COMMON COUNCIL Minutes 20120222-wo Memo COMMON COUNCIL - CITY OF MUSKEGO Approved: 03/13/2012 MINUTES OF SPECIAL MEETING HELD FEBRUARY 22, 2012 Mayor Chiaverotti called the meeting to order at 6:00 p.m. at the Lake Denoon Middle School, W216 S10586 Crowbar Drive. Present were Ald. Fiedler, Schaumberg, Soltysiak (arrived at 6:02 p.m.), Werner, Borgman, Harenda and Snead, City Attorney Larson and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. The Deputy Clerk stated that the meeting was noticed in accordance with the open meeting law on Monday, February 20, 2012. COMMUNICATIONS FROM THE MAYOR’S OFFICE The Mayor stated she called the special meeting because it was the only night that the City Attorney could be present to address the Direct Legislation Petition. PUBLIC COMMENT Mayor Chiaverotti read the protocol for the public comment period. The following registered to speak regarding Reso. #013-2012: Dan Natchek James Dropp Debra Bolton Roy Catron John Bayer Jim Lindhorst requested that his two-minutes be given to Kirk Blomdahl. Attorney Larson stated that did not conform to the policy for Public Comment established by the Common Council. However, the Council can waive the rules. Ald. Soltysiak moved to allow a speaker to yield his time to someone else. Ald. Harenda seconded. Motion defeated 4 against (Fiedler, Schaumberg, Werner and Snead) and 3 in favor (Soltysiak, Borgman and Harenda). Ald. Fiedler suggested that the Council decide the requests on a case-by-case basis. Ald. Werner moved to allow Mr. Lindhorst to give his time to Mr. Blomdahl. Ald. Fiedler seconded. Motion carried 7 in favor. The Public Comment period continued with the following speakers: Kirk Blomdahl Suzi Link Heidi Lindhorst requested that her two-minutes be given to Kirk Blomdahl. Ald. Borgman moved to allow Ms. Lindhorst to give her time to Mr. Blomdahl. Ald. Fiedler seconded. Motion carried 7 in favor. The Public Comment period continued with the following speakers: Kirk Blomdahl Thomas Kapusta John Wehmeier requested that his two-minutes be given to Kirk Blomdahl. Ald. Harenda moved to allow Mr. Wehmeier to give his time to Mr. Blomdahl. Ald. Borgman seconded. Motion carried 7 in favor. Common Council Minutes 2 February 22, 2012 Kirk Blomdahl spoke. Sandra Kapusta requested that her two-minutes be given to Kirk Blomdahl. Ald. Borgman moved to allow Ms. Kapusta to give her time to Mr. Blomdahl. Ald. Soltysiak seconded. Motion carried 7 in favor. Kirk Blomdahl spoke. Keith Rupple requested that his two-minutes be given to Kirk Blomdahl. Ald. Werner moved to allow Mr. Rupple to give his time to Mr. Blomdahl. Ald. Borgman seconded. Motion carried 7 in favor. The Public Comment period continued with the following speakers: Kirk Blomdahl Evangeline Moreno-McCoy Lorie Oliver Elmar Kretschmann Ken Fries Scott Dickmann Jim Rauth Robert Lucas Mayor Chiaverotti read comments submitted by Dan Schwartz. The Mayor thanked all those that spoke during the public comment period. NEW BUSINESS Reso. #013-2012 - Direct Legislation Petition Dated January 30, 2012 Regarding Acquisition of Property on Little Muskego Lake. Ald. Schaumberg moved to put the resolution on the floor. Ald. Fiedler seconded. Attorney Larson reviewed the key points of his February 17, 2012 Memorandum (available upon request). His conclusion is that the petition filed is not a proper subject of direct legislation. He believes the Council should reject the direct legislation petition by acting on Reso. #013-2012. If the Council would like to hold a referendum election, it should adopt a different resolution. Ald. Soltysiak moved to defer to discuss having a referendum at the next meeting. Ald.
