MINUTES OF MEETING HELD FEBRUARY 8, 2011
Ald. Snead called the meeting to order at 7:33 p.m. as Acting Mayor. Present were Ald.
Fiedler, Schaumberg, Soltysiak, Werner, Borgman, and Harenda, City Engineer
Simpson and Deputy Clerk Blenski. The Deputy Clerk stated that the meeting was
noticed in accordance with the open meeting law.
There were no communications from the Mayor’s Office. No one registered to speak
under Public Comment.
PUBLIC HEARING
The Deputy read the public hearing notice to levy special assessments for Durham
Drive Sanitary Sewer Project MSS-01-11/Assessment District “SS.” City Engineer
Simpson was present. He stated that the reconstruction of Durham Drive will take place
this year. As part of that project, it was determined that sanitary sewer would be
installed along Durham Drive to provide service to the properties that currently do not
have it. It will be more cost effective to do the sewer installation with the road
reconstruction project. The Common Council adopted the preliminary assessment
resolution in April of 2010. Notification was given to the affected property owners. No
one requested to be heard. Ald. Snead declared the hearing closed at 7:37 p.m.
UNFINISHED BUSINESS
Ord. #1332 - An Ordinance to Amend the Zoning Map of the City of Muskego (Willow
Glen - RM-1 and RS-2 to PD). On the floor, deferred 1/25/2011. Ald. Borgman
moved to defer because the Plan Commission has not made a recommendation
yet. Ald. Werner seconded; motion carried.
Ord. #1337 – An Ordinance to Amend Chapter 9, Section 9.03, of the Municipal Code of
the City of Muskego (Fireworks). Second Reading. Ald. Borgman moved for
adoption. Ald. Werner seconded. Ald. Borgman stated that he would like to revisit
the language in Section 9.03 (3) (e). He would like a verbal warning by the Police Dept.
to be included. Ald. Werner stated there would be no papertrail. Ald. Fiedler prefers
written complaints from citizens be included. Ald. Fiedler moved to amend 9.03 (3)
(e) to include the phrase, “and/or a written complaint filed with the City” following
the words, “under this section.” Ald. Werner seconded. Motion to amend carried
7 in favor. Ald. Fiedler moved to further amend the ordinance to remove the
words, “in May of the following year” in Section 9.03 (3) (e). Ald. Harenda
seconded. Motion carried 7 in favor. Ald. Soltysiak moved to further amend
Section 9.03 (3) (e) to add that all permit applications must be received on or
before the third Friday in June. Ald. Borgman seconded. Motion carried 7 in
favor. The purpose of this was so the Finance Committee could review the permit
applications with issues at the last meeting in June. Ord. #1337, as amended,
adopted with 6 in favor and Ald. Borgman voting no.

CONSENT AGENDA
Ald. Werner moved to approve the items under the Consent Agenda. Ald. Fiedler
seconded. Motion carried 7 in favor.

and Crystal Roecker
Reso. #011-2011 – Resolution to Support the City’s 15% Assessment to the Little
Muskego Lake District
Reso. #012-2011 – Resolution to Establish Fees (Permit to Discharge Fireworks)
Reso. #013-2011 – Amendment to Deposit and Forfeiture Schedule
Reso. #014-2011 – Resolution of Necessity (Fountainwood Flood Abatement Project)
REVIEW OF COMMITTEE REPORTS
The following minutes were reviewed: 1/11/2011 Finance Committee and 12/20/2010
Public Works Committee.
LICENSES
Ald. Snead noted that the application for a change of agent at Pizza Hut was
withdrawn at the Finance Committee meeting.
VOUCHER APPROVAL
Ald. Fiedler moved for approval of payment of Utility Vouchers in the amount of
$94,761.77. Ald. Werner seconded. Motion carried 7 in favor.
Ald. Fiedler moved for approval of payment of Tax Checks in the amount of
$3,797.88. Ald. Werner seconded. Motion carried 7 in favor.
Ald. Fiedler moved for approval of payment of General Vouchers in the amount of
$214,795.92. Ald. Werner seconded. Motion carried 7 in favor.
COMMUNICATIONS AND MISCELLANEOUS BUSINESS
Ald. Borgman acknowledged the efforts of the Dept. of Public Works during the last
snowstorm. Ald. Snead noted that the Muskego High School Boys’ swim team had an
undefeated year.
ADJOURNMENT
Ald. Harenda moved to adjourn at 8:08 p.m. Ald. Fiedler seconded; motion
carried.
