Conservation Commission -Minutes-20020612 Conservation Commission City of Muskego Minutes of Meeting Held on Wednesday June 12, 2002 Approved Chairman Len Pilak called the meeting to order at 7:01 PM. Committee members Len Pilak, Howard Schneider, Gary Stewart, Alderman Salentine and Conservation Coordinator Tom Zagar were present. Henry Posbrig was absent. Conservation Intern Marisa Pankowski and Jim Doering representing Towne Realty also attended the meeting. Those present recited the Pledge of Allegiance. Len Pilak noted the meeting was posted on June 10, 2002 in accordance with the Open Meeting law. APPROVAL OF PREVIOUS MEETING’S MINUTES – A motion was made by Howard Schneider to approve the minutes of the April 17, 2002 meeting, seconded by Alderman Salentine and carried by all. OLD BUSINESS - none NEW BUSINESS QUIETWOOD CREEK EAST SUBDIVISION – OUTLOT 3 AND OUTLOT 4 – Tom Z. discussed with the commission a preliminary plat of Quietwood East Subdivision. Alderman Salentine motioned to approve recommendation to Plan Commission and Common Council that the City require the reservation of these outlots for public acquisition within 3 years of final plat, as permitted by Chapter 18 and Chapter 236 of Wisconsin Statutes. Seconded by Gary Stewart and carried by all. CANDLEWOOD CREEK – The commission reviewed the final plat of Candlewood Creek Subdivision and memo stating the following: The Commission to recommend to Plan Commission and Common Council that the City defer the reservation of outlot 5 and outlot 6 for public acquisition until such time as the final plat of the future addition is submitted and Developers Agreements are drafted accordingly. After discussion, Gary Stewart moved to approve recommendation to Plan Commission and Common Council to read with the following change: That the City defer the reservation lands within outlot 5 and outlot 6 for public acquisition until such time as the final plat of the future addition is submitted and Developers Agreements are drafted accordingly. Motion was seconded by Howard Schneider and carried by all. RECOMMENDATION TO APPROVE A CONDITIONAL USE GRANT FOR RUSTIC STRUCTURES – Jim Doering of Towne Realty explained the request for “Rustic Structure” designation for two outbuildings on a 5 acre parcel located in the SW ¼ of Section 13 (part of Tax Key No. 2211.999 / W131 S8489 Durham Drive. The Conservation Commission is required to forward recommendation to the Plan Commission for conditional use designation on rustic structures. Gary Stewart questioned the structures being located in the public right- of-way. Jim Doering stated the building department has issued Revocable Occupancy Permit Conservation Commission Meeting June 12, 2002 Page 2 for the encroaching structures. Jim Doering stated the Conditional Use status would be subject to annual review by the Planning Commission. Len Pilak motion recommendations to approve rustic structures conditional use grant for the property located at W131 S8489 Durham Drive. Seconded by Alderman Salentine and carried by all. MISCELLANEOUS BUSINESS: DNR ACKNOWLEDGEMENT OF CITY GIFT – The City received a certificate of appreciation from the Natural Resources Board thanking the City for its generous donation of $135,000 toward the purchase of 43.62 acres of land (Weber and Ladwig parcel) located on Boxhorn Drive. This land is located within the DNR Big Muskego Lake Wildlife Area project area. NEXT MEETING DATE – At this time the commission did not set a date for the next meeting. ADJOURNMENT Being no further business to discuss, Howard Schneider moved to adjourn, seconded by Len Pilak and carried by all. Meeting adjourned at 7:50 PM.
