Mayor Johnson called the meeting to order at 5:45 p.m. Present: Committee Members
Ald. Snead and Schaefer. Ald. Werner arrived at 6:20 p.m. Also in attendance: Ald.
Borgman, Ald. Schneider, Clerk-Treasurer Moyer, Finance Department Supervisor
Mueller, Deputy Clerk Blenski and those per the attached sheet. Those present recited
the Pledge of Allegiance. The deputy clerk stated that the meeting was noticed in
accordance with the open meeting law.
APPROVAL OF MINUTES
Ald. Snead moved for approval of the November 25, 2008 and December 9, 2008
minutes. Ald. Schaefer seconded; motion carried.
LICENSE APPROVALS
Ald. Snead moved to recommend approval of a regular Operator’s License for
David Borkowski, Travis Brandt, Richard Doede, Chris Gamble, Ashley Hense,
Amanda Koszarek, Deanne Schneider, Bridgett Thompson, and Katie
Vinohradsky subject to the licensing requirements being completed prior to
issuance. Ald. Schaefer seconded; motion carried.
Matthew Anderson was present on behalf of Special Olympics of Wisconsin. The
organization is sponsoring its annual Polar Plunge event to be held at Muskego County
Park, S83 W20370 Janesville Road, on February 8, 2009. Special Olympics of
Wisconsin submitted an application for a temporary license to sell fermented malt
beverages and wine at the event. Ald. Snead moved to recommend approval of a
Temporary “Class B” Retailers’ License for the Sale of Fermented Malt Beverages
and Wine for Special Olympics of Wisconsin for February 8, 2009. Ald. Schaefer
seconded; motion carried.
Margarita Bahr was present regarding the renewal of a Dog Fancier Permit for 2009.
Mayor Johnson noted that correspondence was received from one neighbor who
expressed some concerns with the Bahr property. However, the issues have nothing to
do with the renewal of the Dog Fancier permit. Mrs. Bahr stated that she currently has
three dogs, but will be getting rid of one. Her mother-in-law resides with her and also
has a dog. She will be moving in the near future. Ald. Schaefer moved to approve a
Dog Fancier Permit for Margarita and Gordon Bahr, S64 W13223 Windsor Road.
Ald. Snead seconded; motion carried.
Ald. Schaefer moved to approve renewal of 2009 Taxi Driver Licenses for the
Muskego Senior Taxi Service for Daniel Barry, James Depies, Michael Gorski,
Martin Daniel Henry, Robert Heidger, Diane Johnson, Raymond Daniel Kinnick,
Jean Marenda and Carol Stillwell. Ald. Snead seconded; motion carried.

NEW BUSINESS
Discuss Request from Paul Marek Regarding 2004 Personal Property Tax Bill for
Marek Lithograph
Mr. Paul Marek was present for this issue. Clerk-Treasurer Moyer provided background
information. The original amount of the bill was $2,489.59. The current amount due is
$4,280.87. After the City was unable to collect the tax, it was sent to Waukesha County
Collection Division in 2006. Mr. Marek contacted Ms. Moyer on December 4 and
requested that the interest due be removed. Waukesha County sent a letter to Mr.
Marek’s mother notifying her that the amount due could be collected through the tax
intercept process. Waukesha County has confirmed that the tax is not dischargeable
when considering the tax intercept process. Ms. Moyer stated that she does not have
the authority to forgive the interest, or any amount of the tax bill. She noted that the City
does remove delinquent personal property accounts from the books. However,
Waukesha County still pursues collection. Mr. Marek has offered to pay $500 to settle
the matter.
Mr. Marek stated Marek Litho surrendered its assets to the bank in 2004. He continues
to personally pay off the company’s debts. His mother received the notices regarding
the personal property taxes, but thought they related to the real estate taxes. Ald.
Schaefer expressed concern that a precedent not be set regarding this situation
especially with the state of the economy. Ms. Moyer suggested that Mr. Marek contact
Waukesha County to determine if a payment schedule could be arranged. Ald.
Schaefer moved to deny the request. Ald. Snead seconded; motion carried.
Discussion and Recommendation Regarding Claim Submitted by Joseph Yaeger
Clerk-Treasurer Moyer stated that Mr. Yaeger filed a claim on December 10 regarding
an incident on Big Muskego Lake on November 5. His boat hit a sign that was almost
completely submerged. Mr. Yaeger is requesting $1,000 claiming the boat cannot be
repaired. The claim was submitted to the City’s insurance carrier; CVMIC
recommended denial stating the City has recreational immunity. The incident was also
investigated by Tom Zagar. Mr. Zagar observed Mr. Yaeger’s boat. He believes the
damage consists of a long scratch and the structural integrity of the boat was not
compromised. Ald. Schaefer moved to deny the claim submitted by Joseph
Yaeger. Ald. Snead seconded; motion carried.
Recommendation to Combine Wards for Spring Primary Election
Ms. Moyer stated the ballot for the Spring Primary election would only have one office
on it (State Superintendent of Public Instruction). A similar election was held in 2005,
and only 653 people voted. Of those, 230 voted absentee. Ms. Moyer is proposing that
there be only one polling place for the Spring Primary election, which would be City Hall.
State law does allow combining of wards to facilitate using a common polling place. Use
of one polling place would save about $4,000, which does not include City staff time.
Ms. Moyer stated that notification regarding the election would be posted to the City’s
website and display ads run in the Muskego Now and Muskego Chronicle. Signs would
also be posted at each polling place. Ald. Snead moved to approve. Ald. Schaefer
seconded; motion carried.
Recommendation Regarding Cleaning Services Agreement with Jani-King
The item was removed from the agenda as the agreement was not finalized.

Recommendation Regarding Insurance Carriers for 2009
Mayor Johnson stated it is his recommendation that the City continue with CVMIC for
another year. Ald. Snead moved to recommend approval of the following:
Cities and Villages Mutual Insurance Company (CVMIC)
Liability, including General Liability, Auto Liability, Public Officials Liability, Police
Professional Liability and Employment Practices Liability
Crime
Boiler and Machinery
Worker’s Compensation Insurance
State of Wisconsin Property Insurance Fund
Buildings, Personal Property, & Property in the Open
Pier and Wharf Endorsement
Motor Vehicle Physical Damage (Comprehensive and Collision)
Contractor’s Equipment
Ald. Schaefer seconded; motion carried.
Approval of Request of Little Muskego Yacht Club to Place Temporary Race
Course Markers
The Little Muskego Yacht Club submitted a request to place sailboat race course
markers on Little Muskego Lake for the period May 1 through September 30, 2009. The
request is the same as previous years. The Police Department did not have any issues.
Ald. Snead moved to approve. Ald. Schaefer seconded; motion carried.
Recommendation Regarding Cooperative Agreement Between the City of
Muskego and Aging and Disability Resource Center of Waukesha County
Mayor Johnson stated the agreement is for the nutrition program held at City Hall three
times per week. The language is the same as in previous years. Ald. Schaefer moved
to recommend approval. Ald. Snead seconded; motion carried.
Recommendation Regarding Harassment and Discrimination in the Workplace
Policy
The Mayor stated a model policy was provided by CVMIC. The Finance Committee
reviewed the policy and provided comments. The policy has now been finalized. The
City’s labor attorney also provided input. Ald. Snead moved to recommend approval.
Ald. Schaefer seconded; motion carried.
Recommendation Regarding Purchase of 2009 Patrol Truck for Public Works
The following quotes were received:
Lakeside International, LLC $73,875.00
Packer City International Truck, Inc. $75,000.00
Capital City International, Inc. $74,958.53
In addition to the above, the necessary equipment must be purchased from Wausau-
Everest L.P. for a total of $64,500. The total cost of the truck would be $138,375.
Mayor Johnson noted that was $3,375 over what was budgeted. However, the old truck
should sell for $10,000 to $15,000, which will provide the additional funds needed. Ald.

Snead moved to recommend approval of the purchase. Ald. Schaefer seconded;
motion carried.
VOUCHER APPROVAL
Ald. Werner arrived at 6:20 p.m.
Ald. Snead moved to recommend approval of Utility Vouchers in the amount of
$50,030.65. Ald. Werner seconded; motion carried.
Ald. Snead moved to recommend approval of Tax Checks in the amount of
$228,001.13. Ald. Werner seconded; motion carried.
Ald. Snead moved to recommend approval of General Vouchers in the amount of
$769,608.36. Ald. Werner seconded; motion carried. Ald. Schaefer abstained.
ADJOURNMENT
Ald. Snead moved to adjourn the meeting at 6:28 p.m. Seconded by Ald.
Schaefer; motion carried.
