MINUTES OF MEETING HELD JUNE 28, 2011
Mayor Chiaverotti called the meeting to order at 7:05 p.m. Present were Ald. Fiedler,
Schaumberg, Soltysiak, Werner, Borgman, Harenda, Snead and Director of Finance
and Administration Mueller. Those present recited the Pledge of Allegiance. Ms.
Mueller stated that the meeting was noticed in accordance with the Open Meeting Law.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
Mayor Chiaverotti stated she and Ald. Snead met with the Tess Corners Volunteer Fire
Department. A Committee of the Whole meeting will be scheduled on July 12 to
discuss the issues. Mayor thanked the Parks & Recreation Department and Program
Manager Tammy Dunn for coordinating “Olympic Day” activities on June 22. The Mayor
and Community Development Director Jeff Muenkel met with Bill Mitchell, president of
Waukesha County Economic Development Corporation to discuss future development
opportunities. Also the Department of Community Development will provide a quarterly
report on economic development starting in September. The Mayor has received
several positive comments from citizens, contractors and Waukesha County regarding
City Engineer Dave Simpson that he is very professional, knowledgeable and
represents the city well. She also reminded everyone that the next “Jammin’ on
Janesville” event is scheduled on Friday, July 1.
July was proclaimed “Park and Recreation Month.”
No one registered to speak under Public Comment.
CONSENT AGENDA
Mayor Chiaverotti noted the City Attorney requested a few revisions to the Permanent
Sanitary Sewer Easement to be approved under Reso. #090-2011. It can still be
approved under the Consent Agenda. Ald. Harenda requested that Reso. #92-2011 be
removed from the Consent Agenda. Ald. Werner moved to approve the remaining
items under Consent Agenda. Ald. Harenda seconded; motion carried 7 in favor.

NEW BUSINESS
Reso. #092-2011 - Resolution Authorizing the Submittal of a Hazard Mitigation Grant
Application and Appropriation of Funds for Acquisition and Demolition of S76 W18109
Janesville Road. Ald. Werner moved for adoption. Ald. Fiedler seconded. Ald.
Harenda questioned where the City’s share would come from. Mayor Chiaverotti stated
it would come out of the storm water special revenue fund. Motion carried 7 in favor.
UNFINISHED BUSINESS
Ord. #1341 - An Ordinance to Amend Chapter 1, Section 1.05, of the Municipal Code of
the City of Muskego (Board and Commissions). Second Reading. Ald. Fiedler moved
for adoption. Ald. Snead seconded. Mayor Chiaverotti reviewed the proposed
amendments. She also noted that the majority of citizen appointments to committees
are governed by state statute, which makes consistency regarding the terms
impossible. The only appointments that could be changed are those for the Parks &
Recreation Board and the Public Safety Committee. Ald. Soltysiak would like to see the
state statute references regarding the various committees eventually be placed in the
Municipal Code. Mayor Chiaverotti stated that she prefers that all aldermanic
appointments be for one year. This gives the Mayor flexibility and provides the
aldermen the ability to learn about the various boards and commissions. Ald. Fiedler
noted that the Mayoral appointments are subject to confirmation of the Council.
Ald. Soltysiak moved to amend to add “66.1335” to Section 1.05 (9)(b) after the
words, “State Statutes.” The Mayor noted that the City Attorney does not
recommend referencing state statute numbers because they do change. Ald.
Soltysiak withdrew his motion.
Ald. Fiedler moved to amend to add Section 1.05 (9)(c) to state, “The Community
Development Authority is governed by Section 66.1335 of the Wisconsin State
Statutes.” Ald. Harenda seconded. Motion carried 7 in favor.
Ald. Borgman stated he did not support that the proposed ordinance would only allow
citizen appointments who were residents of the community to the Library Board. The
Mayor stated that there can be several occasions where nonresidents can provide
expertise to a committee. Ald. Soltysiak stated that a committee or board could bring

people in to provide expertise; however, he believes that policy decisions and spending
taxpayer dollars should be restricted to residents. Ald. Fiedler moved to amend
Section 1.05 (7)(a) to remove the word, “qualified.” Ald. Soltysiak seconded.
Motion carried 7 in favor.
Ald. Borgman moved to strike the sentence, “The citizen members shall be
residents of the municipality” from Section 1.05(7)(a). Ald. Snead seconded. Ald.
Harenda disagreed that believes the citizen should be a resident of the municipality or
Waukesha County. Ald. Schaumberg suggested that out of the seven citizen members
appointed to the Library Board, two could be nonresidents. Ald. Borgman withdrew
his motion and Ald. Snead withdrew her second. Ald. Schaumberg moved to
amend Section 1.05(7)(a) to add that a minimum of seven members must be
residents of the municipality. Ald. Fiedler seconded. Motion carried 5 in favor
and Ald. Harenda and Soltysiak voting no.
Ald. Fiedler moved to amend Section 1.05 (9)(a) to remove the word, “qualified.”
Ald. Soltysiak seconded. Motion carried 7 in favor.
Ord. #1342 - An Ordinance to Amend Chapter 2, Section 2.09 (3), of the Municipal
Code of the City of Muskego (Special Committees). Second Reading. Ald. Fiedler
moved for adoption. Ald. Snead seconded. Motion carried 7 in favor.
REVIEW OF COMMITTEE REPORTS
The following minutes were reviewed: 5/10/2011 Finance Committee, 5/9/2011 Parks &
Recreation Board, 5/16/2011 Public Works Committee, 5/17/2011 Community
Development Authority, 3/24/2011 and 4/21/2011 Teen Advisory Board.
CLOSED SESSION
Ald. Borgman moved to convene into closed session pursuant to Wis. Stats.
§19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the
investing of public funds, or conducting other specified public business,
whenever competitive or bargaining reasons require a closed session, more
specifically labor union negotiations for 2011. Ald. Snead seconded. Motion
carried 7 in favor.
OPEN SESSION
Ald. Soltysiak moved to reconvene into open session. Ald. Fiedler seconded.
Motion carried 7 in favor.
Reso. #094-2011 - Authorize Execution of the Labor Agreement between the City of
Muskego and the Employees of the Public Works Department and Public Utilities
Department - January 1, 2011 - December 31, 2011. Ald. Borgman moved for
adoption. Ald. Snead seconded. Motion carried 7 in favor.
LICENSES
Ald. Werner moved for approval of a Temporary License to Sell Fermented Malt
Beverages for the Kiwanis Club of Muskego, Inc. for 7/1 and 8/5/2011 Jammin’ on
Janesville, S73 W16610 Janesville Road. Ald. Harenda seconded. Motion carried
7 in favor.

VOUCHER APPROVAL
Ald. Schaumberg moved for approval of payment of Utility Vouchers in the
amount of $50,743.31. Ald. Fiedler seconded. Motion carried 7 in favor.
Ald. Schaumberg moved for approval of payment of General Vouchers in the
amount of $320,849.08. Ald. Fiedler seconded. Motion carried 7 in favor.
CITY OFFICIALS’ REPORTS
Committee reviewed the July calendar.
