MINUTES OF MEETING HELD TUESDAY, OCTOBER 26, 2004
The meeting was called to order at 7:17 pm by Mayor Slocomb with Committee
Members Salentine, Madden, and Schroeder present along with Aldermen Buckmaster,
Borgman, Melcher and Patterson, City Attorney Molter, Clerk-Treasurer Moyer, and
Deputy Clerk Blenski. Those present recited the Pledge of Allegiance.
Mayor Slocomb stated the meeting was noticed in accordance with the open meeting
law.
APPROVAL OF MINUTES
Ald. Salentine moved to approve minutes of the meeting held October 20, 2004.
Seconded by Ald. Schroeder; motion carried.
UNFINISHED BUSINESS
Reconsider Recommendation to Council Regarding Mayor’s Salary
Ald. Schroeder moved for reconsideration of recommendation made by the Committee
on October 20, 2004. Ald. Madden seconded; motion carried. Ald. Schroeder
requested “Version B” of proposed Ordinance #1184 go forward. This version
proposes to decrease the 96 hours of continuing education recommended by the
Finance Committee as reflected in “Version A.” Atty. Molter stated the ordinance poses
potential legal problems. The state statutes say that the salary for an elected official
must be fixed before the term. The League of Wisconsin Municipalities does not
believe the proposed ordinance does that and he agrees. There is also a 1992
Attorney General Opinion that states you cannot set performance standards for elected
officials to receive salary increases. He cannot point to a statute that says it is
absolutely illegal but in his opinion, it probably is. Atty. Molter has concerns with other
aspects of the ordinance as well including the type of classes that would meet the
criteria for continuing education and determining hardship. Ald. Schroeder stated it
was brought forward because previous communication indicated it could be done. The
Committee’s intent was that the education was a requirement, not an incentive. There
would be no salary increase if the continuing education was not achieved. Atty. Molter
stated this is an elected position and the job requirements are governed by state
statute. It is assumed that the electorate will judge the individual’s performance. Ald.
Schroeder moved to defer the item for two weeks. At that point, the results of the
referendum will be known. Ald. Salentine seconded; motion carried.
NEW BUSINESS
1. Amendment to Northview Green Subdivider’s Agreement
Ald. Salentine moved to recommend approval of the amendment. Ald. Madden
seconded; motion carried.

2. Review Recommendation to Disallow Claim - Becker
Ald. Salentine moved to recommend disallowance of claim as recommended by the
City’s insurance carrier. Ald. Madden seconded; motion carried.
3. Approval of Subdivider’s Agreement, Letter of Credit and Cost of Breakdown -
Fireside Orchard
Ald. Salentine moved to recommend approval. Ald. Madden seconded; motion carried.
VOUCHER APPROVAL
Ald. Salentine moved for approval of payment of General Vouchers in the amount of
$523,096.99 and Utility Vouchers in the amount of $305,917.37. Ald. Schroeder
seconded; motion carried.
ADJOURNMENT
Ald. Madden moved to adjourn at 7:34 pm. Ald. Salentine seconded; motion carried.
