FM20030521 CITY OF MUSKEGO FINANCE COMMITTEE MINUTES Approved Wednesday, May 21, 2003 7:00 PM Muskego City Hall, Aldermen’s Room W182 S8200 Racine Ave. Mayor Slocomb called the meeting to order at 7:09 PM. In attendance were Committee Members Ald. Petfalski, Ald. Salentine, and Ald. Schroeder, and those per attached sheet. Finance Director Dawn Gunderson was excused. Those present recited the Pledge of Allegiance. The meeting was posted in accordance with the Open Meeting Law on May 16, 2003 and amended agenda posted on May 19, 2003. REVIEW OF MINUTES OF PREVIOUS MEETING The minutes of the May 13, 2003 Finance Committee Meeting were reviewed. Ald. Salentine moved to approve the minutes. Seconded by Ald. Schroeder. Carried by all. LICENSE APPROVALS Ald. Salentine moved to recommend approval of Operator’s License for Mike Malison subject to receipt of fees, answering the Committee’s questions on police report favorably, and verification of schooling. Seconded by Ald. Petfalski. Carried by all. Outside Dance Permit and amendment to premise description – Bushy’s – June 14, 2003 – Deputy Clerk Jill Blenski sent memorandum stating Lynn Kurer has submitted an Application for Outside Dance Permit – Outside of Licensed Class B Tavern License for Year 2002 – 2003. This is for an outside event connected with the MDA organization to be held on Saturday, June 14, 2003. Lynn Kurer was present to answer committee questions. Kurer is requesting music until midnight and the outside premise (parking lot and deck) be licensed until 1:30 AM. Ald. Salentine moved to recommend approval of Outside Dance Permit for event to be held on Saturday, June 14, 2003 subject to the following conditions: no outside sales in parking lot and patio after 1:30 AM, tent with side screening to be placed on west side of building, and music until 12:00 AM. Seconded by Ald. Petfakski. Discussion continued on the two noise complaints received and the possibility, in the future, of changing the hours for music if noise complaints continue to be received for the same time period. Carried by all. REVIEW 2003 – 2004 LICENSE APPLICATIONS The Committee reviewed spreadsheets provided by Deputy Clerk Jill Blenski. Also reviewed were the police incident reports (if any) for each establishment. “Class A” Retailers’ Licenses for the Sale of Fermented Malt Beverages and Intoxicating Liquors – Ald. Aud-Mar Supper Club will be finalized at June 4, 2003 Finance Meeting. Approval of Outside Dance needs to be reviewed. Recommended approval is needed to be included as part of license. Archery/Trap/Rifle License – Trade Names Boxhorn’s Gun Club Schultz Resort rod & Gun Club (contingent upon Building Hunter’s Nest (contingent on Building Department inspection and April 16, 2003 Finance Department inspection) Committee specific conditions) Wings & Whitetails Taxidermy Archery LLC (contingent on Building Department inspection) PERIODIC LICENSE REVIEW Hearing for revocation or suspension of Operator’s License – Brian Ward – This item was deferred at the March 19, 2003 Finance Meeting in regard to the discussion on conditional three month review for the Operator’s License Ward currently holds and possible revocation or suspension of that license. The Committee at that time requested the Clerk’s Office check on the disposition of trial. Deputy Clerk Jill Blenski sent memorandum with update provided by the Waukesha County Courthouse. Ald. Petfalski moved to send Ward a certified, return receipt letter requesting his presence at the Wednesday, June 4, 2003, Finance Committee Meeting. Seconded by Ald. Salentine. Carried by all. Operator License – Anthony Guzman – A check with the Wisconsin Crime Information Bureau and the City of Muskego Police records revealed new record of arrest since the last periodic license review on February 17, 2003. Mayor Slocomb stated the arrest was not alcohol or drug related. The next review is scheduled for August 20, 2003. Finance Committee Meeting May 21, 2003 - Page 3 UNFINISHED BUSINESS Review request for transfer of funds from Contingency – Rosewood Estates Fencing – Rosewood Estates Fencing was deferred at the May 7, 2003 Finance Meeting and sent back to the Public Works Committee. The Committee met on May 19, 2003. Mayor Slocomb stated after review at Public Works there is no need to draw from contingency and the cost, $9,714.00 is now less that $10,000.00 and therefore does not have to come before the Finance Committee. Rosewood Estates Fencing was removed from agenda. NEW BUSINESS Approval of Developers Agreement, Retention Pond Agreement, Letter of Credit, and Cost Breakdown – MRED (Moorland/Residential) Associates LP – Copies of the documents mentioned below were presented. Discussion took place on Section III: Improvements, A. Public Roads and Streets and B. Private Roads and Streets. Ald. Salentine moved to recommend approval of the revised MRED (Residential/Moorland) Associates – City of Muskego, MRED Planned Development District – Developer’s Agreement; Public Improvement Cost Breakdown, Redmond – Janesville/Moorland – Residential; Letter of Credit; and MRED Planned Development Retention Pond Maintenance Agreement #1 (Lands East of Moorland Road). Seconded by Ald. Schroeder. Motion carried 2 – 0. Ald. Petfalski abstained. Discussion took place on Retention Pond Maintenance Agreement #1, noting that Sandalwood Village Condominium Association, Inc still appeared on agreement. Ald. Schroeder moved to reconsider motion. Seconded by Ald. Salentine. Motion carried 2 – 0. Ald. Petfalski abstained. Ald. Salentine moved to recommend approval of the revised MRED (Residential/Moorland) Associates – City of Muskego, MRED Planned Development District – Developer’s Agreement; Public Improvement Cost Breakdown, Redmond – Janesville/Moorland – Residential; and Letter of Credit; and deferring to the Tuesday, May 27, 2003 Finance Meeting MRED Planned Development Retention Pond Maintenance Agreement #1 (Lands East of Moorland Road). Seconded by Ald Schroeder. Motion carried 2 – 0. Ald. Petfalski abstained. Approval of Developers Agreement, Retention Pond Agreement, Letter of Credit, and Cost Breakdown – MRED (Janesville/Moorland) Associates LP – Copies of the documents mentioned below were presented. Ald Salentine moved to recommend approval of the revised MRED (Janesville/Moorland) Associates – City of Muskego, MRED Planned Development District – Developer’s Agreement; Public Improvement Cost Breakdown, Redmond – Janesville/Moorland – Commercial; Letter of Credit; and revised MRED Planned Development Retention Pond Maintenance Agreement #2 (Lands West of Moorland Road). Seconded by Ald. Schroeder. Motion carried 2 – 0 with Ald Petfalski abstaining. Approval of Agreement with Department of Agriculture for Weights and Measures Inspections – Forwarded to the Committee was a letter addressed to Mayor Slocomb referring to changes in the contract agreement between the City of Muskego and the Wisconsin Department of Agriculture, Trade and Consumer Protection. On November 15, 2002, Secretary Harsdorf approved a fee increase to $400.00 per contract day, the first fee increase in contract rates since July 1994. Enclosed with letter was the new Memorandum of Agreement for Weights and Measures services. The rate of $5,200.00 (increase from $3,120.00 for 2002) represents 13 contract days to complete the Weights and Measures. Discussion took place on creating for the future an Ordinance charging businesses for Weights and Measures services. Ald. Petfalski moved to recommend approval of Memorandum of Agreement, Weights and Measures Inspection for the annual fee of $5,200.00. Seconded by Ald. Salentine. Carried by all. Petfalski stated he and Mayor Slocomb received e-mail from the Muskego Chamber of Commerce Director asking that the City look at doing an Ordinance for City hotel tax so that if a hotel would locate in the City an Ordinance would be in place.
