FM20070626 CITY OF MUSKEGO Approved 7/10/2007 FINANCE COMMITTEE MINUTES Audio Recording Available Tuesday, June 26, 2007 Muskego City Hall, Aldermen’s Room Mayor Johnson called the meeting to order at 5:45 PM. In attendance: Committee Members Ald. Melcher, Borgman and Werner, City Administrator Sheiffer, Clerk- Treasurer Moyer, Ald. Snead, Ald. Schaefer (present for a portion of the meeting) Deputy Clerk Blenski and those per the attached sheet. Those present recited the Pledge of Allegiance. The Deputy Clerk noted that the meeting was noticed in accordance with the Open Meeting Law on 6/22/2007 and as amended on 6/25/2007. REVIEW OF MINUTES OF PREVIOUS MEETINGS Ald. Melcher moved for approval of minutes of 6/12/2007. Ald. Werner seconded; motion carried. LICENSE APPROVALS Ald. Melcher moved to recommend approval of an original Operator’s License for Lisa Borkoski, Brittany Greene, Scott Groh and Rachel Knight subject to the licensing requirements being completed prior to issuance and to recommend approval of renewal of the following Operators’ Licenses: Tiffany Banaszak, Bobbi Jo Butler, Sharon Faherty, Clark Fischer, Matthew Fischer, David Gajewski, James Gollwitzer, Sandra Gollwitzer, Terri Kadow, Cindy Kaminski, Susan Kummer, Donna Morris, Anita Nogalski, Heidi Reise, Kathleen Rynders and Gordon Shafer. Ald. Borgman seconded; motion carried. (Dates corrected at the 7/10/2007 meeting to September 7, 8 and 9, 2007.) License holder Vera Pires was present to discuss an application for an outside dance permit for September 8, 9 and 10 at Spitfires Food & Spirits, S76 W17957 Janesville Road. The Committee expressed concerns with the request for outside music until 10:30 PM on Sunday. Ald. Werner moved to recommend approval of the following: 9/8 and 9/9 outside music 6:00 PM to 11:00 PM, outside licensed noon until 11:00 PM and 9/10 outside music 5:00 PM to 9:00 PM, outside licensed noon until 9:00 PM. Ald. Melcher seconded; motion carried. Ms. Pires accepted the recommendation of the Committee. Mayor Johnson noted that complaints would be reviewed on an annual basis for any future requests. Mr. Wai Ming Kwan was present regarding an application for a Class “B” Retailers’ License for the Sale of Fermented Malt Beverages and “Class C” Wine License for Toko Haru of Muskego LLC, S75 W17351 Janesville Road. Ald. Borgman moved to recommend approval. Ald. Werner seconded; motion carried. Ald. INTERVIEW AND SELECTION OF TEEN ADVISORY BOARD MEMBERS The following applicants for the Teen Advisory Board were present: Alexandra Brandt, Samantha Holten, Krista Karidis, Jenna Klaus, Shannon O’Reilly and Lauren Wundrock. Applicants Holly Flores and Tyler Nred could not be present because of vacation. Each applicant present gave a brief presentation. Following discussion by the Committee, Lauren Wundrock was chosen to serve on the Board as a voting member. All the other applicants will serve as alternate members. PERIODIC LICENSE REVIEW The periodic review for June Loh did not reveal any new violations. NEW BUSINESS Discuss Recent Violation at Licensed Establishments Mr. James Semrad, the agent for Muskego Market Place Foods, LLC (Sentry), was present to discuss a recent violation. An employee at Sentry was cited for selling to someone underage as a result of a compliance check conducted by the Police Department. Mayor Johnson stated that two violations in a year could result in a license suspension. Mr. Semrad stated that he takes this seriously. The store has several safeguards in place to prevent this type of sale. Mr. Semrad stated that the laws will be reviewed with employees and existing policies will be evaluated in an effort to prevent future violations. Review and Recommendation to Raze the Residential Structure at the Engel Conservation Area Mr. Zagar stated that the residential structure at the site has been unoccupied since 2000. The building is in a dilapidated state and extensive restoration would be needed Finance Committee Meeting June 26, 2007 Page 3 if it were to be used by the public. Mr. Zagar is recommending that the structure be razed. The Muskego Fire Department would raze the house as a training exercise. Ald. Borgman moved to recommend approval to raze the structure at the Engel Conservation area. Ald. Melcher seconded; motion carried. Review and Recommendation for Oversizing Reimbursement - Boxhorn Reserve, Woodland Creek and Big Muskego Estates II Ald. Borgman moved to recommend approval of the following oversizing reimbursements: Boxhorn Reserve Subdivision $ 20,622.88 Big Muskego Estates II Subdivision $ 21,626.75 Woodland Creek Subdivision $136,735.00 Ald. Werner seconded; motion carried. Discussion Regarding Timeframe for Display of Fireworks Ald. Fiedler requested this item be placed on the agenda. As he was not present, Ald. Borgman moved to defer. Ald. Melcher seconded; motion carried. Discuss Creation of an Ordinance Relating to Sex Offender Residency Restrictions Mayor Johnson stated that several municipalities are adopting ordinances that restrict where registered sex offenders may reside. The Mayor does not want Muskego to be the last city to do so and become a magnet for these offenders. Ald. Werner agreed. The Mayor stated that the City Attorney suggested waiting for Milwaukee’s ordinance, which will be available in a few weeks. It could possibly be used as a model. Ald. Borgman moved to authorize the Mayor to pursue the creation of an ordinance (once Milwaukee’s is available) and to support the cost incurred to do so. Ald. Werner seconded; motion carried. Discuss Completion of Paving at Muskego High School Athletic Facilities The Mayor presented some background information regarding this issue. The City entered into an agreement with the school district to construct athletic facilities several years ago. A parking lot was part of the project; however, the last layer of asphalt was not completed because of total project costs. The School District has stated that the City Engineer verbally said that the parking lot could be paved when Woods Road was resurfaced at the City’s expense. Several years have transpired and the Woods Road project is now part of the City’s 2007 Road Program. The estimated cost to complete the parking lot is $37,000. Based on the original agreement, the City’s contribution would be 37.75% or $13,968. The Mayor would like to see the project completed. The paving would be added to the City’s 2007 Road Improvement Program. Ald. Borgman expressed concern about the City’s original commitment. Mayor Johnson stated that it is not certain that the statement was made and if it was, it was not authorized. Ald. Werner moved to defer until the next meeting. Ald. Melcher seconded; motion carried. Finance Committee Meeting June 26, 2007 Page 4 REDUCTION IN LETTER OF CREDIT Ald. Borgman moved to recommend a reduction in the letter of credit for Copper Oaks in the amount of $31,200 pursuant to supporting correspondence received by Ruekert & Mielke. Ald. Werner seconded; motion carried. VOUCHER APPROVAL Ald. Melcher moved to recommend approval of General Vouchers in the amount of $357,387.17 and Utility Vouchers in the amount of $223,736.42. Ald.
