Meeting was called to order at 7:3CI by President Christenson. Agenda was approved on motion R. Leichtfuss, second J. Roberson. Minutes of the January 7 meeting were approved on motion N. Berken.z:econd R. Leichtfuss. Next meeting scheduled March 3,1992. Treasurer's report: Motion R. Christenson, second J. Roberson to approve January expenditures in amount of $19,117.:;6. Christenson reviewed intersystem borrowing problems since the passage of President of WCFLS Board, letter dated January 17,1992. Mid-Wisconsin Library Dodge, Jefferson, and Washington Counties. WCFLS Board has determined that System is refusing to fund any cos13 of intersystem borrowing by residents of action and political pressure is necessary to solve this problem of funding, and recommends WCFLS libraries close the door to resident borrowers from these counties on August 1, 1992. Muskego Public Library is not directly affected by these borrowers. LIBRARIAN'S REPORT FEBRUARY , 19 9 2 The year started well, with circulation of over 13,000 - our third highest month ever. We are soon going to be needing three people on duty for Saturdays during the school year. WCFLS Board. Ray Christenson is the newly-elected Vice President of the Penny and Holly attended an APL meeting which dealt with services to the deaf and hard-of-hearing. Waukesha. Ray and Holly went to an Intersystem Borrowing meeting at An ILL meeting was held at Waukesha. We will be getting a $1,500 materials grant from WCFLS to improve the reference collection. The February display highlights Black History Month and the March 1st art fair. A special Friends of the Library sale of romance books for Valentine's Day has received favorable reactions. We get many donations of paperbacks throughout the year, and this seemed like a good way to sell them. We received handouts from1 the Muskego-Norway Family Child Care Preschool Providers which I felt did not meet the criteria in the Board policy for posting, as they promoted a business. We put a copy in our question/answer box and in the community organizaticmns file. I The reading group has chcssen 0 Pioneers as its first selection. Holly attended three meet,ings with the city about space (lack of) and telephones (new). Except in storage areas, the library space will be adequate, until we need to add present phone system, but. it is hard to add anyone new. shelving - any moment now... We are very happy with the Storyhours are once again underway. There was a question about staff attendance at the Muskego Woman's Club's recent lurcheon to hear storyteller Judy Busack. It should go without saying that everyone who attended was either on their own time or used compensatory time. People who are scheduled for the evening hours are not expected to work twel.ve-hour days. February 5, 1992 Ed Vojtik, President 321 Wisconsin Avenue Waukesha, WI 53186 WAUKESHA COUNTY FEDERATED LIBRARY SYSTEM BOARD Dear Mr. Vojtik: At last night's meeting, the Muskego Public Library Board voted "yes" to all eight points on the intersystem borrowing checklist. Aided by the System's excellent supporting documents and the insi9ht.s of our Board President, Ray Christenson, the Trustees: showed a real understanding of the problem now facing the system, several member libraries, and perhaps eventually, our 1.ibrary. The Board wanted me to express their wholehearted support for the System Board's ac:tions, and admiration for their courage in bringing matters with Mid-Wisconsin to a head, while not neglecting legislative remedies. While our Board is fully in support of what the System Board is trying to accomplish, they had some additional comments and suggestions: -- They felt the August deadline to close the doors was December 31, 1992. too soon, and recommended actually stopping service as of -- The idea of a brochure was warmly applauded. The Board saw the dual neces:;ity of arousing public protest and of forewarning library u:;ers. Vojtik Page 2 'I' HIGHLIGHTS? - INTERSYSTEN BORROWING SINCE HEPHNER &!mer. 1985 - The Hephner amendment, later to become 43.17.10 of the State Statutes, requiring adjacent library systems to a:llow on-site borfiowing across library system lines, is inserted into the 1986-87 budqet bill. Concerned librarians are told that it will be almost impossible to remove :it from the budget bill and that "the amendment as it is worded is most likely unenforct!able due to its placement in 43.17.10 for general system requirements rather than member library requirements ... and due to lack of discussion of compensation for fiscal impact." (memo from Jerry Pennington. Chair of the WLA Library Development and Legislation Committee). Mav 26. 1987 - Menomonee Falls Library Ilirector asks the Director of the Mid-Wisconsin Library System and the West Bend Library Director to meet with him on behalf of Washington County to talk about reimburrjement for intersystem borrowing. The request is not honored. July 2. 1987 - System Board President asks to meet with representatives of the Mid-Wisconsin Library System. The request is not honored. November?. 1988 - The State's Legislative Audit Bureau evaluates public library systems and reports: "...public library systems do not have a statutorily defined role for intersystem borrowing. However. the Audit Bureau does recommend that, because of legislative interest in this issue, the DPI should institute a policy which would deal with the problems caused by 43.17.10. January. 1989 - In response to the Audit: Bureau's evaluation, the Division recommends that funds for intersystem borrowing rehbursement be included in the 1989-91 budget & equest. The initiative is placed in the DPI budget request but is never pushed gislatively. The initiative dies. June 21. 1989 - The Library System Board presents a resolution to the Waukesha County Board, asking that 43.17.10 be revised and that the costs of intersystem borrowing be WCA . assessed to the borrowing library system. The resolution passes and is sent to the Auqust? 1989 - Wisconsin Counties AssocFation does not act on the resolution from the Waukesha County board; it refers the intersystem borrowing recommendation to the WCA Executive Board for later action. September. 1989 - DIS notifies System Directors that member libraries not in compliance with the State Statutes must be penalized or the library system will lose a quarter of its State aid. WCFLS notific!s libraries that they must comply with 43.17.10 in 1990. October 3. 1989 - In response to the prospect of enforcing 43.17.10, the System Board agrees to reimburse libraries for the cost of intersystem borrowing while it pursues negotiations with adjacent library systc!ms. Reimbursement is at the county average cost per circ. The motion says that in future years, should sufficient money not be available, net lending libraries will rcxeive money on a pro rata basis. October, 1989 - The Director of the Lakeshores Library System, with the support of the WCFLS Director, triee to convince the System and Resource Library Administrators Association (SRLAAW) to recommend that I)IS develop legislation to create a fund of e oney to cover the costs of intersystem borrowing. The resolution fails. November 3. 1989 - County Board Supervi!jor McNelly. System Board President Luebke and System Director Gosz appear at the WCA Executive Board meeting to ask for approval of the intersystem borrowing recommendation. The resolution is passed unanimously. It - f is referred as a part of the WCA's legislative agenda to legislators all over the 6:::; 10. 1990 - The System Board President writes to the outgoing PreBident of the Mid-Wisconsin Library System Board asking for an opportunity for the System Director and the System Board President to attend the next Mid-Wisconsin Board meeting. No reply is received. March 27. 1990 - System Board President writes to the new President of the Hid-Wisconsin Library System, making the same request. March 27. 1990 - System Board President and System Director appear at a Mid-Wisconsin Library System Board meeting in Beaver [lam and plead for fairness on the intersystem borrowing issue. The Mid-Wis. System BcNard says it will work with WCFLS on legislation to solve the problem and prclmises to appoint a committee - no committee is ever appointed. June 29. 1990 - System Board President writes a letter to all Waukesha County Legislators. asking them to take action on the WCA resolution to change 43.17.10. Rep. Schneiders responds that DLS is not in favor of this resolution and suggests that the System Board explore other avenues for reimbursement. July 25. 1990 - System Board agrees to fund intersystem borrowing at county average cost, maintain most System services at status quo. and discontinue its competitive grant program. September 17. 1990 - System Board President, after calling the Mid-Wisconsin Board There is no apparent response. 8 resident, sets up a meeting in West Bend to discuss the intersystem problem. ystem Director. This time he suggests that the State aid formula be changed to correct the intersystem borrowing problem - have the money follow the people. Jan. 4. 1991 - System Board President and System Director meet with Rep. Winnner to explain the proposal for changing the way State aid formula funds are distributed. Rep. Wimmer indicates interest but never follows up even after a call and a letter from Bd. President Luebke. February 13. 1991 - System Board President and System Director meet with two representatives of the Outagamie-Waupaca Library System to try to enlist support for the legislative change. The OWLS representatives follow up with their State legislators but do not receive any help. February 21. 1991 - System Board President and System Director meet with Rep. Duff at Library Legislation Day and again ask for his help in creating legislation to change the way the State aid formula funds are distributed. He is sympathetic but does not promise to take any action. March 13. 1991 - System Director meets with the new Hid-Wisconsin Library System Director at Germantown to talk about the intersystem borrowing problem. He indicates that there is not any money available in 1991 but that some funding in 1992 is very April 8. 1991 - System Board President, :system Director, and Menornonee Falls Library Director meet with Lolita Schneiders who has a draft of legislation which would ' require the net borrowing library system to pay the costs involved in order to qualify e for State aid. (The WCA position) April 22. 1991 - Dodge County Library :Service writes the OPL to say that, because the Jefferson County Library Board does not have to reimburse OPL and is still allowed to borrow materials at Oconomowoc P.L.. the Dodge County Service has decided to discontinue its contract with OPL. April 23. 1991 - System Board President and System Director meet with the Mid-Wisconsin Board President and Director at West Bend. Meeting is not conclusive but seems to point in the direction of some compensation for intersystem borrowing from the Hid-Wisconsin System in 1992. ADril 26. 1991 - SRLAAW meeting in Deliivan. Leslyn Shires tells the system and resource library directors that DE will not support Lolita Schneiders' proposed legislation and SRLRAW votes almost unanimously (two "no" votes) to fight this of the Lakeshores Library System, that the Division for Library Services will nwe legislative proposal. Shires states, in response to a direct question from Tom Hennen penalize a library system which has a n&iier library not in compliance with 43.17.10 r ADril 29. 1991 - Lolita Schneiders, Letrlyn Shires, System Board President and System Director meet at tlenomonee Falls to try to reach a compromise on legislation. Leslyn Shires proposes that the law be modified to allow libraries which are not compensated to close their doors to intersystem borrowing. WCFLS representatives reluctantly agree. Nay 5. 1991 - Division for Library Services develops a position paper on non-resident orrowing across public library system boundaries which states that given the nequities created by 43.17.10 of the Statutes and the lack of state funding that the (Ip State law should be modified to 1) allcw libraries not being reimbursed for intersystem net lending to discontinue giving the service and 2) remain a member in good standing of the library system. Nay 16. 1991 - DLS notifies System and Resource Library Directors that the above concept has been approved by both COLRND and the Wis. Library Association's Library Legislation and Development Committee. Nay 21. 1991 - System Board President writes letter to Dodge County Library Service, warning them that on-site borrowing privileges could end if Dodge County does not renew its payment contract with the Oconomowoc Public Library. Library. She says it is unlikely that DLS will ever withhold state aid from a library June 3. 1991 - Leslyn Shires meets with Library System Board at Brookfield Public discusses the possibility of closing doors to intersystem borrowers and 'Shires system which has member libraries not in compliance with 43.17.10. The Board comments that this is the kind of political pressure that will eventually solve the problem. - June 6. 1991 - Director of OPL writes a letter to Dodge County Library Service, saying that WCFLS funding for intersystem bormwing is precarious and urges Dodge County to sign an intersystem borrowing contract. Julv 8. 1991 - System Board approves a recommendation from the System Director to fund ntersystem borrowing at 65 per cent of actual cost in view of the possibility of no ncrease in State funding in 1992. 0. a July 24. 1991 - Letter from Oconomowoc I?ublic Library to Dodge County Library Service accepting the Dodge County contract offer while noting the cost differential between I . 2 the contract amount and the actual cost. Letter states that the WCFLS Board has asked the OPL director to apprise Dodge County about the eventual phase out of WCFLS dollars Y or intersystem borrowing. Auqust 27. 1991 - System Board member Vcmjtik and Director Gosz meet in West Bend with borrowing problem and ask for some compensation in alleviating the problem. The Mid-Wisconsin System Board takes no action. October 8. 1991 - Mid-Wisconsin Library System Director attends WCFLS System Board meeting at North Lake and says action from the Mid-Wisconsin Library System on the Mid-Wisconsin full Board meeting. intersystem borrowing funding request cm be expected after the November 26 October 14. 1991 - The System's long range plan is presented, including a proposal from the System Director to phase out in,tersystem borrowing reimbursement by funding at 65 per cent of cost in 1992. 35 per cent of cost in 1993. and no funding in 1994. If, by that time, reimbursements from other systems are not adequate, WCFLS member libraries will be allowed to close their doors. The Board passes the proposal as part of the System plan. IT' - At the request of the County Board's LIE Committee which wants some Board discusses AB557 (as amendedl, the legislation introduced by borrowing if costs are not reimbursed. The System Board recommends that LIE support the legislation as the best that can be done for now. November 5. 1992 - LIE Committee of the County Board votes in favor of AB557, and sends its recommendation to the County Board of Supervisors. December 2. 1992 - The System Director learns from the Director of the Mid-Wisconsin Library System that the Mid-Wisconsin Library Board is unwilling to fund any intersystem borrowing costs and is reconlmending that WCFLS approach the Jefferson. Dodge, and Washington Countv Library Boards to get funding. For at least two years, negotiations have been proceeding to gain some measure of reimbursement for the more than 59,000 items which Mid-Wisconsin residents are freely borrowing from Waukeshta System libraries. 2. This past year, a subcornnittee of three Trustees met twice with Mid-Wisconsin to explain the problem and to request: some munt of reimbursement: one meeting was with the Executive Cormittee of the Mid-Wisconsin Board and one was with the full Mid-Wisconsin Board. 3. On December 10, 1991 we finally received an answer from the Mid-Wisconsin Director on behalf of Mid-Wiscons:.n's Federated System. The answer: "The tmstees from MwnS, Dodge, Jefferson, and Washington Counties' library Services (have) concluded that respnsibiLty for compensating intersystem usage rmins with individual county library sewices and municipalities who support the primary service of the individual:; who use the intersystem services." In effect, Mid-Wisconsin has said Waukesha's Federated System and its libraries can continue to absorb approximately $130,000.00 for serving library users from Washington and Jefferson counties. The Mid-Wisconsin Federated Library System assumes no responsibility. Wcms System Board Reaction: A subconunittee of the Waukesha County Federated Library System Board was named to react to Mid-Wisconsin's decision. The subconunittee members were enjoined to represent the strong feeling of the Board that some action had to be taken. The January 13, 1992. The full Board was unanhnous in its approval of the report, and a subconnnittee's report was presented at. the regular meeting of the full Board on timeline was incorporated which direct4 that the WCFLS President send a letter informing each of Waukesha's 16 library directors of the System Board's reconunendations.
