COMMON COUNCIL Minutes 20110614 COMMON COUNCIL - CITY OF MUSKEGO Approved: 08/09/2011 MINUTES OF MEETING HELD JUNE 14, 2011 (As Revised) Mayor Chiaverotti called the meeting to order at 7:00 p.m. Present were Ald. Fiedler, Schaumberg, Soltysiak, Werner, Borgman, Harenda, Snead and Deputy Clerk Blenski. Those present recited the Pledge of Allegiance. Ms. Blenski stated that the meeting was noticed in accordance with the Open Meeting Law. COMMUNICATIONS FROM THE MAYOR’S OFFICE Council members received a tentative timetable for the 2012 budget process to review the upcoming dates. Mayor Chiaverotti thanked the Department of Public Utilities for fixing the water problem in the Champion Village subdivision on June 3 in a timely manner. She also thanked the Department of Public Utilities and maintenance staff George Wolwark for fixing a plugged sewer drain at the Muskego Public Library on June 7. CONSENT AGENDA Ald. Borgman moved to approve items engross under Consent Agenda. Ald. Snead seconded. Motion carried 7 in favor. Common Council Minutes – May 10, 2011 Reso. #076-2011 - Approval of a Certified Survey Map – Anderson Reso. #077-2011 - Approval of a Certified Survey Map - Pakulski, Town of Vernon Reso. #078-2011 - Approval of Various License Applications for the City of Muskego for the Licensing Period July 1, 2011 to June 30, 2012 Reso. #079-2011 - Approval of Work Plan #2 and Funding Agreement for the Sanitary Sewer Backup Prevention Program (BPP) and Private Property Infiltration and Inflow (PPII) Reduction Program Reso. #080-2011 - Authorize Execution of Change to Health Insurance Contract for July 1, 2011 - June 30, 2012 Common Council Minutes Page 2 June 14, 2011 UNFINISHED BUSINESS Reso. #065-2011 - Acceptance of Proposal Submitted by Ayres Associates, Inc. for Engineering Design Services for Utility Relocations (Janesville Road-First Phase). On the floor, deferred 5/24/2011. Mayor Chiaverotti stated that the City Engineer did obtain two additional proposals. The cost estimates are significantly higher than the proposal submitted by Ayres. The proposals submitted by the two other firms assume that they would be allowed to work with Ayres Associates, the County’s engineering firm. If not, the cost estimates will be even higher. The Mayor stated that there was a request to delay action on the resolution to obtain the two additional bids. Staff is aware that the City’s current purchasing policy is outdated and is being reviewed. In this case, it is her opinion that it was unnecessary because the County had gone through the bidding process and that is how Ayres was chosen. The City Engineer’s recommendation to use Ayres was based on that. The deferral regarding this resolution did delay the County from starting the project. Motion to adopt carried 7 in favor. REVIEW OF COMMITTEE REPORTS The following minutes were reviewed: 4/26/2011 Finance Committee, 5/3/2011 Plan Commission and 5/4/2011 Public Safety Committee. FIRST READING OF ORDINANCES Ord. #1341 - An Ordinance to Amend Chapter 1, Section 1.05, of the Municipal Code of the City of Muskego (Boards and Commissions). The Mayor stated that she brought the ordinance directly to the Common Council because they did not have any financial impact. The Council can move forward with the ordinances, or can send them to the Finance Committee. Ald. Fiedler requested a standardization of terms for the Library Board and Community Development Authority, which Ordinance #1341 addresses. The Mayor presented her rationale for making the aldermanic appointments for one year. It provides flexibility and the Mayor can re- appoint an alderperson to the same committee after the expiration of the one-year term. The Mayor stated that she wanted to include language regarding appointments to the CDA because there currently isn’t anything in the Municipal Code. Ald. Harenda noted that he would like to see the citizen appointment terms be more consistent, such as for two years. He believes individuals may be hesitant to make a three or four year commitment. The Mayor stated that they would have to be staggered as it would be too difficult to fill all the citizen appointments at one time. She stated she would like to discuss any potential term changes with the affected department heads. Ald. Snead noted that if a citizen cannot fulfill an appointment, he/she can resign. Ald. Soltysiak proposed that the citizen members appointed to the Library Board be Muskego residents. He also noted that he believes this type of discussion is better when held at the Committee level. Ord. #1342 - An Ordinance to Amend Chapter 2, Section 2.09 (3), of the Municipal Code of the City of Muskego (Special Committees). Ald. Fiedler stated that the bottom line is that the Mayor has the discretion to appoint special committees. He believes the language could be simplified. Fiedler moved for approval of a Temporary License to sell Fermented Malt Beverages for the Muskego Chamber of Commerce on July 13 at Idle Isle Park. Ald. Borgman seconded. Motion carried 7 in favor. CLOSED SESSION Ald. Borgman moved to convene into closed session pursuant to Wis. Stats. §19.85(1)(e) Deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, more specifically labor union negotiations for 2011. Ald. Snead seconded. Motion carried 7 in favor. The Deputy Clerk was dismissed. Finance and Administration Director Mueller was present for closed session and the remainder of the meeting. OPEN SESSION Ald. Snead moved to reconvene into open session. Ald. Werner seconded. Motion carried 7 in favor. Reso. #081-2011 - Authorize Execution of the Labor Agreement between the City of Muskego and the Muskego Police Telecommunicators Unit Local #443 of the Wisconsin Professional Police Association/Civilian Employee Relations Division. Ald. Borgman moved for adoption. Ald. Snead seconded. Motion carried 7 in favor. Reso. #082-2011 - Authorize Execution of the Labor Agreement between the City of Muskego and the Muskego Area Public Employees Local 2414 Affiliated with District Council No. 40 of the AFSCME, AFL CIO (City Hall and Library Unit) Ald. Borgman moved for adoption. Ald. Snead seconded. Motion carried 7 in favor. VOUCHER APPROVAL Ald. Schaumberg moved for approval of payment of Utility Vouchers in the amount of $242,858.82. Ald. Harenda seconded. Motion carried 7 in favor. Ald. Schaumberg moved for approval of payment of Tax Vouchers in the amount of $8.74. Ald. Fiedler seconded. Motion carried 7 in favor. Ald. Schaumberg moved for approval of payment of General Vouchers in the amount of $491,424.43. Ald. Fiedler seconded. Motion carried 7 in favor. CITY OFFICIALS’ REPORTS Mayor Chiaverotti clarified that the fireworks permit violations are not retroactive prior to the ordinance being passed in February 2011. She also thanked everyone who participated in the “Jammin’ on Janesville” event on June 3. Ald. Werner stated there will be a Little Muskego Lake District meeting on July 7 starting at 5:30 pm at Tres Loco followed by a tour of the lake. Ald. Harenda addressed the council regarding a consistent start time for the common council meetings. Also the Teen Advisory Board will hold their 1st addition for teen idol at City Hall on July 11.
