FCM199411220 FINANCE COMMITTEE - CITY OF MUSKEGO MINUTES OF MEETING HELD TUESDAY, NOVEMBER 22, 1994 The meeting was called to order at 7:lO P.M. by Chairman De Angelis. Also present were Committee Members Sanders, Dumke and Patterson (arrived at 7:35 P.M.), Ald. Misko, Ald. Woodard, Ald. Taube, Ald. D'Acquisto, City Clerk Jean Marenda, Deputy City Clerk Jill Blenski, Assessor Laura Mecha, Chief Johnson and those per the attached list. The Committee noted that the meeting was posted on November 18, 1994, in accordance with the Open Meeting Law. Mr. Robert Patch, Terra Development, appeared before the Committee to discuss request for Release of Letter of Credit for Overlook Bay. The outstanding remediation work for Little Muskego lake District was discussed and Mr. Patch agreed to extend the Letter of Credit until January 15, 1995. Ald. Dumke moved to approve release of all monies except the monies to be held for the remediation project, subject to receipt of extension of Letter of Credit to January 15, 1995. Seconded by Ald. Sanders, motion carried. The Committee reviewed status of all Terra Development Letters of Credit. 0 Ald. Sanders moved to request a January 15, 1995 extension for all Letters of Credit for the Lake Forest Developments. Seconded by Ald. Dumke, motion carried. Mayor De Angelis discussed with the Committee the need to establish a date for Attorney John Macy to address the Finance Committee on proposed amendments to the Liquor License Ordinance. The Committee agreed that a date should be selected from the first available time which would be the 5th week in January, either Monday, January 30 or Tuesday, January 31, 1995. Mayor De Angelis will have his office confirm a date with Attorney John Macy. The Committee reviewed Letter of Credit for Foxboro North Subdivision. Ald. Sanders moved to defer. Seconded by Ald. Dumke, motion carried. The Committee reviewed the 1995 Operating and 1995 Capital Budgets and made the following recommendations: 0 Park Fund - The Committee reviewed comments from the Public Hearing regarding Mr. Niezgoda's comment to putting netting over Horn Field instead of proposed fencing, and Mrs. Lewis' proposal to eliminate proposed Development funds for Kurth Park. Ald. Sanders moved to recommend no changes to the proposed 1995 Budget. Seconded by Ald. Dumke, motion carried. Operating Budget - 100.3000.10000 Health & Sanitation. FINANCE COMMITTEE - Page 2 November 22, 1994 The Committee noted that .3212 (Other Supplies & Expenses) budget figure was missing. Ald. Sanders moved to add $l,OOO.OO for postage, envelopes and supplies. Seconded by Ald. Dumke, motion carried. Police Department - The Committee reviewed memorandum from Chief Johnson advising of the following adjust- ments that needed to be made: $14,000 needs to be added to Police Receivables (100.0041.0727) for D.A.R.E. reimbursement from Waukesha County, and add $15,750 to Vehicle Replacement (100.2000.3910) as factory prices have increased. Ald. Dumke moved to recommend approval of above adjustments. Seconded by Ald. Sanders, motion carried. As a result of comments made at the November 21, 1994 Public Hearing on the 1995 budget, discussion took place on placing money in the 1995 budget for a complete "walk through" reassessment to be done for every property in 1995. At that hearing, Attorney George Rice had requested that the assessments for 1994 as established by the revaluation performed by Cole, Layer & Trumble, be rescinded by the Council. Mr. Rice had suggested that the 1993 valuations be used with the exception of new properties. Regarding this item and a possible recommendation by the Finance Committtee to amend the budget, Mayor De Angelis stated that two questions exist: 1. Is it legal for the Council to rescind the assessment? 2. Does the fact that the Oaths of Office were not administered to the contracted assistants to the Assessor have an effect on the 1994 assessments? Attorney Molter stated that his research reveals that the governing body cannot rescind the assessment. The Assessor has certified the roll and the Board of Review was held and concluded. Attorney Molter stated that appeal procedures exist for taxpayers to object to their assessment as identified by state statute. He stated that the Council would be in legal jeopardy if they chose to rescind the assessment. Attorney Molter read a letter from the Wisconsin Department of Revenue also supporting his opinion. He does not believe that the assessment should be invalidated due to the Oaths of Office not being administered. Dave Johnson of CLT, the Project Supervisor, answered questions the Council members had regarding the revaluation as did City Assessor Laura Mecha. Attorney Rice stated his opposition to the comments made by the City Attorney and the Wisconsin Department of Revenue. He requested that the Finance Committee recommend to the Council that the 1995 budget be amended to include money for a new 0 0 0 reassessment to be performed in 1995. Patterson moved to deny request upon the advice received from the City Attorney and the confidence the City has in Assessor FINANCE COMMITTEE - Page 3 November 22, 1994 Mecha, who stated that the work performed by CLT was professionally and accurately done. Seconded by Ald. Dumke, motion carried. The Committee reviewed request for Provisional Operator's License for Angela Freitag. Ald. Sanders moved to recommend approval of Provisional License. Seconded by Ald.Dumke, motion carried 2-l with Ald. Patterson casting the dissenting vote. Ald. Patterson moved to recommend approval of payment of General Vouchers in the amount of $2,537,023.38 and Utility Vouchers in the amount of $349,733.91. Seconded by Ald. Dumke, motion carried. The Committee reviewed service agreement with Lanier for Municipal Court recorder. Ald. Sanders moved to approve $73.50 for the service agreement. Seconded by Ald. Dumke, motion carried. Ald.
