COMMON COUNCIL Minutes 02-11-1997COMMON COUNCIL - CITY OF MUSKEG0 (CORRECTED) MINUTES OF THE MEETING HELD FEBRUARY 11, 1997 The meeting was called to order at 8:16 P.M. by Mayor De Angelis. Also present were Aldermen Patterson, Pionek, Rasmussen, Salentine, Sanders, and Suhr, City Attorney Molter, Clerk-Treasurer Marenda, Planning Director Sadowski and Deputy Clerk Blenski. Alderman D'Acquisto was absent. The Clerk-Treasurer reported that the meeting was noticed in accordance with the Open Meeting Law on 2/1/91. Patterson moved for approval of the minutes of the 1/28/91 meeting. Salentine seconded, carried. Clerk-Treasurer read the Notice of Closed Session. Office. The Mayor had nothing to report under Communications from the Mayor's Ord. #921 - An Ordinance to Amend the Zoning Map of the City of Muskego from RS-2 to RS-2/0D (Miller). First Reading. Rasmussen proposed for the parcel. Mayor stated that a determination needs to requested developer provide the footprint and pictures of what is be made if another public hearing is required for the OPD designation. Salentine supports the OPD as recommended by the Plan Commission. Attorney Molter stated in the past the City has adopted a resolution approving the concept to rezone for projects with an QPD designation, with action on the final rezoning occurring later. Ord. #920 - An Ordinance to Amend Chapter 14, to Add Section 1.5 Zoning Ordinance: Official Map (Ryback). First Reading. No (2)(m) of the Municipal Code of the City of Muskego. Floodplain additional information was requested. Plan Director Sadowski was excused at 8:30 P.M. COMMITTEE REPORTS Suhr moved for acceptance of the 2/5/91 and 2/11/91 minutes of the Finance Committee Meetings. Rasmussen expressed concern that item regarding compensation for Clerk-Treasurer was deferred. Mayor responded the Committee believed the entire Council should be involved in the discussion. Sanders seconded, carried. Patterson moved for acceptance of the 2/3/91 minutes of the Public Services Committee Meeting. Pionek seconded. Patterson moved for individual consideration of paragraph regarding Cable TV to be sent back to Committee for clarification. Pionek seconded, carried. Motion to approve minutes without said paragraph carried. Suhr moved for acceptance of the 1/21/91 & 11/14/96 (deferred seconded, carried. 11/26/96) minutes of the Public Works Committee Meeting. Pionek Board Meeting were received and placed on file. Minutes of the 2/4/91 Plan Commission Meeting and 1/22/97 Library OLD BUSINESS Ord. #912 - An Ordinance to Amend Chapter 9, Section 9.03 (2), of the Municipal Code of the City of Muskego (Sale of Fireworks). On the Common Council Minutes February 11, 1997 Page 2 floor, deferred 1/28/97. Patterson moved to defer. Suhr seconded, carried. Ord. #913 - An Ordinance to Amend Chapter 17, Section 6.04 (4) G. 5. Muskego (Trailers). On the floor, deferred 1/28/97. Patterson moved and Chapter 12, Section 12.10 of the Municipal Code of the City of to amend to remove the word "permanent." Pionek seconded. Suhr asked that any habitation, even temporary, is prohibited. Motion carried. for rationale. Patterson stated removing the word permanent clarifies Ord. #913, as amended, carried 6-0. Ord. #917 - An Ordinance to Amend Chapter 29, Sections 29.03 and 29.09 Second Reading. Patterson moved for adoption. Pionek seconded. (1) of the Municipal Code of the City of Muskego (Erosion Control). Carried 6-0. Ord. #918 - An Ordinance to Amend Chapter 8, Section 8.01, Section 8.01 (1) of the Municipal Code of the City of Muskego (Street Widths). Second Reading. The amendment reduces the ultimate right-of-way of Ryan Road, west of Boxhorn, from 80' to 66'. Salentine moved for adoption. Sanders seconded. Carried 6-0. Reso. # 7-97 - Approval of Certified Survey Map - Meinen. On the floor, deferred 1/28/97. Motion to adopt carried 7f0 6-0. NEW BUSINESS Reso. #19-97 - Amended and Revised Final Resolution Authorizing Against Benefited Property (Loomis Road/Drive Sewer Project MSS-1A-96) Installation of Sewer Improvements and Levying Special Assessments Sanders moved for adoption. Rasmussen seconded. Carried 6-0. Reso. #20-97 - Approval of Certified Survey Map - Fenger. Salentine moved for adoption. Sanders seconded. Carried 6-0. Norway. Salentine moved for adoption. Suhr seconded. Carried 6-0. Reso. #21-97 - Approval of Certified Survey Map - Bettinger, Town of Reso. #22-97 - Determination of Substantial Change to the Lake Forest Planned United Development. Salentine moved for adoption. Sanders seconded. Pionek noted that the Council previously denied access to Sunset Drive. Carried 6-0. Reso. #23-97 - Support of and Authorization to Execute 1997 Nonpoint Source Pollution Abatement Program Under the Muskego Priority Watershed Grant. Sanders moved for adoption. Suhr seconded. Carried 6-0. Reso. #24-97 - Approval of Temporary Habitation of Trailer. Patterson moved for adoption. Pionek seconded. Carried 6-0. Reso. #25-97 - Resolution to Establish Fee ($40 Minimum Plan Review Fee). Suhr moved for adoption. Sanders seconded. Carried 6-0. Reso. #26-97 - Resolution of Support for the Mediation Center of Waukesha County. Salentine moved for adoption. Sanders seconded. Mayor stated there were 3 referrals from the City and 24 other residents utilized this service in 1996. Carried 6-0. Carried 6-0. Reso. #28-97 - Resolution Acknowledging the Muskego High School Cheerleading Squad. Patterson moved for adoption. Salentine seconded. Carried 6-0. Ord. #919 - An Ordinance to Amend the Zoning Map of the City of Muskego from EA to RS-1 (Stefaniak). First Reading. 0 LICENSES Suhr moved for approval of Operators' Licenses for Jill Protzman, Robert Scaffidi, Deanna Mecha, Joshua Briggs and Lisa Albritton. Salentine seconded, carried. Suhr moved for approval of "Class B" Alcohol and Beer License for B. J. Macks, Inc. (J. C. Hammers) subject to conditions placed by Finance Committee and referred to in the 2/5 and 2/11 minutes. Sanders seconded. Carried 6-0. VOUCHER APPROVAL Sanders moved for approval of General Vouchers in the amount of $439,154.53. Suhr seconded. Carried 6-0. Sanders moved for approval of Utility Vouchers in the amount of $89,698.04. Rasmussen seconded. Carried 6-0. Sanders moved for approval of Tax Checks in the amount of $13,629.94. Suhr seconded. Carried 6-0. Sanders moved to convene into Closed Session pursuant to S19.85(l)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, more specifically dispute over sewer connections with Town of Norway Sanitary District. Salentine seconded. Carried 6-0. Deliberating or negotiating the purchasing of public properties, the Rasmussen moved to convene into Closed Session pursuant to §19.85(l)(e) investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically acquisition of Parkland Mall. Suhr seconded. Carried. 6-0. The Clerk-Treasurer and Deputy Clerk were dismissed at 9:20 P.M. The Council reconvened into Open Session and Suhr moved to adjourn at 1O:lO P.M.
