MINUTES OF MEETING HELD THURSDAY, SEPTEMBER 14, 1995
The meeting was called to order at 6:35 P.M. by Chairman Misko.
Also present were Committee Members Salentine and Rasmussen,
Police Chief Johnson, Building Inspection Director Chuck Dykstra,
Ald. Sanders and Ald. Patterson and those per the attached list.
Mayor De Angelis arrived at 6:40 P.M.
It was noted that this meeting was posted on September 8, 1995, in
accordance with the Open Meeting Law.
Building Inspection Director Chuck Dykstra discussed with the
Committee the attached report on Update of status of
Condemnations/Citations.
Building Inspection Director Dykstra also discussed with the
Committee the proposed amendments to the Soil Erosion Ordinance
which had been presented to the Committee a couple of months ago.
Chuck advised that copies of the proposal have also been sent to
Waukesha County, Little Muskego Lake Association, Department Heads
and surrounding communities for their review and comments. To
date, three agencies have responded; Army Corps of Engineers and
DNR, verbally, stating their approval and Waukesha County has
• submitted written approval with minor changes. The Committee
discussed concern with strictness of the proposed amendments.
Chuck explained to be able to address the worse case scenario, the
rules would be in place; each and every construction site has it's
own erosion problems, i.e., different soil types, uphill, down
hill, surrounding grass or weed, watershed, etc. Chuck Dykstra
advised that inspectors will take all factors into consideration
and use discretion when enforcing rules.
The Committee reviewed final draft of proposed changes to Chapter
30 (Building Code), Section 30.14 (3.f.) as follows:
30.00 Scope - The provisions of This Code shall govern the design,
construction, alternation, repair, demolition, and moving of all
buildings and structures within the CITY OF MUSKEGO, except that
THIS CODE shall not anDly to AGRICULTURAL BUILDINGS as defined by
30.14(3.f.) - AGRICULTURAL BUILDING - Agricultural Building means
a building located on a parcel of 35 or more acres of contiguous
land which is devoted primarily to agricultural use (as defined by
s.91.01(1), Wis. Stats., which during the year preceding, produced
gross farm profits, as defined in s.71.58(4), Wis. Stats., of not
less than $6,000 or which, during the 3 years preceding, produced
gross farm profits, as defined in s. 71.58(4), Wis. Stats., of not
• less than $18,000; or a parcel of 35 or more acres of which at
least 35 acres are enrolled in the farmland preservation program.
Note: In addition to the above criteria, commentary issued from
time to time by DILHR and annexed to Appendix A, as attached, may

also be utilized when determining qualifications for Agricultural
• Building Exempt Status.
Ald. Salentine moved to recommend approval of above amendment to
Chapter 30, Section 30.14(3.f.). Seconded by Ald. Rasmussen,
motion carried 3-0.
Ald. Rasmussen requested to have the Erosion Control amendment and
the Public Nuisance amendment be listed separately on the October
agenda.
There was nothing to report on the status of removal of billboard
- Hwy "00" (Franklin).
Ald. Mark Suhr and Mr. Victor Murn discussed with the Committee
boating enforcement concerns on Little Muskego Lake and presented
the Committee with the attached proposal. The Committee
determined that a meeting will be set in the future for Chief
Johnson, aldermen and Mr. Murn to further discuss alternatives.
Ald. Patterson discussed with the Committee a request for
installation of a Stop Sign at the intersection of Longfellow 6
Saroyan Road. Ald. Salentine moved to have Chief Johnson further
research the are and return to the October meeting with a report.
Seconded by Ald. Misko, motion carried 3-0.
The Committee reviewed written petition, dated September 8, 1995,
• from Jerry Konkel (W179 56920 Muskego Drive) and neighbors,
requesting a "No Parking" and "Vehicles Backing From Driveway"
signs posted on Muskego Drive, between Elm and East Drive, due to
the severity of the curve, the width of the road and due to the
construction of a 24" x 28" garage on Muskego Drive. Ald.
Salentine moved to erect "No Parking" signs from property
addressed W18004 Muskego Drive to East Drive, on the west side of
the road. Seconded by Ald. Misko, motion carried 3-0.

Ald. Sanders discussed with the committee the request for traffic
signage in Plum Creek Subdivision. Ald. Salentine moved to direct
Supt. Loughney to install a 25 mph sign and a "Slow -Children at
Play" sign at the entrances to Plum Creek Subdivision and Bending
Brea. Seconded by Ald. Rasmussen, motion carried 3-0. The
Committee request that an item be put on the October Public Safety
Committee agenda which would address addition of signage in
Subdivider's Agreements.
Ald. Rasmussen discussed with the Committee speed limit signs on
Ryan Road. Chief Johnson will check on missing signs.
Ald. Rasmussen moved to adjourn at 8:15 P.M.
