MINUTES OF ANNUAL MEETING HELD AUGUST 23, 1982
The meeting was called to order at 7:35 P.M. by Chairman Wayne Salentine.

Commissioners Dumke, Nilsson, Tomczyk, Treba, Colburn, Klenz and 'Penoviel
Also present were Deputy Commissioners Brent Martin, Al Meinen, Craig
Lawdanski, Larry Erickson and Deputy Committee Chairman, Estel Ellery
and City Clerk Charlotte L. Stewart.
The Clerk read the minutes of the previous annual meeting held F
:and a motion was made and seconded to accept the minutes as presented.
Chairman Salentine advised the DNR had agreed to release to the city
the water quality report prepared by them by October 31, 1982 even
though a lake access point has not been agreed upon.
Unfinished business - Discussion of detachment request of Orlo Zlenski.

Mr. Estel Ellery advised that after considerable discussion and de-
liberations the Deputy Commissioners made their recommendation that
the commissioners should file an appeal with the courts not to have
the Zlensky's detached from the district. Following a lengthy discus-
sion as to whether or not the district should hire an attorney and
whether or not a petition could or would be presented that would
relieve the members of the governing body from continuing on ascommis-
• sioners of the district and whether or not property owners could be
detached from the district if their property is located within the
watershed of the lake, the Clerk read the decision of Judge Wollenzien
which requested the commissioners to detach Charmain and Orlo Zlenski
from the district.
Further discussion followed with Mr. Ellery reviewing the steps taken
to establish the Big Muskego Lake/Bass Bay District and the necessity
of a district in order to receive state and federal aids. He also
advised of the steps taken for forming the boundaries of the district.
In answer to a question from Mr. David Gardner as to why he wants to
be out of the district, Mr. Orlo Zlensky advised that 109 property
owners were let out of the district and that he received no benefits
from the lake therefore, he felt he should be detached.
Mr. Al Meinen, Deputy Commissioner, described the lake as being an
asset to those who like to hunt and fish.
Following considerable more discussion, Commissioner Colburn moved
to call for the question. Commissioner Klenz moved to detach the
Orlo Zlensky property from the district as the Court has ordered
and that if detachment is denied it would be considered an appeal ,
to be filed within 45 days as required by law. Seconded by Commissioner.
Nilsson. Upon a roll call vote on Commissioner Klenz's motion,
Commissioners Colburn
it 0 Nilsson, Penovich Tomczyk and Treba voted
aye". Commissioners Klenz and Dumke voted "no". The Zlenskys
were detached from the district.

Consideration of detachment request of Leslie and Annaboll Meyer,

The Clerk read the request from the Meyers indicating that they
receive no benefit from the district and feel there is no reason
why they should be included. Commissioner Klenz moved to deny
the request of the Meyers. Seconded by Commissioner Nilsson. Upon
a roll call vote on Commissioners Klenz's motion, Commissioners
Klenz and Nilsson voted "aye". Commissioners Colburn, 11onovich,:
Truba, Tomczyk and Dumke votud "no". The motion to L1011y slid nUt"
` carry, therefore, the Meyers were detached from the district.
Consideration of detachment request of Mr. and Mrs. Walter Hendrickson

indicated the Hendricksons felt they have no interest in the lake
,and receive no benefits from the lake or in the future. Commissioner Ti
moved -to approve the detachment request. Seconded by Comm. Penovich
Upon a roll call vote on Commissioner Treba's motion, Commissioners
Klenz and Nilsson voted "no". Commissioners Colburn, Dumke, Penovich,
Tornezyk and Treba voted "aye". The motion carried and the Hendrickson
were detached from the district.
Consideration of detachment request of Mr and btr5 "Wayne Weber, S90
W13333 Boxhorn Dr. The Clerk read the request from the Webers which
indicated they feel they receive no benefits from the lake now or in
:.4 future. Commissioner Treba moved to approve the request of the
Wooers to be detached from the district. Secondud by Commissioner •

Commissioners Klenz and Nilsson voted "nay". Commissioners Colburn,
Ducnke, Penovich, Tomczyk and Treba voted "aye". Thu motion carried.
The Webers were detached from the district.
VOUCHER APPROVAL - Commissioner Klenz moved to approve payment of
vouchers in the amount of $371.16. Seconded by Commissioner Nilsson.
Upon roll call the motion carried unanimously.
Discussion took place by several persons present regarding the
boundary lines of the district, should the commissioners (aldermen)
be responsible for the district, the city's present negotiations with
Milwaukee Metropolitan Sewage District, etc.
