BMLM19900820BIG MUSKEGO LAKE/BASS BAY PROTECTION & REHABILITATION DISTRICT MINUTES OF ANNUAL MEETING HELD AUGUST 20, 1990 The meeting was called to order at 7:06 P.M. by Chairman Wayne Salentine. Also present were Lake District Commissioners Simmons, Hilt, H. Sanders, Taube, and D. Sanders, Deputy Commissioner Pilak and Reinke. The Recording Secretary read the minutes of the annual meeting held August 29, 1989. Deputy Commissioner Pilak reported on the fish stocking program. He stated that small fish were put in and it appears the survival rate is satisfactory when they are put in a small bay. Deputy Commissioner Pilak updated those present on the carp removal project. A 600 ft. net was purchased and the plans are to wait until Fall, when the water is cooler, to lay the net and begin carp removal. Netting will begin in Bass Bay. The object will be to separate the carp into smaller groups and if the ice runs deep enough, the oxygen will be reduced, thus killing off some of the carp. Commissioner Pilak stated he would like to see a drawdown at the end of September to assist in carp removal. A District member questioned whether there were wardens on the lake controlling small fish being taken out of the waters. It was suggested that whenever a situation like this occurs, the person should record the boat number and report it to the authorities. Chairman Salentine advised that he had spoken with Gary Nelson, DNR, and Mr. Nelson stated that comments from within the DNR staff for the drawdown & dredging request received from the City last August were not favorable. If the District tonight decides that it definitely wants to pursue DNR approval, they will have to again contact DNR and DNR will then point out all the necessary steps that will have to be taken prior to approval. Mr. George Brauer moved to have the District continue to proceed with securing the drawdown & dredging permit. Seconded by Mr. Ken Jacobs, motion carried. Deputy Commissioner Pilak was questioned why the DNR seemed to be uncooperative and he stated that the DNR wanted a public launch on Bass Bay and that the DNR has approached a proprietor on the Bay to hold down launch fees and that there should be no motor size discrimination. Deputy Commissioner Pilak stated that the Deputy Commissioners are looking into federal funding for part of the dredging project. Commissioner Taube suggested that they use traditional machinery for dredging rather than hydraulic. Chairman Salentine updated those present on the status of Schultz Lane Road Project. The City has received and recorded all of the necessary easements and have received approval from the Corp of Engineers. The only obstacle in bidding out the project is that Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Mtg. Page 2 - August 20, 1990 the DNR has contacted our City Engineers stating that they will not issue a storm sewer permit because water run-off into Big Muskego Lake would contribute to Wind Lake's flooding problem. Chairman Salentine advised that he had spoken with Gary Nelson, the head of that particular division of DNR and will pursue the permit. Chairman Salentine updated those present on the status of the Emerald Park Landfill. The negotiating committee is coming to a conclusion and the final draft is being prepared for submittal to Emerald Park. The contested case is being pursued by Waste Management and nine (9) citizens who are challenging the environment impact statement. The proposed agreement does include cleaning of the ditch from Emerald Park to Big Muskego Lake, as well as property protection for certain properties in the area. Chairman Salentine updated those present on the Sewer Service Area Southeast of Big Muskego Lake. MMSD has indicated to all of the "contract" communities that they will not approve any sewer plan extensions until we put in the required monitoring devices which will allow them to monitor all base flows. The City received correspondence from DNR dated August 13,1990, stating that 9 items needed to be addressed prior to resubmitting the facility plan form. Commissioner Dave Sanders reported that there has been no communication from the State regarding transfer of Big Muskego Lake Dam. Chairman Salentine informed those present of the Wave Runner vehicle which the City can use in the shallow areas of Big Muskego Lake/Bass Bay and Lake Denoon. He stated that if additional surveillance is needed, that the alderman of the District should be contacted and/or the Police Department. Deputy Commissioner Pilak moved to approve payment of vouchers in the amount of $2,777.71. Seconded by Tom Buechel, motion carried. Deputy Commissioner Pilak advised that the $2,600.00 portion of the vouchers was for the water quality study done in 1989. The Recording Secretary read correspondence from United States Department of the Interior, Geological Survey, regarding new information on the lake planning grants. The first deadline for the application is September 1, 1990, and the application must come from the City. Mr. George Brauer moved to have the City apply for the water quality control grant for 1991 thru 1994. Seconded by Deputy Commissioner Pilak, motion carried unanimously. This grant is at 75% matching funds by the State. Kathy Arron, Wind Lake Management District, noted that the Big Muskego Lake/Bass Bay Protection & Rehabilitation District is part �— of the Wisconsin Association of Lake Districts which will be sending out applications shortly. Page 3 - August 20, 1990 Representative David Lepak talked about the landfill situation in Muskego and the role the legislators played in the adoption of the portion of the Budget Bill addressing the limitation of landfills in Class 3 cities to two. He explained that Emerald Park would be grandfathered in, upon receipt of all necessary approvals, because of the great amount of dollars already expended at the time of the legislation. He stated that he was hopeful that Waste Management land the nine (9) residents will be successful with their Contested Case. Deputy Commissioner Pilak presented the following proposed 1991 budget: Salaries $ 150.00 Audit 265.00 Insurance 150.00 City Computer 175.00 Water Testing 3,000.00 Fish Stocking 2,500.00 Carp Removal 3,000.00 Lake Association Membership 250.00 Legal Fees 500.00 Postage 175.00 Total $10,165.00 Deputy Commissioner Reinke moved to approve the above budget for 1991 which will result in a $35.00 assessment per parcel. Seconded by Mr. Ken Jacobs, motion carried unanimously. A District member in attendance spoke in support of the great job being done by the present Deputy Commissioners. A discussion was held on soil erosion practices in the City. Chairman Salentine indicated that we have one of the strictest erosion control ordinances in the area. Commissioner Taube felt that the City is not ignoring the problems. The City is trying to work closely with contractors to try to adhere to our erosion control practices. Robert Klenz was nominated but the person nominating withdrew his name because he did not have Mr. Klenz's permission). Mr. George Brauer moved that nominations be closed. Deputy Commissioner Pilak seconded, motion carried. The Deputy Commissioners for 1990-91 are: Les Proeber, Leonard Pilak, Jan Flancher, Ken Jacobs and Bob Sorenson. Chairman Salentine alerted the District of correspondence received from the auditing firm of Conley, McDonald, Sprague & Co. regarding authorization to conduct an audit of the general purpose financial statements for the year ending December 31, 1990. Mr. George Brauer moved to approve the agreement. Seconded by Deputy Commissioner Pilak, motion carried. Chairman Salentine advised the Commission that he was presented before the meeting with a letter from Mr. Paul J. Benke (S68 W13910 Bristlecone Lane) to have his property at W131 S8489 Durham Drive withdrawn from the District. Mr. Benke will be advised on how to formally proceed.
