lot in an
unobstructed condition so as to maintain its intended purpose. Construction of any building,
grading or filling -in said easement is prohibited. In the event such property owner does not
properly preserve or maintain the drainage easement area, the City of Muskego may send written
notice to the lot owner indicating that the City has determined that that the drainage easement is
not being properly preserved or maintained, and further indicating that the City of Muskego will
perform such correction of the drainage easement area and/or maintenance if not properly done by
lot owner. The above -referenced notice shall give the lot owner a minimum of seven (7) days to
correct the problem, unless the City determines that a shorter period of notice, or no notice, is
necessary due to exigent circumstances, the City of Muskego shall then have the authority, but not
the obligation, to restore the drainage easement area and/or maintain any such drainage easement
area referred to in said notice and shall have the right to charge the lot owner for any costs
incurred buy the City as a result of said restoration and/or maintenance. The City's rights of
restoration shall include the right to remove any obstructions placed by the lot owner within the
drainage easement area. Said costs shall be assessed as special charges pursuant to Section
66.0627, Wisconsin Statues. If such charges are not paid by any lot owner within the period fixed
by the City of Muskego, the charges shall become a lien upon the owner's lot as provided in
Section 66.0627, Wisconsin Statues, and shall extend upon the tax rolls as a delinquent tax against
the lot owners as provided in Section 66.0627, Wisconsin Statues.

PRESERVATION EASEMENT RESTRICTIONS
The Preservation Easement includes all of Outlot 1 and those portions of Lots
1-5 north of the 30' Drainage Easement.
Those areas of land identified as a Preservation Easement on this Page of this
Subdivision Plat shall be subject to the following restrictions:
1. Grading, filling, the removal of topsoil or other earthen materials are
prohibited, except with the specific approval of the municipality in which the
property is located within.
2. The removal or destruction of any vegetative cover, i.e., trees shrubs,
grasses, etc., is prohibited, with the exception that dead, diseased, or dying
vegetation and invasive species may be removed, at the discretion of the
landowner and with approval from the municipality in which the property is
located. Silvicultural thinning, upon the recommendation of a forester or
naturalist and with approval from the municipality in which the property is
located shall be permitted.
3. Grazing is not allowed in these areas
4. The introduction of plant material not indigenous to the existing
environment of the Preservation Easement
