ROLL CALL Present: Alderpersons Madden, Kubacki, Engelhardt, Kapusta, Hammel, and Wolfe. Also present: City Attorney Warchol, Public Works & Development Director Kroeger, Lead Planner Trzebiatowski, and Assistant Deputy Clerk Roller. Absent: Alderperson Terrence STATEMENT OF PUBLIC NOTICE The Assistant Deputy Clerk stated the meeting was noticed in accordance with the open meeting law. PUBLIC COMMENT None COMMUNICATIONS FROM THE MAYOR'S OFFICE None PUBLIC HEARING Assistant Deputy Clerk Roller read the notice to consider petition of Ryan Janssen to rezone property known as Tax Key Numbers 2170.991, 2173.997, 2173.998 and 2176.999 (between Martin Drive and College Avenue) from RSE - Suburban Estate District and RS-1 - Suburban Residence District to PD - Planned Development District (based on RS-2 - Suburban Residence District) for the purpose of allowing a future single-family subdivision known as Kirkland Crossing. The request also includes an amendment to the 2020 Comprehensive Plan from Low Density Residential Land Use to Medium Density Residential Land Use. Lead Planner Trzebiatowski provided a summary of the petition explaining the size of the proposed subdivision is about 91 acres with 108 single-family lots with 4 outlots. The 2020 Comprehensive Plan currently identifies the area as Low Density Residential and this would be amended to Medium Density Residential. The applicant is requesting the following zoning waivers: • minimum average lot widths of 90 feet and 100 feet on predetermined lots; compared to 110 feet • front setback of 30 feet and 25 feet on second street side of corner lots; compared to 40 feet • side yard offsets of 12.5 feet on both sides; compared to 15 feet on one side and 20 feet on the opposite side • rear offset of 25 feet; compared to 20 feet • proposed open space of 70% of the lot area; compared to 15,000 square feet or 75% of lot area. The applicant is not requesting any type of density bonus as part of this PD request. Other concerns were extension of public utilities and cost; potential placement of students in already over capacity schools, maintaining the wooded area; trail system, flooding after development, and potential property clutter. Bill Carity and Petitioner Ryan Janssen spoke in response to resident comments explaining the traffic concerns have been addressed with the County, deed restrictions will reduce clutter free properties, the development will trigger a traffic analysis by the County, and current parcels will now have utilities available to them. Adam Trzebiatowski also stated comments made at this Public Hearing will be addressed at the next Plan Commission meeting scheduled for August 3, 2021.
