Commuinity Development Authority - MINUTES - 8/17/2010 CITY OF MUSKEGO Approved 9/21/10 COMMUNITY DEVELOPMENT AUTHORITY (CDA) MINUTES TUESDAY, AUGUST 17, 2010 Chairman Glazier called the meeting of the Community Development Authority to order at 6:00 p.m. Those in attendance recited the Pledge of Allegiance. STATEMENT OF PUBLIC NOTICE The meeting was posted in accordance with the Open Meeting Law. PRESENT: Commissioners Kathy Chiaverotti, Rob Glazier, Gail Konkel, Larry Lefebvre, Steve Whittow, Ald. Harenda, Ald. Soltysiak and Executive Director Muenkel GUESTS: Ald. Borgman, Heidi Lindhorst, Leonard Mueller APPROVAL OF THE MINUTES OFJULY 20, 2010 Ald. Harenda moved to approve the minutes of July 20, 2010 meeting Ald. Soltysiak seconded. Upon a voice vote, the motion to approve the minutes carried. PUBLIC INPUT: None. OLD BUSINESS Resolution for an amendment to the Redevelopment District #2 Plan Executive Director Muenkel stated the following changes had been made to the document:  Removed the Lindhorst parcel from the boundary areas.  Removed references to Bring Back the Lake and the associated ACDO.  Changed Table 1 back to original format.  Added the Bay Breeze condominium parcels to the boundary area. One outstanding issue remaining is whether or not the CDA wanted to include residential parcels, basically those existing along Janesville Road, from Pioneer Drive west to Racine. One benefit of the inclusion of these properties would be making grant programs available to the property owners to encourage them to enhance their property making the Janesville Road corridor a cleaner, aesthetically pleasing environment. Chairman Glazier refreshed the commissioners on the discussion from the previous meeting relative to residential properties being included in the district. Commissioner Chiaverotti moved to include the residential properties in the new RD #2 Plan boundary that are along Janesville Road as they were included in Pioneer and they were included in Redevelopment District #1. Commissioner Lefebvre seconded. Ald. Soltysiak voiced his objection to including the residential properties along Janesville west to Racine as he felt the core purpose was to help redevelop the downtown area, or what is perceived as the downtown area. He would like to keep the district as it is or just improve the commercial entities that are going to be affected by the Janesville Road reconstruction and to also concentrate on the other developments that are in the city, putting energy and resources towards those while Janesville is being worked on for the next two years. Commissioner Chiaverotti commented that the district has called for mixed-use, commercial and residential and her research revealed that people like to do remodeling and changes during road construction, not after. She thought the timing was good. Further, it is the main drag and they want it to look good whether it is residential or business property. Commissioner Lefebvre stated he would like to settle the issue and it would be in place for those that want to do something, not tell them they have to wait the two years or when construction is going on. After reviewing it and thinking about it, Ald. Harenda could see adding in the Pioneer Drive; but as far as going west of Pioneer, he was not too much in favor because there are more residential than businesses. Looking at the CDA Minutes Page 2 August 17, 2010 existing district, adding Pioneer, attaching DJs, taking out the Lannon Drive area, he was not too much in favor of extending it at this time. He was okay with residential properties, but the boundaries were a problem for him. He was not in favor of going west. He mentioned that the CDA could always amend the plan in the future. Chairman Glazier said the CDA would have to resolve first having the residential properties in the district and then address the boundaries. Commissioner Whittow asked if the majority of those, west of Pioneer, that attended the public hearing were affected by it. He was under the impression that they did not want to be included in the district. Commissioner Chiaverotti clarified that there actually was only one resident and they were okay with being included; the others were from the Bay Breeze condominiums. Commissioner Konkel asked what are the benefits and what are the potential risks to the residential property; if the benefits are few, and the risks would be the same for the residential property owner whether in the district or not. A developer could come to them whether they are in or out of the district. She would like to think that if they were in the district, the developer would have to come to the CDA and would need to comply with design guides, etc. She thought there would be more protection being in the district than out. CDA members had a lengthy discussion on residential properties being in the district and how it would impact the CDA grant/loan program funds. Chairman Glazier reminded the members that the purpose of expanding this redevelopment district was to be able to reach the corner on Racine Avenue and not have to create yet another redevelopment district there. At that time, he did not think the CDA members were thinking ahead as to the purpose of having residential properties in the district. Commissioner Lefebvre pointed out that expanding it to Racine Avenue closes the gap to the industrial park. The fact that there are residential properties now along a route that may become a boulevard and probably over the years, those residential properties will change. It puts the CDA in a position for the future so why not do it now, than wait a few years and then have to come back and look at it again. Commissioner Konkel thought the issue was whether they were going to include residential properties in redevelopment plans. Commissioner Chiaverotti simplified that there is a road construction project from Moorland to Racine and it doesn’t stop at Pioneer. It’s going to be a redeveloped road with a new look so every property along the route should have the opportunity to spruce up their property. Upon a voice vote, the motion carried with Ald. Harenda and Ald. Soltysiak opposed. Commissioner Lefebvre moved to approve Redevelopment District #2 resolution based on changes that staff has made and what has been discussed this evening including the previous motion about including the residential properties. Commissioner Konkel seconded. Commissioner Lefebvre restated that district #2 should go all the way to Janesville whether it’s residential or not and this prepares the CDA for the future and it can be changed. Commissioner Whittow commented that he saw good and positive changes as a result of the road project. He had no problem with residential properties being in the district. He was leaning towards keeping the boundaries the same because it makes sense in this case. Commissioner Chiaverotti alluded to the fear that residential property owners may have regarding businesses being developed and rezoning and also added that the grant/loan programs would be good for the residential owners, but suspected that many would not take advantage of it. It will give them an opportunity to do something to make their property look nicer. Commissioner Konkel was concerned about setting a precedence based on a road and not on merit as a redevelopment district. Ald. Harenda and Ald. Soltysiak reiterated their previous comments on the issue. CDA commissioners also discussed adding the commercial entities at Janesville/Racine area into the business park as better use of the CDA time and money. Chairman Glazier stated that the boundaries are flexible and they can amend existing districts in the future. He would prefer to move forward with the development district in place and the initial discussion was to go to Racine Avenue. He had no problem with having residential properties in the district. Motion was withdrawn. Commissioners continued their discussion on what properties to be included in the redevelopment district. Ald. Harenda moved to approve Redevelopment District #2 resolution based on changes that staff has made, however, removing the parcels in the proposed RD#2 boundary that are west of Pioneer Drive with the exception of including the DJs Pub & Grill parcel. Ald. Soltysiak seconded. Once again, commissioners discussed the commercial entities at Racine/Janesville becoming a part of the business park. Commissioner Chiaverotti pointed out the P&L Insurance was not considered in the motion. Upon a roll call vote, the motion CDA Minutes Page 3 August 17, 2010 failed 2 for and 5 opposed—Commissioners Lefebvre, Chiaverotti, Whittow, Glazier, Konkel. Ald. Soltysiak moved to approve Redevelopment District #2 resolution based on changes that staff has made, however, removing the parcels in the proposed RD#2 boundary that are west of Pioneer Drive with the exception of including DJs Pub & Grill and the P&L Insurance parcels. Ald. Harenda seconded. Commissioner Konkel stated that all businesses, Pioneer east, would be included, except for those at Racine. Ald. Harenda said it was the similar to the previous motion with P&L Insurance being included. Commissioner Lefebvre suggested to have district #2 as outlined and leave out the residential area, including all the way to Janesville Road. Upon a roll call vote, the motion failed 3 for and 4 opposed—Commissioners Glazier, Lefebvre, Whittow, Chiaverotti. Chairman Glazier moved to approve Redevelopment District #2 resolution based on the changes that have been offered up by staff and adopting the original boundaries as they are outlined on the submitted map to Racine Avenue. Commissioner Lefebvre seconded. Chairman Glazier offered it’s the CDA’s redevelopment district and they can promote residential redevelopment in the district or promote commercial redevelopment and this would all be in one clean, contiguous boundary. Commissioner Chiaverotti commented that CDAs do redevelopment in residential districts all the time. The business district on this road calls for mixed use because that’s what keeps them thriving. They want residential to stay, to take care of their properties, to look good. Ald. Soltysiak said it is now a road that they are focusing on and not a downtown area; it is too broad. Chairman Glazier stated that the CDA would have to scrutinize requests/plans that come forward. They can create the focus around the businesses. Upon a roll call vote, the motion passed 5 for and 2 opposed—Ald. Harenda, Ald. Soltysiak. RD#1 Amendment Adoption Process Executive Director Muenkel went over the plan that was handed out at the July meeting. He brought before the commissioners a survey to send out to the property owners and tenants in the redevelopment district. He would like to have the survey results back by the September meeting. Ald. Harenda moved to direct Executive Director Muenkel to follow through with the survey. Ald. Soltysiak seconded. Ald. Soltysiak recommended that a better response may be brought by having the survey hand delivered. Executive Director Muenkel said he could stop by as well as send them in the mail. Other commissioners suggested a follow-up phone call, however, Ald. Soltysiak thought the personal touch would show the owners how serious the CDA was about the survey. Commissioner Konkel asked if the CDA would be including the residential properties in the district as the previous survey was for the business park and will there be a discussion with them on what they want. Executive Director Muenkel mentioned that the other avenue would be a public hearing and maybe put more information in the public hearing notice. Chairman Glazier said they are focusing on the business owners to promote commercial development. Upon a voice vote, the motion carried. NEW BUSINESS Muskego Business Park Grant Approval (Wesco Machine / Tax Key No. 2223.994.008). Executive Director Muenkel presented Wesco Machine’s request for a grant of $500 to offset some of their costs for completely enclosing the east wall of their building. Commissioner Chiaverotti moved to approve the $500 grant for Wesco Machine. Commissioner Whittow seconded. Mr. Mueller was present and spoke to the commissioners on his appreciation for their help. He also gave his thoughts on city mandates and what it costs the business owners to comply with the city’s request. You can’t mandate something and not expect repercussions to occur. Upon a voice vote, the motion carried. TIF Residual Fund Clarification. Executive Director Muenkel shared with the CDA commissioners that the funds may be used for whatever purpose the Council decides. The funds are controlled by the Council. In 2008, the Council did earmark some of the funds for various grant/loan programs that the CDA may develop. Toolkit to Surviving the Road Construction CDA Minutes Page 4 August 17, 2010 Commissioner Chiaverotti announced that there is information available from the DOT on what other businesses did to lessen the impact of major road construction on their businesses. She mentioned creation of some teams:  Create a campaign to bring people to their doors during construction with a logo  Create events and activities to get patrons to their door  Fund-raising group to pay for marketing and advertising for the events She said that Sandy Hoorman is spearheading the fund-raising and will be at future CDA meetings. Commissioner Chiaverotti felt the CDA grant/funds could be used for this purpose and what the criteria would be for funds used for the marketing/advertising. Commissioner Konkel if it would be a viable use for the CDBG funds. Executive Director Muenkel will check on it. MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Redevelopment District Development Updates Nothing aside from what was discussed earlier in the meeting. Commissioner Konkel asked if CDBG funds could be used for flooding issues. Executive Director Muenkel will try and find out what the parameters are for the use of the CDBG funds. The next meeting date will be determined, but tentatively scheduled for September 21. ADJOURNMENT: There being no further business, Commissioner Whittow moved for adjournment, Commissioner Chiaverotti seconded. Upon a voice vote, the motion carried unanimously.
