COMMON COUNCIL Minutes 01-14-1997COMMON COUNCIL - CITY OF MUSKEGO MINUTES OF THE MEETING HELD JANUARY 14, 1997 Approved 1/28/97 The meeting was called to order at 0:47 P.M. by Council President D'Acquisto who chaired the meeting in the absence of Mayor De Angelis. Planner Sadowski and Deputy Clerk Blenski. Sanders, and Suhr, City Attorney Molter, Clerk-Treasurer Marenda, The Clerk-Treasurer reported that the meeting was noticed in accordance with the Open Meeting Law on 1/10/97. Suhr moved for approval of minutes of the 12/10/96 and 12/30/96 meetings. Salentine seconded, carried. Suhr moved for approval of the 12/5/96 Joint Council/School Board meeting. Salentine seconded, carried. The Clerk-Treasurer read the Notice of Closed Session. @ Also present were Aldermen Patterson, Pionek, Rasmussen, Salentine, b I COMMUNICATIONS FROM THE MAYOR'S OFFICE Appointments to Lake Access Review Committee were not made as the Mayor was not present. D'Acquisto announced the birth of Julia Mayvis to Mayor and Tracy De Angelis. D'Acquisto also expressed the City's sympathy to the family of Ted Ludwig, an employee of the City who passed away on 1/13. COMMITTEE REPORTS Suhr moved for acceptance of the minutes of the 1/9 Committee of the Whole Meeting. Sanders seconded, carried. Suhr moved for acceptance of the minutes of the 1/8 & 1/14 Finance Committee Meetings. Sanders seconded, carried. Patterson moved for acceptance of the minutes of the 1/6 Public Services Committee Meeting. Pionek seconded. Salentine moved for individual consideration of the last paragraph on Page 2 regarding Rasmussen called for the question. There was no objection. Motion farm produce issue. Patterson seconded. Discussion took place and There has been no consensus at committee or Council level. Patterson carried. Further discussion took place on what path this should take. moved to approve paragraph. Sanders seconded. Motion carried 4-3 to move forward to create proposed ordinance language and schedule a public hearing. Patterson, Rasmussen, Sanders, and Suhr voted "yes." Rasmussen asked if the other aldermen voting no would state their concerns. Pionek stated he opposes agricultural sales in residential areas as do some of his constituents. Other communities do not allow agricultural ealee in residential areas. Salentine stated we have spent much time and over $1,000 on this issue already. We should keep what we have. A change would still require a judgment call to be made. The licensing exemptions have nothing to do with zoning. D'Acquisto stated he has no problem with the existing ordinance. Some clarification maybe needed. Why recraft. Motion to approve minutes carried. Sanders moved for acceptance of the minutes of the 12/16/96 Public 0 Utilities Committee Meeting. Salentine seconded, carried. Minutes of the 1/7/97 Plan Commission Meeting and 12/9/96 Parks & Recreation Board Meeting were received and placed on file. Sanders seconded, carried. Ord. #916 - An Ordinance to Amend the Zoning Map of the City of Muskego from RS-2 to RS-2/0IP (Muskego-Norway School District). First Reading. Suhr requested wetland delineation research be submitted. Rasmussen stated this is not ready to proceed and should be removed from the agenda. Atty. Molter recommends taking action at the time of second reading. D'Acquisto stated the City must be consistent and population growth information. Matt Sadowski responded his follow the usual process for a rezoning petition. Rasmussen requested information is not current and he has contacted the school district School Board needs the Council's decision. Suhr and Rasmussen for additional information. Sanders wants this to move forward; the agenda. Patterson stated it should be placed on the next agenda; expressed concern about the ordinance being placed on the next Council however, the Council does not have to take action on it if there is still additional information needed. Ord. #909 - An Ordinance to Amend Chapter 3 of the City of Muskego Municipal Code to Utilize Section 66.60(16), Wis. Stats. to Charge On the floor, deferred 12/10/96. Suhr moved to amend to incorporate Back Engineering, Attorney and Other Fees to Landowners Benefitting. new language provided by City attorney with the addition of "from time seconded. Carried 6-0 with Salentine voting "no." Ord. #909, as amended, adopted 6-0 with Salentine voting "no." Planner Matt Sadowski was dismissed. Ord. 910 - An Ordinance to Amend Chapter 7 to Repeal Section 7.11 (2) (a), (b), (d) and (5) and Recreate Section 7.11 (2) (a), (b), (d) and (5) of the Municipal Code of the City of Muskego (Abandoned Vehicles). Second Reading. Salentine moved for adoption. Sanders seconded. Carried 7-0. Reso. # 1-97 - Resolution to Establish Charge Back Fees Policy in Accordance with Section 3.085 (1) b. Suhr moved for adoption. Rasmussen seconded, carried. Reso. # 2-97 - Approval of Certified Survey Map - Krzman, Town of Norway. Salentine moved for adoption. Sanders seconded, carried. Reso. # 3-97 - Approval of Land Rental Agreement. Sanders moved for adoption. Suhr seconded. The original property owner, Mr. Pipke, has decided not to enter into the Agreement. The Agreement will now be between the City and Mr. Bennett. There was concern as to how the project and cost would be affected by this new site. Suhr moved to amend to add subject to approval of "the Mayor" and City Attorney in FURTHER RESOLVED that the Mayor may make any changes to said Agreement he deems necessary." Rasmussen seconded, carried. Motion to approve Reso. #3-97, as amended, carried. 0 to time" at the end of 3.085 (1) (b) in Section 1. Rasmussen moved for adoption. Sanders seconded. Patterson moved to amend "contingent on the Mayor's approval" following "the Finance Committee" in the NOW, THEREFORE, BE IT RESOLVED and following the word "documents" in the BE IT FURTHER RESOLVED. Rasmussen seconded, carried. Motion to approve Reso. #4-97, as amended, carried. Reso. # 5-97 - Approve Revised Position for 1997. Rasmussen moved for adoption. Suhr seconded, carried. Reso. # 8-97 - Approval to Continue Part-Time Clerical Position - Police Department. Sanders moved for adoption. Rasmussen seconded, carried. Reso. # 9-97 - Resolution Waiving Contingency - Offer to Purchase - waive contingency. Suhr seconded. Patterson moved to amend that Thiesenhusen Property. Patterson moved for adoption of resolution to additional money needed as the property will be purchased without the sale of Kurth Park will be taken from Park Dedication Funds. Suhr seconded, carried. Reso. #9-97, as amended, adopted 7-0. Ord. #911 - An Ordinance to Amend Chapter 12, Section 12.03 (7)(a) of Transient Merchants-Fees). First Reading. Ord. #915 - An Ordinance to Amend the Zoning Map of the City of Melissa Lueck, Julie Hakala, Wayne Vanderhei, Vicki Pilot, and Randall Sanders moved for approval of Operators' Licenses for Heidi Wolfgram, Martens. Suhr seconded, carried. VOUCHER APPROVAL Sanders moved for aDDroval of General Vouchers in the amount of $546,709.96. Suhr seconded. Carried 7-0. Sanders moved for approval of Utility Vouchers in the amount of $255,770.52. Rasmussen seconded. Carried 7-0. Sanders moved for approval of Tax Checks in the amount of $11,216,408.50. Common Council Minutes January 14, 1997 Page 4 CITY OFFICIALS' REPORTS Clerk-Treasurer announced the following public hearings to be held on 2/11: 7:25 PM Plan Commission Rezoning Petition EA to RS-1 (Woods Road), 7:30 PM Ryback Petition - Amendment to Floodplain Zoning Map, 7:35 PM Rezoning Petition RS-2 to RS-2/OD. (Miller/Racine Avenue). These public hearings were originally scheduled for 1/28. Salentine seconded. Carried 7-0. The Clerk-Treasurer and Deputy Clerk were dismissed at 11:20 PM and not present for Closed Session.
