Tuesday, December 5, 2006 Chairman Frank Waltz called the meeting of the Community Development Authority to order at 6:00 p.m. Those in attendance recited the Pledge of Allegiance. The meeting was posted in accordance with the Open Meeting Law. PRESENT: Commissioners Rob Glazier, Suzi Link (6:04 p.m.), Gail Miles, Frank Waltz, Alderman Nancy Salentine, Alderman Chris Buckmaster and Executive Director Jeff Muenkel ABSENT: Commissioner Dave Lidbury GUESTS: Ald. Borgman, Mike Dilworth (Ener-con Co.), Bob Hoorman (Tri Town Heating), Justin Johnson (McClure Engineering, Milwaukee, WI), Mayor Johnson, CNI Reporter Denise Lockwood, Paul Meier (Paul Meier, Inc.) APPROVAL OF MINUTES Alderman Salentine moved to approve the minutes for the October 17, 2006 meeting. Commissioner Glazier seconded . Upon a voice vote, the motion carried. In response to Ald. Salentine’s inquiry, Executive Director Muenkel said that the loan for Stella & Chewy’s LLC went through okay. They closed on it yesterday. Just need to get a signature from the Mayor and Clerk- Treasurer in the next couple of days. OLD BUSINESS — None NEW BUSINESS Approval of a Building, Site and Operation Plan and Rezoning for Parkland View Development located in Redevelopment District #2 (Tax Key Nos. 2198.991.002, 2198.991.003, & 2198.992 / Janesville Road). Executive Director Muenkel provided a supplement for the Parkland View Development and reviewed in detail how the development met with the guidelines for the Redevelopment District #2. He mentioned that it would be going before Plan Commission in January. A full submittal, including site plans, color renderings, photometric plan for the lighting, landscape plans, full building elevations, was received from the developer. The plans showed the condominium plat, the retail area and the residential units. A CSM (Certified Survey Map) is also provided to dedicate right-of-way on Janesville Road. The property is along Janesville Road between Mobil gas station and the Assist-to-Sell building, directly across from the library. This site was owned by the City of Muskego (City) for storm water purposes. Common Council turned the site over to the CDA to allow a mixed-use development on the site. Now, with the developer, the CDA is trying to make the mixed-use development happen. It is a mixed-use development with 31-unit condominium building with retail office building in front. It has a 10-foot setback from the right-of-way which is new to the City and it is something they are looking to promote through the redevelopment plan consistent with traditional neighborhood development. The parking area is behind the building. In front, will be the pathways to connect to the Janesville Road trail in the future. Commissioner Miles asked if the Janesville Road widening would have any affect on the narrower setback. Executive Director Muenkel said it would be designed appropriately for within the right-of-way either as the Common Council directed for either boulevard section or cross-access section with trails and landscaping. CDA Minutes December 5, 2006 - page 2 Commissioner Link inquired if there was a mechanism for running this by the county to make sure there is a reasonable assurance for this. Executive Director Muenkel said the county would receive the development documents within the next month and certified survey maps will be provided to the county. Executive Director Muenkel continued that the development does relate to the vision of the redevelopment district. It met with the key planning elements on design character, use mix and density. He further explained the need for rezoning to B-4/OPD/OWP (Highway Business District with a Planned Development Overlay with a Wellhead Protection Overlay) to allow the following:  Spreading the density of the proposed 31 units of residential over the entire zoning district area. The Planned Development zoning area covers over 6.5 acres of land resulting in allowing approximately 60 units (under the RSM zoning density of at least 5,000 of land area per unit). Only 31 units are proposed to allow good site planning for the given developable area.  Allowing the height of the structure as measured by code (midpoint of the highest gable between the peak of the roof to the trough line) to be 34 feet. This is 4 feet above the B-4 code requirement of 30 feet.  Allowing the structure to have a 10-foot setback along Janesville Road which is 30 feet closer than the B-4 code requirement of 40 feet. The smaller setback is encouraged by the City Redevelopment District guide to promote Traditional Neighborhood Development of putting buildings closer to the roadway and hiding traffic and parking behind. Executive Director Muenkel advised the commissioners that the landscape plan had met with the approval of the city forester by meeting all specifications. The lighting would be unified lighting through the site for the pole lights and architectural up/down lights along the retail center and the building itself. The lights do meet the code being high-pressure sodium. Commissioner Suzi Link moved to accept the building, site, and operational plan and rezoning for the Parkland View development site. Ald. Salentine seconded. Ald. Salentine would like to see the lights along the street be decorative streetlights to match the library’s lights. The city had requested this of Arby’s development. This would be the streetlight on the west side of the 170-foot building along Janesville Road. The developer did not see a problem with this request. Commissioner Link suggested this request be incorporated into the downtown design guide so it would not have to be addressed on a predevelopment per development basis. She said as businesses come in or as buildings are proposed, they would have this information and come into conformity for street lighting. On the entrance, Ald. Buckmaster asked how that would relate to the widening of Janesville Road. Executive Director Muenkel said the county wanted minimal access as possible to Janesville Road. Right now, the property has two entrances but it will be down to one single access. Ald. Buckmaster felt that the fire department and its access would be discussed at Common Council. Executive Director Muenkel said relative to the fire code and their access lanes, they had worked with the fire department on this the past year. There are parts of the plan that would need to have extra width and it would not affect the development. Commissioner Miles expressed her concern about not having a curb cut (turning lane) planned on this major arterial. Traffic could be backed up waiting for turns into the development. There should be some attempt to move the traffic off the road. Executive Director Muenkel will see if the county has any recommendations when they review the plan. It may not be warranted according to the county’s standards. In regard to the fire department, Commissioner Link said they bought into a five-story building a block and a half away, she did not think this would be a big issue. On the traffic issue, Ald. Buckmaster asked if the development would be before or after the Janesville Road project. He stated that the area of development is one of the worst spots for traffic on Janesville Road (between Bay Lane and Parkland). He thought that Plan Commission would address this issue. Commissioner Miles asked about the location of the dumpster. On the site plan, Executive Director Muenkel pointed out it would be in the northeast corner. She also asked what material would be used for the awnings. Mr. Meier said it would be fabric. She further asked if they had any potential tenants for the retail space. Mr. Meier said none and explained that he was waiting to see if the development was approved before actively marketing the site. However, the Assist to Sell business may be moving from the building being torn down to the new retail/office structure. Commissioner Link felt the architecture would blend very well with what is in the area. While it is going to three stories, it increases in elevation as approaching the downtown and is part of the original plan CDA Minutes December 5, 2006 - page 3 the community wanted. Commissioner Glazier expressed his concern about not having clients for the retail area as there are allot of empty retail spaces in the City of Muskego. However, as the development stands, he did like it. No other discussion. Upon a voice vote, the motion carried unanimously. Executive Director Muenkel advised the public hearing would be next Tuesday at 7:30 p.m. in the Muskego Room. PUBLIC INPUT — There was no public input. MISCELLANEOUS BUSINESS AS AUTHORIZED BY LAW Approval of City of Muskego TID Guidelines Executive Director Muenkel updated the commissioners that the Plan Commissioner deferred this item at the last meeting to allow the members to read them one more time. They might be adopted at this night’s Plan Commission meeting. The guidelines may go before the Common Council the next month. Chairman Waltz refreshed the members that at their last meeting, they had gone through the guidelines line by line and provided a number of suggestions. Executive Director Muenkel stated he had put all the suggestions together and emailed them out to everyone. Their response was the suggestions were fine. The next meeting date to be determined. ADJOURNMENT: There being no further business, Ald. Buckmaster moved for adjournment, seconded by Commissioner Link. Upon a voice vote, the motion carried unanimously.
