FCM19960924FINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD SEPTEMBER 24, 1996 The meeting was called to order at 7:00 P.M. by Chairman De Angelis. Also present were Committee Members D'Acquisto, and Suhr, as well as Aldermen Patterson (arrived at 7:15), Pionek, Rasmussen, Salentine, and Deputy Clerk Blenski. Committee Member Sanders was absent. The Deputy Clerk noted the meeting was noticed in accordance with the Open Meetings Law on Friday, September 20. Chairman De Angelis noted that an application was submitted within the lo-day time period for the "Class B" license presently held by Mr. Steve Krzman. Ald. Suhr requested that Page 2 of 9/18 minutes be corrected to reflect a 3-O vote regarding the Davis Right of First Refusal issue. Unfinished Business Ald. D'Acquisto moved to amend determination regarding special charges for Holz Drive Assessor's Plat. The City's utility hardship policy cannot be utilized with regard to these charges. Ald. Suhr seconded. Motion carried. Further review and discussion regarding the contract with Triad Engineering for the Muskego Creek and Muskego Canal Project took place. Ald. D'Acquisto moved to delete "where it is not customary to do so" at the end of the sentence that begins "Should Triad determine it appropriate or necessary to rely on a subcontractor" in Article IV (Page 2 of 6) in the Terms and Conditions of Agreement. Ald. Suhr seconded, carried. Ald. Suhr moved to approve the contract subject to approval of the City Attorney and DNR and the addition of hold harmless language by Triad. D'Acquisto seconded. Motion carried. Ald. D'Acquisto asked if the City was comfortable with Article XI (Page 3 of 6) in the Terms and Conditions of the Agreement regarding "Dispute Resolution." He is concerned about the method of mediation outlined in the article as no one seems to be familiar with it. Ald. Suhr moved to add that the City Attorney must review and approve of Article XI Dispute Resolution prior to execution of the contract. Ald. D'Acquisto seconded, motion carried. Ald. D'Acquisto moved to approve the contract as further amended regarding Article XI. Ald. Suhr seconded. Motion carried. There was no new business. Rasmussen stated that there were still property owners (Blattner and Passler) who were not satisfied with the restoration in connection with the Southeast Sewer Project. Ald. D'Acquisto moved to remove the $27,740 voucher to Mainline Sewer and Water from Sewer Vouchers until the matter is resolved. Ald. Suhr seconded, carried. Ald. Suhr moved for approval of payment of General Vouchers in amount of $578,949.28 and Utility Vouchers in the amount of $139,050.26. Ald. D'Acquisto seconded, carried. Ald.
